trying to help governor newsom to keep the job. biden will join at a campaign rally in long beach. amy hollyfield is live at city hall. amy: good morning. city hall is an early voting option for you today if you want to get this done. all polling places will be open tomorrow for the election. volunteers were out this morning working hard to make sure people know about this. they were not all talking about the issues. many just encouraging people to vote. somewhat door-to-door and others held rallies. volunteers say they are just hoping they were member to vote. >> our campaign is to get out and vote and it does not matter who, what, when or where. we believe in voting because this is the lifeline of the united states.

jennifer siebel newsom of working with harvey weinstein. her brother-in-law works of the law firm and is the son of the cofounder. >> you don't think jennifer siebel newsom went home after making contact with me and talking to her husband? if her brother-in-law is the son, it makes him the son of gavin newsom. they are in it together. >> a spokesperson told abc news the allegation is "a complete fabrication." today, john coxe is also hitting the campaign trail. governor newsom had attended a party there last year when coronavirus first it. this is part of the recall.

we do not expect any big gimmicks like this one when he was criticized by animal welfare activists by including a live bear. >> police are trying to find the person who attacked a demonstrator out of rally in san rafael yesterday. demonstrators say it is the latest example of the backlash they are facing. tim johns has the story you will only see on abc 7 news. [horns honking] tim: on a pedestrian walkway over the 101 walkway in san rafael the recall election hit a fever pitch. they say they were making their voices heard when a man approached them holding a knife. >> he was slashing down the sign. tim: while she did not witness the event she spoke to abc 7 on

those who did. after the man started destroying the signs when demonstrator confronted him trying to get him to stop. >> the assailant came toward him and pushed him back and started punching him. tim: following the attack though man fled on foot, his victim to be transported to the hospital where another group member said he was diagnosed with a fractured skull and broken jaw. while it angered rallygoers gibbs says this is nothing new. >> we are in a situation where freedom of speech is in danger. tim: many say it is just another example of the kind of anger that has been directed at recall demonstrators and pointed to an incident yesterday were woman through an egg at larry elder. >> we do not do that kind of stuff. we don't attack people who we disagree with. that site attack the people we disagree with.

and not eligible to be vaccinated. that warning comes as one in four new cases are in children. more than a quarter million new cases were reported in miners two weeks ago. that was the highest number of cases on record since the pandemic again. the former head of the fda says if things go according to plan. -- if it goes according to plan, we could have a vaccine available later on. >> you could have one by halloween. >> that is the goal, october. we are doing everything we can. jobina: one million public school students return for in person learning and two schools in pennsylvania switched back to online learning after a major covid i break -- major covid outbreak.

>> a fast-moving wildfire in mendocino county has destroyed multiple homes. the hopkins fire started yesterday right along the river. it shows multiple homes in flames or burned to the ground. about 275 acres have burned. it is just 10% contained. kumasi: warm and dry conditions are keeping the fire active. it is 65% contained but there are positive signs. yesterday, a stretch of highway 50 from icehouse road to kyburz was reopened. more evacuation orders have been downgraded but 16,000 structures are still threatened. more than 219,000 acres have burned. more funding is available to help caldor fire victims after president biden declared that a major disaster in the state of california. he ordered federal assistance to supplement state, tribal and

local recovery efforts. funding is also available to certain nonprofit organizations. >> trust funds have to compensate california victims say they are short 2.5 ilya dollars. those who file claims may never be fully compensated. that was the message from a trust of the fire victim trust which was established to benefit survivors impacted by three major northern california fires ignited by pg&e. one of those was the deadly 20 fire in butte county. nearly 70,000 people have filed a claim. the trust says remaining money is in pg&e stock and has yet to be sold. kumasi: an apartment building explodes leaving behind a shell of a building. one investigators say might've triggered the blast. reggie: the gulf coast bracing for another storm. tropical storm nicholas marching toward texas. michael have more on that path. mike: as i look at the latest

reggie: tropical storm nicholas is heading toward texas and expected to bring heavy rain and in coastal areas of louisiana and mexico. the governor of texas placed emergency teams on standby along the coast. louisiana's governor declared a state of emergency last night. that state still recovering from hurricane ida. mike nicco standing by with a look at the path of the storm. mike: let's start with good news. it is only a tropical storm and

60 mile-per-hour wind and very little time to ramp up much more. but it will. it is kind of disorganized with the heavy rain over the gulf. that is nice until we get into tonight and tomorrow when it starts to come ashore and pushes that shield of rain into the southeastern part of texas and across louisiana. that is where we are going to see a whole lot of flooding. just follow the purple. that is where we start at 5:00, even the wider 10 inches of rain. it is going to be the inland rain and flooding that will be the biggest issue. back at home you can see a ton of sunshine in the south bay. 54 santa clara all the way to 61 in san jose. 60 in alameda, low to mid 60's in the east bay valleys, 57 san francisco right now. we have a nice wind at the golden gate the coast from overheating. if you are out elsewhere, it will be warmer. watch out if you are exercising, running errands.

the air quality should be good and if you have been running the ac, another day to do that. mid-90's in the east bay valley, 92 south bay, 88 and nearly 90 in the north bay, 70's around the bay with low to upper 60's at the coast and san francisco where it will be breezy from time to time. let's turn it over to jobina for the morning commute. jobina: good morning. we had an earlier crash and stall the altamont pass that slowed things down. from tracy to dublin it will be 57 minutes for the drivetime. antioch to concord things are slowing down. moving over to a live picture of the bay bridge the metering lights are on and where we see the backup -- although still not bad. look at the richmond san rafael ridge and things are heading pretty good.

chp has a wind advisory in effect. kumasi: thank you. are you too busy? having too much free time maybe nearly as bad for our health is having too little. it focused on how people spend discretionary time. either exercising, watching tv, other hobbies. people who had a full seven hours to fill with something to do felt more unhappy, especially when engaging in unproductive activities than those that had 3.5 hours of free time. so, if you are planning to retire, spending your newfound time with purpose is the key. ok. reggie: it kind of seems like, from what i read, about two hours is the key amount of free time per day. anything more is stress, anything less is stressed. kumasi: i feel like you should be doing more with your time? like you feel guilty about relaxing? reggie: yeah.

[laughter] reggie: thank you. i will not. welcome to monday. here is a look from the coast. the clouds are broken as the push into the bay and in the distance we have high clouds and hazy conditions. mike: especially as the warmest afternoon unfolds today and tomorrow. little bit warmer than average. as we head throughout the forecast the north bay has a chance of showers saturday and the fire risk is increasing next week and could be the first significant offshore wind event. we are in the height of fire season the next several weeks. as far as temperatures 92 morgan hill, 83 and 89 for the rest of

department got in on the gig at this weekend's bluegrass festival. good morning and welcome to monday, september 13. you're watching abc 7 mornings. kumasi: will want to start with the forecast with mike. mike: good morning. nice to see you. thank you for joining us. first, we opened the weather window and show you what it looks like from mount tam. you can see low clouds making the late push on a light breeze as high pressure dominates the weather. temperatures mainly in the 50's through the morning commute. 48 santa rosa, 63 antioch, and toward noon any cloud cover will be right around half the bay. the rest sunshine. not a spare the air day. upper 60's and mid-seventies around the bay. mixture of 70's and 80's inland by noon. the 80's become dominant inland, in the south and north bay as well.

everything you need to know about the race to replace governor newsom is on our website, abc7news.com under the features section. kumasi: we have breaking news. a shelter-in-place has been ordered at san jose after a vehicle hit a building and started a gas leak. this is on wo101. people are being told the shelter-in-place and there are traffic controls in place. pg&e is responding. we will track this and let you know when we get more. with hospitals in some parts of the country becoming overwhelmed with covid patients the biden administration is pushing workplace based vaccinations. jobina is live to tell us how legal these are. jobina: president biden's vaccine mandate is the most aggressive push by his administration to get more americans vaccinated. critics say he is walking back on previous promises not to implement a vaccine mandate. the president has ordered the labor department to create a new

rule mandating companies with 100 employees are more demanding vaccine or conduct weekly covid-19 tests for those who opt out, either through religious or medical exemption. governors can hand down these mandates but abc news chief analyst dan abrams says the federal government's case is not a slamdunk. >> anyone getting federal funds they have control over. but it is demanded of the larger companies where i think there could be serious challenges. and remember, the best challenges are not going to come from the governors, it is going to come from employers saying, for whatever reason, we don't want to implement this. osha has typically lost to these kinds of cases in court. jobina: companies face a penalty of $13,000 per violation but it will take time for these to be enforced. federal employees and contractors along with health-care workers at

facilities receiving federal funding are covered by this vaccine mandate and they can no longer opt to do regular testing. reggie: thank you. a key piece of president biden's agenda is hanging in the balance as congress returns to washington. his infrastructure bill passed in the senate but still sitting in the house. progressive house democrats say they will not act unless the senate passes a $3.5 trillion budget resolution deal. that measure has its own obstacles. west virginia senator joe manchin is causing for a pause and wants debate on the bill. the senate is split 50-50 and democrats need the vote. >> we have the unknown and the unknown is everything you are talking about, covid, what is happening, what it will do to the economy. nobody is talking about inflation or debt. we should have that is part of the discussion. reggie: the budget committee chairman bernie sanders is confident democrats will be able to work out their differences. he has been critical of manchin. kumasi: investigators say they

are looking for suspects in a fire in marin county near the backpacking campground in the golden gate recreational area. the crews were on scene throughout the night. witnesses are credited with helping stop a suspected arson. santa rosa police were called to the field behind the bay village shopping center on marlow road saturday and found a man surrounded by several people. those people told police the man lit something on fire, dropped in on the ground, i was trying to fan the flames. firefighters contained the fighter to a 400 foot square foot area of grass and police arrested the man. reggie: happening today, if you are out and about in burlingame, police are going to be watching people carefully, especially but comes to traffic laws. officers will be conducting a bicycle, pedestrian safety operation around town. the goal is to keep everybody safe. burlingame officers are looking for speeders, people making illegal turns, and those who failed to stop for pedestrians.

i should say crosswalks. the operation will run from 8:00 a.m. until noon. kumasi: work is set to begin this week on cleaning up the massive damage in san francisco's stern grove. workers will start clearing away damaged trees and that filled the part of the park, including the concert area. a water pipe ruptured last month when crews were preparing a leaking air valve. 700,000 gallons of drinking water was lost and repairs are estimated to cost at least $4 million. ♪ reggie: opera house yesterday for there was a live performance outside and in died where people could get -- inside where people could get vaccinated. hardly strictly bluegrass had canceled in person and will go virtual. up next, a first for iphone.

reggie: we are getting this statement from top fda researchers on the subject of booster shots. you may be surprised. they say there is no evidence that shows it is time to give americans another shot. jobina forbes is live with what this means for the biden administration's plans to roll these out. jobina: this is significant concerning the white house's plans to begin booster shots for the general population. two top fda reviewers have signed onto a statement that says it is too soon to administer those booster shots. the reviewers say the current vaccine doses remain highly effective against severe disease and that is the primary goal of vaccination. dr. gruber and dr. krause are both veterans of the fda and they played key roles in authorizing all three covid-19 vaccines in use in the united states right now. the statement says all the signs out there at this moment does

not point to the credible evidence the vaccines are winning and how effective they are -- waning and how effective they are. members of the world health organization also signed onto the statement. the who called on many nations to delay third doses given the disparity in vaccine distribution. the biden administration is targeting september 20 for rollouts of booster shots for the general population and the administration has not responded to the statement. kumasi: thank you. republican and democratic leaders will stand in unity and observe a moment of silence today for the victims of the 9/11 attacks. a ceremony will be held at 9:00 a.m. on the steps of the capitol building mark 20 years. speaker pelosi, senate majority leader chuck schumer, and mitch mcconnell, as well as house republican leader kevin mccarthy, will be attending. today, secretary of state blinken will be testifying in front of the house foreign

affairs committee. this is the first time since the evacuation from afghanistan. over the weekend protesters took part in a number of rallies nationwide calling on the government to provide humanitarian aid to refugees were still in afghanistan and cannot leave the country. one of those rallies took place at san francisco's union square. organizers with the global advocates for afghanistan see the need is urgent and times of the essence. they fear refugees will not only be ignored by the taliban government but become targets. >> the taliban recognized the terrorist organization throughout the world. humanitarian aid cannot get in, it is blocked. we need our leaders and at the american people to push our leaders to try and find whatever we we can to get aid to the country. kumasi: protesters also called on the u.s. government to do more to help refugees leave, especially those who have visas and are awaiting a way out of the country. reggie: today, a new york judge
