amanda: favorable conditions helping firefighters on the frontlines of the caldor fire containment up to 37%. the fire grew only slightly overnight. the total size passing 214,000 acres. some people are returning home. abc news reporter kate larsen is tracking the process. kate: new flames north of kirkwood ski resort. >> fires jumping out half mile from the fire activity taking place. kate: cooler conditions me the caldor fire has slowed. >> that represents all of the hard work firefighters on the ground have gone through to get there, and that is getting us to the repopulation. kate: evacuation orders listed for many in the yellow zone. >> just because you get released back doesn't mean we are scot-free. kate: the echo lake area continues to be a challenge.

kate: the fire was rapidly through that area. some cabins were lost, many historic cabins were saved. kate: they spoke from a base camp set up at heavenly ski. how is firefighter morale? >> there is fatigue with the firefighters because there's been a lot of fires burning and they have fires. some of these guys haven't been home for weeks, going on months. kate: homes empty and many businesses closed. a few people snuck in a swim despite the coast guard asking everyone to avoid activity on lake tahoe until the fire has subsided.

>> we know people love tahoe and we feel your love but now is not the time to come. kate: the fire marshal wanted me to share that the fire clearance that they have done has saved many homes. and second how grateful fire crews are for everyone's support, especially hotels in southlake tahoe who have been housing them. i'm kate larsen, abc 7 news. amanda: as firefighters come in, more help could be on the way for residents who have been forced to leave. a major declaration would be in addition to an emergency declaration approved by president biden earlier this week. we spent yesterday on the frontlines lines of the firefight and has more from tahoe. wayne: the immediate future of lake tahoe. >> i want clear air. you come for clear air.

gil: good morning. amanda: what are the defenses we may see? gil: leading defense is that she did not intend to fraud anybody. the government has to prove she did. we will sear to arguments in support of that. first was that she was surrounded by people far more seasoned and more experienced, including former secretaries of state and a former four-star general and business leaders. she relied on them to tell her whether the company was acting fraudulently and it appears we will hear a defense that she was abused, sexually, emotionally by her then boyfriend and the coo of the company, so much so that she lacked the ability to make decisions and form the intent to defraud. amanda: what are the advantages and disadvantages to this defense regarding him? gil: it changes the focus from whether the statements that were made were false.

that could be a high hill for her to climb. it changes whether she was abuse and tondeking and capacity to io do wrong. that is a safer playing field. it may simply be difficult for the jury to square this picture of someone who cannot make decisions for herself with a confident image and i fully expect the government to present evidence that she ran the company and knew what she was doing. amanda: how does the startup culture play into the trial? gil: the startup culture is front and center. she and her lawyers will want the jury to understand and believe that this is what happens in the startup culture. you make exaggerated claims about your products. the problem there is that can be a very successful defense if you are talking about predictions of future financial performance. but this there are but -- but if there are statements about did
