calling on him to step down. erielle reshef is on the scene in albany, new york, with the latest. good morning, erielle. >> reporter: good morning to you, george. that sweeping 165-page report includes searing testimony from those 11 women. governor cuomo denying any sexual misconduct accusing investigators of weaponizing his everyday interactions. this morning, pressure mounting on new york governor andrew cuomo to resign. >> i think he should resign. i understand that the state legislature may decide to impeach. >> reporter: president biden calling for him to step down after new york attorney general letitia james' investigation concluded cuomo sexually harassed multiple women violating federal and state laws. >> what this investigation revealed was a disturbing pattern of conduct. i believe women and i believe these 11 women. >> reporter: prosecutors laying out their findings in a press conference tuesday morning,

saying the governor created a hostile work environment rife with fear and intimidation, including new allegations from a state trooper assigned to cuomo's security detail. >> in an elevator, while standing behind the trooper, he ran his finger from her neck down her spine and said, hey you. another time she was standing holding the door open for the governor. he took his open hand and ran it across her stomach. she told us that she felt completely violated. >> reporter: cuomo defiant, denying the investigation's conclusions in a prerecorded video message. >> i never touched anyone inappropriately or made inappropriate sexual advances. >> reporter: the governor claiming displays of affection were meant to convey warmth to those around him. cuomo including this slide show depicting him kissing and hugging constituents and other politicians. >> i do kiss people on the forehead. i do kiss people on the cheek. on occasion i do slip and say

sweetheart or darling or honey. >> reporter: authorities interviewing 179 people over the course of the inquiry including an 11-hour interview with the governor, former aide charlotte bennett telling investigators cuomo came onto her after she disclosed a previous sexual assault. >> he asked whether she had ever been with older men. he told her that he was lonely and wanted to be touched. he suggested that she get a tattoo she was contemplating on her butt and asked her if she had any piercings anywhere other than her ears. >> reporter: cuomo insisting he was only trying to help, saying he had a close relative who had also been a victim of sexual assault. >> i did ask her questions i don't normally ask people and i did ask questions to try to see if she had positive support of dating relationships. >> reporter: investigators releasing a recording of cuomo singing to bennett on a phone call in 2019.

♪ do you love me, do you really love me ♪ ♪ do you love me ♪ >> reporter: according to the investigation's findings, bennett reported the behavior to the governor's chief of staff but with no investigation. she was reassigned to another role. a violation of policy and an example of the culture in the executive chamber ripe for harassment accordsing for investigators. cuomo saying it is a demanding place to work but blasting the report as politically biased. >> to discredit the legitimate sexual harassment victims the law was designed to protect. >> reporter: that response not a surprise to karen hinton, cuomo's former press secretary, who spoke to investigators about her own allegation of discrimination and harassment which cuomo denied. >> this is the way he always responds, he never takes responsibility for anything. he always pushes it off on someone else. he blames the victims. >> reporter: and support for cuomo within his own party is quickly eroding. it is looking more and more like

he will be impeached. the new york assembly speaker saying he can no longer remain in office. a sentiment echoed by nearly every top democrat. george? >> okay, erielle, thanks. we are joined now by charlotte bennett and her attorney debra katz. charlotte, let me begin with you. he singled you out and apologized to you, but also said you heard things he didn't say, and he was just trying to help you. what were you thinking as you watched the governor yesterday? >> it wasn't an apology and he didn't take accountability for his actions. he can't once apologize and then say he didn't do anything wrong. he blamed me and said that i simply misinterpreted what he had said, but his line of questioning was not appropriate. he was coming onto me and he insinuated that survivors of trauma and sexual assault can't tell the difference between mentorship and leadership and

sexual harassment itself which is not only insulting to me but every survivor who listened to him yesterday. the victim-blaming is not okay. >> when that was happening at the time how did you feel? >> overwhelmed, but mostly vindicated, because i had just listened to the new york state attorney general tell me and the ten other women that we were believed and that was powerful and so much more important than anything the governor had to say. >> the fact that you came forward earlier helped bring this about earlier and turned up several more accusers of the governor. did you have any idea there were others and that so many would come forward? >> i had heard some whisperings of other people talking, but it really came from a sense of supporting lindsey boylan who had first tweeted out her allegations in december. i actually dm'd her on twitter and we had a private conversation in which i told her what i was experiencing and why i left public service earlier

that same year and, you know, when there are two women, there are more than two. you know, we know from experience that it's not just one person and that's why we need to believe every woman who makes these allegations. why do you think itso this to? >> he has been an establishment political figure for so long and he rules by fear. he is scary. i was scared. i didn't know where to turn and when i was still working in new york state, i vowed to myself to never speak of this. i was horrified in the moment and that's the reason why i no longer work there. >> and what should happen right now for governor cuomo? >> well, based on his apology, which was not much of an apology at all yesterday, it seems like he's not living in reality. so it's up to us to take action and, you know, it's really the responsibility of the assembly

speaker to impeach him immediately. september is not soon enough. this needs to happen now. he's a danger. we have the facts and the assembly speaker needs to get to it. >> debra katz, the albany district attorney has now opened a criminal investigation as well, what are the next legal steps? >> at this point charlotte has done -- she's done a heroic and courageous act coming forward, cooperating fully with investigators. at this point it really is on the new york legislature to take decisive action to impeach him because the governor is clearly not living in reality as charlotte said. he's refusing to step down and his performance yesterday was belligerent and made it clear he is unfit to serve. he still does not get it. he still wants to blame the victim and shockingly yesterday he blamed his mother for teaching him how to kiss people inappropriately. he really does not get it. >> and, charlotte, you said you

feel vindicated? >> yeah, it has been a long road. i mean, even before my story came out in february, i left new york state after this happened. i left my job. i left new york state and i was really living in a state of anxiety and panic and it has been a really long road, but yesterday was the start to something new and i -- i'm just happy that we had the investigation we deserved. >> charlotte and debra, thanks very much. robin. so let's bring in our legal analyst dan abrams, george. can you explain why the attorney general was not able to file criminal charges on her own and we heard ms. bennett's attorney talking about the possibility of criminal charges. >> right and, the attorney general specifically said that state and federal laws were violated. the issue is this attorney general was only empowered to

subpoena witnesses, subpoena documents and write a report. that's it. that was the extent of her power here. it would then go to local district attorneys, local investigators and as we pointed out, albany county is investigating. so it is possible that criminal charges could be filed because it is misdemeanor assault to kiss, touch, whatever it is, someone in an unwanted way without their consent, so we'll see what that investigation uncovers, but just because no criminal charges have been filed now doesn't mean that they can't happen in the future. >> he is clearly not going to resign. impeachment is an option, and americans may think they're very familiar with it on a federal level, but impeachment in new york is a little different? >> a little different, right. it still starts in the judiciary committee same way federal, still have a vote in the assembly equivalent to congress which would be a majority vote to decide if they go to trial. if there is a majority vote in

the assembly to impeach he is immediately sidelined and the lieutenant governor then takes over temporarily, and then you have that senate trial where you need the two-thirds. in new york, you also have the highest court judges who are serving as the judges in addition to the state senators, if there is a conviction, he's out. if he is not convicted by two-thirds he would be reinstated, but you have to believe that if there is enough political pressure he is going to know where the winds are going on this. >> civil lawsuits? >> certainly possible moving forward as long as it's within the statute of limitations. >> dan, we appreciate you as always. thanks so much. we want to turn now to another story. a lot of developments in the pandemic. the delta variant is spreading, of course, as you know and the hospitalizations are going up. some hopeful news in the race to vaccinate, the cdc reporting that the vaccination rate has gone up 73% in the past three weeks and the fda is set to approve the pfizer shot possibly, that's just weeks away. our eva pilgrim has the very latest for us.

>> reporter: this morning, news that full approval of pfizer's covid vaccine is coming likely just weeks away. sources telling abc news it could come by early september or sooner. >> i do hope it's going to be within the next couple of weeks. they said hopefully by the end of the month. i hope it's even sooner than that. >> reporter: the fda fast-tracking it, taking an all hands on deck approval and full approval would open the door for more mandates with more cover from legal pushback. several universities, hospitals and the defense department are expected to issue mandates after full approval. many health experts are also hopeful that some of those who are vaccine hesitant will feel more comfortable getting a shot with a fully approved vaccine. this as new york city, the original epicenter of the coronavirus, announces it will become the first city in the country to require proof of vaccination to dine, work out and do many activities indoors. >> it's time for people to see

vaccination as literally necessary to living a good and full and healthy life. >> reporter: with covid cases surging nearly 600% in the last month the mayor calling the new mandate which rolls out september 13th the key to is the city's recovery. but not clear what this means for children under 12 who are not yet eligible to be vaccinated. officials say they're still figuring that out. president biden pushing more in the private sector to require vaccinations and calling out governors of states who have banned mask mandates. >> if you're not going to help at least get out of the way of the people trying to do the right thing. use your power to save lives. >> reporter: and this week san francisco general hospital starting to accommodate what they're calling a supplemental shot of pfizer or moderna vaccine for those people who got the j&j shot and have consulted with their doctor, robin. >> all right, eva, thank you. we'll move on to the

negro leagues. and a whole lot more coming up on "gma," including a parenting alert. swimming instructors are in short supply right now. how can you teach your kids the skills they need to stay safe in the water. that's all coming up. first, the fallout from that bizarre scene on a frontier airlines front. the man groped two of the attendants and assaulted a third. will reeve has the story. good morning. >> reporter: good morning, george, what a wild situation. the man had allegedly been drinking. the video of the incident is quite shocking. at one point there is a thrashing physical confrontation. the largest flight attendants union in the country is now speaking out against frontier airlines and how it handled the aftermath of this, just the latest incident in the sky. this morning, fallout growing from this disturbing flight fight ending in a passenger being wrapped in tape. >> help! >> reporter: 22-year-old maxwell berry now facing charges accused of unruly behavior on a frontier airlines flight from philadelphia to miami saturday. >> you guys [ bleep ].

>> reporter: police say berry had been drinking and groped two female flight attendants and assaulted a male flight attendant. berry seen here swinging at the man trying to restrain him. >> he started raising his voice, cursing, then i realized that he was drunk. >> reporter: the flight attendants trying to get him under control duct taping him to his seat. the passenger who shot this video saying the crew did the best they could in the situation. >> they were very professional in my opinion. they had to restrain him because he was a danger for all the or himself. >> reporter: berry arrested upon landing, now faces three could wants of battery, but the airline under fire this morning for its handling of the crew members involved saying in an initial statement, the flight attendants had been suspended pending further investigation, claiming proper policies for

restraining passenger had not been followed. amid backlash from the union representing flight attendants the airline revising its language to claim the employees are on paid leave. this caught on camera fiasco is just another in a spate of incidents with unruly passengers this year. in its new weekly report the faa counting more than 3,700 such incidents since january 1st. >> what we have been saying since the beginning of january is that this new circumstance in aviation is simply something that flight attendants have not been trained for. if we don't get it together really soon across aviation and government it is going to make people question whether or not they can come to work and be safe and whether or not they want to buy a ticket on air airplane. >> reporter: frontier says that it is supporting the prosecution of the unruly passenger. we reached out to maxwell berry, did not hear back, george. >> and will, meantime, so many are still having trouble with cancellations. >> reporter: yeah, really spirit airlines especially. 45% of spirit airlines' flights today have already been canceled.

that's after yesterday 60-plus percent of their flights were canceled. at one point yesterday only 25 spirit airlines flights in the sky. spirit telling abc news that an i.t. issue is to blame. we'll see if that gets resolved today. >> will reeve, thanks very much. we want to turn to surside, the tragedy there seeing newly released body camera footage that shows the chaos and confusion to the first responders in the minutes after that building collapsed. our victor oquendo is in surfside. good morning, victor. >> reporter: good morning, t.j. the videos you're about to watch are body cameras worn by three of the first police officers here on the scene. people were so confused they thought it may have been an earthquake or a plane hit the building. we want to warn you these videos are tough to watch. >> is anybody there? >> reporter: this morning, the shocking and painful new body camera video released showing police responding just minutes after the tragic surfside building collapse. the first officers on the scene

in disbelief. this officer calling his captain alerting him to the devastation. >> captain, the champlain towers, the building, it collapsed. fire rescue on its way. this is huge. i mean humongous. >> reporter: one first responder who lives in the building warning officers. >> i was there with my family. >> what happened? all the way at the top. i'm on my phone -- sorry, man. the whole [ bleep ] back is gone. >> reporter: you can even hear screams coming from the building. >> there's screaming, bro. people are screaming. >> reporter: and here it appears this officer is walking underneath the remaining part of the champlain towers south. >> are you okay? is anybody down there injured? >> yes. >> reporter: cars seen dangling into the now collapsed garage. and overnight, security guard

more on that bombshell report from new york's attorney general. it found that governor andrew cuomo sexually harassed 11 women facing pressure to resign. sunny hostin is here to analyze. sunny, thanks for joining us. you've seen the report. as a former prosecutor is there enough evidence there to successfully bring criminal charges? >> you know, i think you have to look at this in three buckets, george, because this investigation that resulted in this report is largely civil in nature so when you look at the civil bucket i do think it's a very strong case. you have 11 alleged victims and usually you don't need corroboration, one victim is enough but corroboration certainly makes a case stronger. the legal standard here is whether or not it was severe. whether or not the behavior was pervasive. when you have 11 victims coming forward certainly that is pervasive, a toxic work environment based on gender-based harassment. when you think about severe, and look at some of the allegations, yes, they look severe.

a strong civil case, no question. when you look at the criminal bucket though, a lot of the allegations don't necessarily rise to the level of criminal behavior, but there are some instances in my view that do or could rise to the level of criminal behavior. you look at the state trooper who says she was really i think groped. she was groped on her stomach. she was groped perhaps on her breasts. you have someone else who alleges groping on her buttocks. that could be sexual assault so i think the criminal bucket, there is a possibility there. but the most present i think pressing bucket would be the political bucket. will he continue to govern? can he continue to govern? what about impeachment? impeachment, we've learned a lot about it over the past couple of years. high crimes and misdemeanors is generally the federal standard,

but the new york statute is a little more vague which makes it in my view a little more broad and so can he be impeached by the senate plus seven judges, that is an avenue that could be likely here given the allegations. >> and of course, if he faces the trial he has to step aside at least temporarily. we saw the governor's response yesterday saying i'm an affectionate guy, my actions were misunderstood. is that a kind of defense that could hold up in a courtroom? >> no, and i'm actually sort of surprised we heard the governor's response. generally when you're someone that's facing civil litigation, potential criminal litigation, potential impeachment the best response is no response. i'm not sure which crisis manager is advising him or which group of crisis managers are advising him but i thought that certainly was a misstep. >> though, on the other hand in a political situation you have choi b tdeouelf bee rit w it's in the h iis t . thanks vy mu. let's o ng.

thanks to frequent body checks and amazing doctors all is well. an estimated 3 million people are diagnosed with the condition every year caused mainly by uv exposure. carcinomas look like little red bumps. >> remember, go and get it checked and wear sunscreen. >> reporter: while jackman has not revealed the results of his latest biopsy he's urging others to get checked. >> if you see a shot of me with this on do not freak out. thank you for your concern. i'll let you know what's going on but i think it's probably fine. >> reporter: we hope it's fine too, hugh. joining us is board certified dermatologist dr. whitney bowe. explain to us the different types of skin cancer. good morning to you. >> good morning. there are two main types. there's melanoma, which is the most deadly form and then there's nonmelanoma skin cancer like basal and squamous cell carcinoma. look out for any spot bleeding, itching or changing in size, shape or color or anything new

that catches your eye, robin. i've diagnosed basal cell carcinomas that look like a pimple on the nose that wasn't going away or a sore that isn't healing. if you see anything like that on your skin, you want to make an appointment with a board-certified dermatologist. >> what can we do between visits? >> if your derm suspects a lesion, she will perform a skin biopsy, simple in-office procedure that takes a few seconds but it can actually save your life. all these forms of skin cancer are highly treatable if they're detected early and in between those office visits, i do recommend that my patients look at their own skin from head to toe about once a month and recruit a friend or loved one to check your back, the backs of your legs, the spots you can't see. >> and what are some overall preventible measures we can take every day? >> so, robin, you know i'm stressing sunscreen, reapplying

throughout the day, right, but sunscreen is not enough. you also want to think about things like a broad-rimmed hat, sunglasses, sun-protected fabrics and seek shade when the sun is at its peak in the middle of the day. >> and we need to emphasize all skin types here, right? >> all skin types, in fact people with skin of color are more likely to be diagnosed later when it's more challenging to treat these cancers. so absolutely, no matter what color your skin. >> as always, always a pleasure to see you, dr. bowe, thank you. we have a parenting alert now for the summer pool season. experts are warning the lack of swim lessons during the pandemic combined with a shortage of lieguards may be putting more kids at risk. diane macedo is here with a look at what parents can do to keep kids safe. good morning. >> reporter: good morning. so many kids missed out on lessons last year. because of pool closures. now newly re-opened pools are having a hard time finding swim

instructors. that means many families including mine still can't find swim lessons for our kids, so we went to the experts to find out how to keep them safe while we wait. swim lessons are one of the most important layers to water safety, but getting them isn't so easy this year. >> many have not had access to water over the past year or swim lessons, so children may not have the swimming abilities that we might expect. they also might have regressed a little bit. >> reporter: the consumer product safety commission says drowning is the leading cause of death for kids 1 through 4 and "limited experience around the water due to recent social distancing restrictions could put them at greater risk of drowning." but the u.s. swim school association says even as more pools re-open many have long lines for swim lessons due to capacity from covid. that's leaving many kids like my son unable to get a spot.

we tried to put him in but the pool nearby us is still closed and all the other areas are boxd up. >> we certainly have more inquiri inquiries than we can meet. >> reporter: brandon hears from frustrated parents every day and says under constant supervision there are things parents can teach their kids in the meantime. first tip, teach your child they need to be invited into the water with a cue like one, two, three jump before they get in. >> yay! >> ready, one, two, three, under. >> reporter: next, he says it's important to get little ones used to water on their faces and you can ease into it by starting with shoulders, neck and ears before finally getting the full head and face. >> we want them to be used to water in their face so then they can learn to take a breath, hold water totalm anrelaxed d tr. >> ta skil tacflt, aka the starfish. brendan says to put your face
