but it was interesting. he was campaigning until the last minute today in san francisco trying to get every last vote. we also spoke to the original founder of this recall, oren healy. he says regardless of the outcome, he hopes governor newsom learned something after going through this process. >> in the final hours of the recall election, gavin newsom made one last campaign stop in san francisco to thank his supporters and give his final pitch to last-minute voters. >> if we don't reject this recall, very elder is the next governor of the state of california. [boos] >> i'm going to sound like obama. don't boo, vote. reporter: that was echoed by president biden, comparing larry elder to former president donald trump. >> he is a clone of donald trump. can you imagine him being governor of this state?

reporter: democrats are feeling confident newsom will defeat the recall. they believe their strategy to cast the recall as a power grab by the extreme right will prove to be successful, and in large part thanks to larry elder. >> larry elder has been the gift that keeps giving. he is the perfect foil for what they need. somebody to be running against trump. larry elder personifies trump for them. >> the effort began well over a year ago when oren healy, a retired sheriff sergeant with the county sheriff's office, filed a petition. his effort seems like a longshot, but frustrations over the stay-at-home order and outrage over newsom's dinner at the french laundry helped bolster the campaign and seal the deal. 15 months later, he told us regardless of the outcome, he hopes newsom learned something from going through this process. >> regarding homelessness, regarding the spike in crime. our water supply issues.

mesa where larry elder will hold his election night party. that is set to begin about 7:00 tonight. the 69-year-old elder spent the last days leading up to the election here in southern california, where he reinforced his commitment to ending mask mandates and vaccine requirements as well as his strong belief california families should have a choice when it comes to what schools children attend. he has been a frequent critic of governor newsom on issues like climate change and solving the state's homeless crisis. today elder made no public appearances, choosing instead to post a message to voters on his facebook page. >> larry elder here. today is election day. be sure to vote before 8:00. turn your ballot into a voting -- go to get gavin out.com. we are going to change california. we are going to change the world.

>> while elder posted a link to a voter fraud website on his website, he also is appearing on a radio show, or just appeared shortly ago down here. he insists he will still win this election. he was asked if he might concede. he said i have not conceded the election. people ask over and over if i'm going to accept the results. that is the wrong question, said elder. is gavin newsom going to accept the results of the election when he loses, because, elder said, he's going to lose. obviously still very confident. >> it will be interesting as the night plays out. thank you. >> about 40% of ballots have been returned so far. this is the return rate for each county. the darker the color, the higher the rate.

solano county lags in last p with a return rate of about 36%. you can check how york county is doing on abc7news.com. we sent reporters across the bay area to check on turnout and monitor for any issues. kate larsen is in san francisco. we will begin in san jose. the bay area's biggest county, santa clara. >> as anticipated, it is a busy election day. at times, the line inside the registrar's office going to be a couple dozen people long. everyone we spoke with pointing to the sheer importance of this recall election, wanting to make sure they have a say. there are roughly one million registered voters in santa clara county, each receiving a recall

ballot in the mail. the registrar's office says nothing compares to a presidential election year, but as of an hour ago, officials say they were at 50% of county voters. few stopped to chat about today's election. >> everybody has up-and-down's. i don't believe that is enough to remove him from office. >> i have seen times people stood in longer lines to vote, under duress of gunfire. this is important. >> resident jack mccosh happy to stand in line, throwing his support behind governor newsom. of those we talked to, most adamant about keeping the governor is an office. officials expect and to 60% or more as election day continues. they say early on, people were confused. voters surprised to see just two questions on the ballot. that is voting yes or no on the

recall effort, then again choosing -- or voting on a potential replacement. we will keep an eye on this as we inch closer to 8:00. >> let's continue our live team coverage in the east bay. j.r. stone is live in oakland. reporter: there has been a steady flow of people out here in oakland. lots of energy, lots of excitement. one woman started dancing when she turned her ballot in. she was that excited to be out here. you can see one of the areas people can turn their ballot in. lots of opinions here. many of the folks we talked with our strong gavin newsom supporters. ! >> i am voting! i am making sure everybody's voice is heard. he is doing a great job. i don't think anybody else could have taken us through this.

we have been the first to lock cities down so people can be -- and also to wear their masks. >> you heard her talking about masks. several people i spoke with brought up masks in their belief of how important those are. that bodes well for newsom. here is an alameda county, we are talking about 950,000 possible voters. this vote is going to have a big impact. you see more people dropping off their ballots this evening. keep in mind, i'm told by officials we will start getting results around 8:30 this evening. more good news, we are talking about a possible turnout, looking like a possible turnout between 60% and 70%. they broke all sorts of records back in november in the presidential election when they were over 80%. doing well here in alameda county.

>> san francisco city hall serves as a polling place along with other functions like a wedding site. we met up with a couple of newlyweds today. . congratulations to them. did they vote as well as say i do? reporter: they tried to vote. i saw a woman in a wedding dress and amanda in a suit, i said did you just get married? they said yes and we forgot to vote. we realized it was election day while we were at city hall. they just moved to sacramento and they are registered to vote in sacramento, and you must vote in the county you are registered in. they were not able to vote but we hope they have a wonderful wedding dinner. this is the basement. we could not speak to people there on camera because that would be considered exit polling. but you can see there are people there, no lines.

if you need to go vote, you will not have to wait too long. you can still register down at the department of elections. you will just have to vote conditionally. i did also speak to people elsewhere in city hall about how they feel about this election. >> the timing of the pandemic and a lot of economic struggles have got a lot of people on edge . they want to take it out on a political adversary, maybe. >> i think this time has been very hard on most people. it has been tough on a lot of individuals. i feel that -- governor tries his best in these trying times and i feel that i can understand how some may feel different. i support that, too. >> back out here live, at 6:00, two hours left to vote. you see this tent outside city

to get california's largest ethnic group to vote. community leaders are working overtime at the last to make sure this key group is heard. >> in cali in cali in cali in ci million latinos just are to vote , giving them the power to sway this recall election. >> you voted for change? >> yes. reporter: governor gavin newsom knows the power of the latino vote. latinos played a key role getting him elected in 2018 when 64% of california's latinos voted for him. but now things are different. latinos were disproportionately impacted by this pandemic and suffered losses as a result of the shutdown. some who historically voted democrat shifted republican during the presidential election. >> we wanted latino voices to be heard, for there to be a difference made. reporter: we met a voter who

preferred not to be on camera instead he was undecided. so the task force team are working overtime to target this group of latino voters just hours before the polls close. >> we are still calling those people who either were undecided or did not pick up to make sure we did that last ditch effort to make sure we get everybody to vote. >> accessibility is key. we came across this polling place. to the right you can vote. to the left you can get a haircut. >> the owner of this hair salon volunteered her business to make it easier for the community to vote. are you coming here to vote, or to get a haircut? >> to vote. reporter: on the left side of the hair salon, she waits for clients to do both. have any of your customers voted and also gotten their hair done?

efforts boost latino turnout. >> if this recall were to pass, we would be one of the populations most affected. latino population and its power in elections. what about other groups? are we seeing strong influence from black or asian voters? what about women voters? >> the polls show 60%, 70% of the asian american, african-american voters are for newsom. women voters, traditionally they vote democratic, and that is -- seems to be the case as well. it is interesting to note, geographically could be the key. we in northern california have the highest turnout. watch how our votes come in early on.

contra costa county, san francisco, alameda county, between monterey and sacramento, that is the basket of democratic support. los angeles, not so much. republicans are going to be depending on the central valley. we will see how it goes. >> the last time we did this, when governor schwarzenegger became governor in 2003, the results came fairly quickly. do you think this election will be cold tonight? >> it depends how close it is. it is going to take a while to certify, but yes, this is a vote by mail election. a preponderance of the ballots are already in. they just have to count them out real quick. i think we are going to see the trend tonight if it is a big margin, we will be able to call it tonight. if not, it's going to take time. i'm going to give the big caveat.

>> building a better bay area, finding solutions. this is abc 7 news. >> california's recall election is on track to be one of the most expensive today. the state has spent close to $300 million of your money. so what needs to change to make the process more efficient and cost-effective? >> stephanie sierra is digging into reforms experts say need to happen. reporter: there is no question california's recall election process is outdated. >> we have not revised it in 100 years. we know at least $276 million. reporter: uc berkeley's school of governmental studies published a poll that found three out of four voters support recall elections, but agree reform is needed, some of which will cut costs. >> they would like to increase the number of signatures that would be required from currently

the 12% of the voters in the last statewide election to 25%. >> mark dicamillo is the director of the poll. he says another reform voters support is raising the threshold people need to meet to qualify as replacement candidates. >> currently the filing fee is just $4000. all a candidate needs to do is get 7000 signatures to put their name on the ballot. reporter: eric sickler says another idea raised is requiring signatures to come from different parts of the state. >> in five different counties, you need to have x number of signatures. . so it is not enough to send signature gatherers to your hometown. reporter: making it too easy for people to buy their way onto the ballot. but it is not just the cost of raising eyebrows, but flaws in the process. >> governor newsom could lose and we could end up with a person who did not have more

had been replaced by chris stapleton. >> he is country, neither one of us like country music. reporter: linda brought her tickets -- bought her tickets through a market place that connects buyers with third-party sellers. they refused to give her a refund. >> it was a bait and switch type of situation. i wanted my money back. reporter: they told us if an event has been rescheduled and tickets are still valid, customers are not entitled to a refund. it encouraged linda to reach sale -- resell her tickets, but she was unsuccessful. and by her tickets to see the frames through ticketmaster. ticketmaster offered her a 120% credit for a future event, but the band's own cancellation announcement said refunds for new york and chicago can be had at the original point-of-purchase. >> why am i being offered credit when the band said they would

the stand telling jurors she quit after six months over concerns about the accuracy of the company's blood testing device. daily quality control tests would sometimes fail and is in an email, another employee acknowledged on another occasion, failed results were ignored to pass the quality control process. the witness also testified that during her time at theranos, a blood analyzer could perform only one test at a time while another device made by another company could run multiple tests at the same time. this could help with the government's case that the theranos technology was not delivering what holmes was promoting to investors, doctors, and others. >> clearly not something that was ready for prime time. but at some point, she started to represent that this technology works. i think that is when she should have made sure it would actually work. >> defense attorneys are likely to discredit the witness as a

>> as abc 7 news prepares to celebrate hispanic and latino heritage month, we are highlighting the importance of the community in the bay area. the percentage of people identifying as has panic or latino it -- hispanic or latino is the largest ethnic group in the state of california. julian glover breaks down the numbers. reporter: remember those census surveys you filled out last year? the results are in and more than one in three californians now identify as hispanic or latino, the largest racial or ethnic group in the state, 39.4% of the population. in the bay area, seven out of nine counties saw an increase in the hispanic latino population when compared to 2010 and 2020 census numbers. solano in sonoma county the largest gain. vallejo had one of the largest increases for bay area cities, adding nearly 7000 more hispanic or latino people in 10 years. san francisco and alameda county

saw small increases in the population identifying as hispanic or latino. keep in mind they have larger total populations than the north bay counties. richmond and antioch saw increases in the number of residents identifying as hispanic or latino. contra costa and napa join withh a larger growth than the state average. largest bay area county. in santa clara county there were almost 2% fewer hispanic latino people in 2010, but this community still makes one is and four people in the county. it is also our most populated county in the bay. across the board, the number of people identifying as either hispanic or latino and asian group in the majority of bay area counties well the number of black-and-white residents declined in virtually all bay

his going to have season-ending surgery to fix his knee. he took to twitter and set after weighing his options, it was best to undergo season-ending surgery, adding he is far from done. he had just two carries before leaving sunday's game with shipped cartilage in his knee -- chipped cartilage in his knee. he played just eight games last season battling injuries. last night on abc 7, the las vegas raiders put on a show for their first game in front of fans in sophia stadium. a 31 yard walk-off winning touchdown giving the raiders a win in overtime over the raiders. afterwards, head coach john gruden explaining it in the way only chucky can. >> i felt like i died and woke up and died again -- i was like a cat, i had multiple lives tonight. i'm proud of the character. we were down 14-0 to the ravens and it did not look good.
