to, starting with the latest on the pandemic, delta surging. hospitals around the country being pushed to the limit. the u.s. now surpassing 40 million covid cases during the pandemic and more than 252,000 pediatric cases reported just last week. that is the highest weekly total yet and children hospital admissions on the rise again at their highest point on average about 365 children being admitted to the hospital each day. >> more states are now calling on military personnel for help including idaho where health authorities have officially declared a crisis. kaylee hartung is in boise with the latest. good morning, kaylee. >> reporter: good morning, michael. as cases skyrocket in idaho some hospitals are running out of beds. even more are running out of staff. they have had to turn to what officials are calling the last resort, rationing healthcare. this morning as millions of children start the school year, the u.s. setting an alarming new record. more than 252,000 children diagnosed with covid last week.

the highest number of pediatric cases since the pandemic began. >> we're calling this the fourth wave but it is certainly been by far the most impactful surge, really hitting children and adolescents. >> reporter: in texas where the number of children hospitalized with covid hit an all-time high, 11-year-old levi tested positive a few days after going back to school then spent four days in a hospital bed. >> just felt horrible throughout the whole time. >> he's now recovering after fighting for his life. >> i would say to take it seriously and to protect yourselves from what can be a really, really dangerous and awful disease. >> reporter: hospitals across the country are now calling for help and the department of defense is answering sending military medics to support alabama, arkansas and idaho. >> this is a war against covid. it is not over. we are very much in the middle of the battle. >> reporter: idaho's governor calls it an unprecedented point in the state's history, the

health department activating crisis standards of care for ten could face long wait times. >> when we get short on certain supplies, oxygen or ventilator equipment or what have you, that may require us to make some tough decisions about who gets what when. >> reporter: doctors say this time around, the surge feels and looks different. >> we don't have to have these patients in our icus. every single patient i've seen in the intensive care unit has been unvaccinated and also younger. >> reporter: that was the case for 31-year-old alexandra. she wanted to do more research. before getting the vaccine. >> i don't have a lot of energy for talking, so i'm going to try to make this quick. >> reporter: but she was too late. she lost her battle to the virus just days later in this final video posted on the tiktoker encouraging followers to get the

shot. >> don't wait. go get it because hopefully if you get it, then you won't end up in the hospital like me. >> reporter: the cdc has released two new studies finding that since the delta variant has become predominant these covid-19 cases in children and adolescents are increasing in number, but not in severity. that means based on what we know a child is not more likely to get severely ill or die from delta but we are seeing a rise in hospitalizations because of the sheer number of kids who are testing positive now. george? >> thanks very much. let's bring in dr. ashish jha, the dean of the brown university school of public health and dr. jha, let's sort through some of this. hearing talk of the fourth wave but dealing with two different americas, the america where people are vaccinated, the america where peope aren't. >> yeah, good morning, george. thanks for having me here. that's exactly right. for people vaccinated, they may get the infection, they may get a breakthrough but it'll be mild and won't end up in the hospital but for people not vaccinated

this is a very, very dangerous moment. people are ending up in hospitals in unprecedented numbers and kids who are not vaccinated are getting infected largely from the adults in their lives so we have a lot of work to do to protect kids as well. >> what do you make of the mu variant we've been hearing about? >> look, there are going to be more variants, as long as it is a global pandemic and the virus rages around the world we will see new variants. mu comes from colombia. lambda comes from peru. we'll see things like this. i'm not worried right now about the mu variant. i don't see it displacing delta i don't think mu will end up s,- taking a major hold in the u.s. but we have to watch the data and see where it goes. >> what do we do about the surge among children right now? >> yeah, there are two thing, certainly for kids 12 and over they should get vaccinated. there is no doubt about that. that kids will benefit from the vaccine. the question is what to do about kids under 12 and there are two parts to that. as i said earlier kids get

infected from the adults in their lives. that's the major source. if you don't want to get vaccinated for yourself get vaccinated for your kids and we have to push the fda to get kids under 12 vaccinated as soon as that is available. i don't want bureaucratic slowups on that. >> a lot of confusion about boosters as well. who should get it and when can they expect to be able to get it? >> yeah, i think we'll hear more formal guidance from the fda and cdc. i think the science on this is becoming clearer. vulnerable people, older people, frail people with chronic diseases should be undoubtedly get the third shot. the question around young healthy people getting the third shot, that is more open. we'll see where the fda and cdc land on this as well. >> dr. jha, thanks, as always for your time and information. amy. turning to that breaking news from overnight a powerful earthquake rocking mexico near a popular resort city. marcus moore joins us with more on the destruction. good morning to you, marcus. >> reporter: amy, good morning. the 7.0 magnitude quake struck

as many were getting ready for bed and we know this morning at least one person is dead. these are images of the destruction coming in this morning showing the violent shaking, walls that have crumbled and lightpoles that have collapsed into streets and on to cars. this quake was centered about ten miles outside of acapulco but the capital city, buildings swayed there in mexico city. that is 200 miles away. mexico's national civil defense said it was conducting reviews in ten states, but outside of the one fatality, we know there have been no reports of serious injuries or catastrophic damage. still, a frightening night for people in that region. many who got no sleep overnight, over fears of aftershocks. and there have been more than 90, amy. we'll continue to follow developments of this as they come in this morning. amy?

>> wow, my goodness. we know you will. thank you for that. we turn to the severe weather that is on the move sweeping through the midwest and now heading for the northeast. those were the areas just hammered by ida now on alert for flash floods. ginger is tracking that for us. good morning, ginger. >> good morning, amy. let me show you what this front is capable of. take a listen first. so that's hail in illinois. they were just getting blasted but up to softball-size hail in wisconsin. that same line of storms bringing up to 72-mile-per-hour winds so we're not even talking 60 which is the threshold for severe but this is the type that rips trees out of the ground and takes down power lines and did so in muskegon, the trees all over roads in the city and now we'll have to deal with this moving east and started up in far western new york and pennsylvania along that cold front, the severe storms will blow into, say, arlington, virginia, up through scranton to burlington, vermont, and even

tornadoes but the flash flooding with everybody so tender after ida is so concerning. one to three inches falling quickly from new york city, trenton back to scranton and down to philly needs to be on the lookout. that happens tonight. >> definitely need to be on the lookout. thank you so much for that, ginger. now we turn to the latest on afghanistan. secretary of state blinken touring the evacuation operations at the u.s. air base in ramstein, germany, moments ago. thousands of afghans are there and martha raddatz joins us from washington with the latest on the taliban's new government raising more concerns. good morning, martha. >> reporter: good morning. the taliban had promised an inclusive government, but there are no women, all are members of the taliban and many with a very worrisome past. this morning, afghans are waking up to a new taliban government that sounds very much like the old. filled with taliban commanders

and terrorism suspects including sirajuddin haggani with a $5 million bounty on the fbi most wanted list, accused of brutal acts of terrorism and ties to al qaeda and his uncle khalil named minister of refugees designated a global terrorist and a $5 million reward on his head and the new intelligence chief, mullah abdul haq wasiq. a former gitmo detainee. in their first statement the newly appointed leaders say they will take steps to protect human rights, but they have already disbanded the ministry of women's affairs, the lead agency for promoting women's rights. this as thousands desperately fled the country during that chaotic and dangerous evacuation, many families separated in the process. aid groups now identifying 300

unaccompanied afghan children who evacuated, still not reunited with their parents. but for thousands more who have escaped, a glimmer of hope. u.s. officials announcing up to 95,000 afghan evacuees will be accepted in the u.s. over the next year. and after they have been in the country for 12 months, they will be eligible to apply for a green card on a fast track to permanent legal status. of course, there are thousands including about 100 americans who are still trying to leave the country. michael. >> and, martha, there is a new poll that shows many americans feel less safe than before the 9/11 terrorist attacks nearly 20 years ago. >> reporter: exactly, michael. the new abc/"washington post" poll shows less than half the country, 49% sees the u.s. as safer from terrorism than it was before 9/11. that's down from 64% a decade ago and among the weakest ratings of u.s. anti-terrorism

efforts in any abc news/"washington post" polls all likely reflecting the partisan divide in the country and tumultuous withdrawal of u.s. forces from afghanistan. michael? >> martha, thank you as always. george. the latest now on the texas abortion ban. it includes no exception for rape victims and governor greg abbott is under fire for his comments on that and cecilia vega has the story. good morning, cecilia. >> reporter: good morning to you. once again the second's largest state is ground zero for these restrictive republican-led laws that carry sweeping consequences. and this morning, there are even some democrats who are calling on the biden administration to do more to fight them. this morning, growing outrage over governor greg abbott's stunning response to a question about why texas' new abortion law lacks an exception for rape or incest. the republican governor's answer, his state will eliminate the crime of rape altogether. >> texas will work tirelessly to make sure that we eliminate all

rapists from the streets of texas by aggressively going out and arresting them and prosecuting them and getting them off the streets so goal number one in the state of texas is to eliminate rape so that no woman, no person will be a victim of rape. >> reporter: the reality abbott has not required the legislature to take up any rape prevention legislation. the backlash fierce. >> the majority of people who are raped and who are sexually assaulted are assaulted by someone they know and these aren't just predators that are walking around the streets at night. it's not just ignorance but it's ignorance that it's hurting people across this country. >> reporter: now the biden administration is facing growing calls from within its own party to take a more aggressive stand. 22 house democrats writing a letter to attorney general merrick garland saying we urge you to take legal action up to and including the criminal ppro vigilantes attempting to use the private right of action established by that blatantly

unconstitutional law. the attorney general has said the justice department is urgently exploring options but the white house concedes they he state of texa >> reporter: this after abbott signed into law one of the most restrictive voting measures in the country. >> we must have trust and confidence in our elections. >> reporter: despite no evidence of widespread voter fraud in the 2020 election, in texas or anywhere else, the new law now bans drive-through voting and 24-hour polling locations which have increased turnout among minorities. it also no longer allows election officials to send mail-in ballot applications to voters who haven't formally requested one. in addition to those two things the governor added another special session. the republican majority there is going to take on more politically charged issues, george, including trans youth sports, redistricting and vaccine mandates.

♪ britney's father, jamisp filing a petition through his attorney to formally ask the court to end the conservatorship. the filing reviewed by abc news states, she wants to live her life as she chooses adding that he believes britney is entitled to have this court now seriously consider whether this conservatorship is no longer required. ♪ my life has been so overprotected ♪ >> reporter: the 39-year-old pop star broke her silence about it back in june addressing the court for more than 20 minutes calling the court ordered conservatorship which is controlled in part by jamie spears abusive. in june britney told the court she says she's not allowed to ride in a car driven by her boyfriend or make her own decisions about birth control, imagine or having more children and jamie spears agreed to step down as britney's conservator of estate

but not until now he said it should end. ♪ stronger than yesterday ♪ >> britney's legal team has shown absolute brilliance in how they've moved this case forward on a very fast time line. >> reporter: it's a goal britney's ardent fans and the free britney movement have long fought for. [ crowd chanting ] >> now that jamie spears is leaving the case, there's very few roadblocks to having the entire conservatorship removed. >> reporter: but her attorney, mathew rosengart, saying if the judge does agree to dissolve it, it won't be the end of britney's search for justice and accountability telling abc news having exposed his misconduct and plan to hold his daughter hostage by trying to extract a multimillion dollar settlement, mr. spears has now effectively surrendered adding that he intends to depose jamie spears as part of an investigation into financial mismanagement. so the big question, what's next?

ultimately the decision to end the conservatorship now rests with the judge who has been overseeing the case. she would have to approve the request, guys. >> thanks very much. let's bring in chief legal analyst dan abrams. here with us right now. what a twist this is. why now? >> if you read the petition and you read what jamie spears is saying, he would say it seems that she now wants this to end. it seems that she's able to make more decisions for herself, but what you read through the lines on this is jamie spears' petition is pushing it on everyone else and saying the judge determined she can hire her own lawyer and she says that she wants to end the conservatorship and she says that she can make decisions for herself. so if that's the case, then you should end the conservatorship so in a way he's not even taking responsibility for his -- for this decision. he's saying you guys all seem to have decided that the conservatorship should end, so

if that's the case, then i'm going to join as well and say it should end? >> we heard eva say the judge has to approve this. any reason to think a judge won't approve it? >> we don't know still exactly what led to this conservatorship being put in place. so we can't answer that question definitively without knowing exactly why this has been in place for this long but it certainly seems that all indicators are that at least the conservatorship over the person, remember, there are two conservatorships over the person where she gets who makes medical decisions, who she associates with, that one is pretty clearly going to end. does the one on her finances end as well, i don't know. we'll have to say. >> how long would this take? >> look, it's been 13 years so i don't think it will happen tomorrow or today. but there is a hearing at the end of the month. it could happen as soon as then. so i'd say at the soonest it would be a few weeks, but it could certainly extend beyond that.
