slow down and take time up there today because it will be around for the morning commute. this is how it looks from the east bay hills camera., marine layer, thousand feet. we will switch that out for high clouds as we warm into the 60's, 70's and 80's at noon. a brief spike in the heat before autumn like whether returns. kumasi: the oakland unified school district is now mandating full covid vaccination for all students ages 12 and up. those with certain medical cases and religious beliefs are exempt but no doubt this is major with the delta variant spreading quickly among children. this decision could be monumental for the state. amy: it was a long night.

they did not take the vote until after midnight. this may be news this morning. it has motivated a lot of discussion, the oakland school board voted 5-1 to pass this, to require students to get the covid vaccine. they would be exemptions allowed for medical or personal reasons. if the student is not vaccinated, they will face a weekly covid test. before the vote, supporters and opponents on the plan. >> please vaccinate and make it a mandate. it is a simple mandate to preserve our community. >> i am opposed to a mandate. parents and students must have the choice of whether or not to take the vaccine. amy: oakland is leading the way, one of the first in northern california, to pass a vaccine requirement. l.a. has passed a similar requirement.

they have to figure out the details of how to implement the rule and they need to give students time to get the vaccination. in oakland, 54% of kids 12-17 are fully vaccinated. they have not said when this will be in effect. the superintendent said it will not be enforced before january, likely. abc 7 news. kumasi: piedmont unified school district will be requiring all eligible students to get both doses. students under 12 have to get vaccinated in eight weeks once they become eligible. reggie: health experts believe the booster shot means more protection for the most honorable. reporter: the cdc meets today to talk about who gets the shots and when. the director is expected to lay out the full guidelines by

tomorrow. yesterday the acting commissioner gave an example of who the agency has in mind for the shot. when it comes to high risk, the list includes health care workers, teachers, daycare staff, grocery workers and people at homeless shelters. here is a member of our vaccine team. >> hopefully the director will give final recommendations on friday. we need more data. reporter: americans who received the moderna and j&j vaccine have to wait a few more weeks for approval from the federal government. 2 million americans with compromised immune systems have already been cleared. kumasi: 9:00 this morning, a virtual town hall featuring abc news, dr. jen ashton and dr. anthony fauci.

reggie: a shoot out in oakland left an officer wounded and a suspect shot yesterday morning. this was at 21st and telegraph. the suspect shot the officer almost as soon as police arrived. >> a sober reminder of how dangerous it is. >> we came within a hair's breath of losing to police officers today. these officers responded to a citizens call and they were essentially ambushed. reggie: two officers returned fire and the suspect ran into an apartment building and a standoff followed. the men stabbed himself several times before surrendering. the officer and suspect are expected to survive. all week we have had extensive coverage of a crime plaguing oakland.

trial of elizabeth holmes. the former secretary of defense james mattis was a former board member. kumasi: yesterday he told the court about his business relationship with elizabeth holmes. reporter: james mattis taking the stand at the criminal trial of elizabeth holmes. the former defense secretary joined the company in 2013 after retiring from the marine corps. he was paid $150,000 annually. >> he is one of the most brilliant strategists i have ever met. reporter: elizabeth holmes claims she could run hundreds of test on just a few drops of blood. in court, the general testified she personally pricked his finger to demonstrate the technology and said she was aggressive about trying to work

with the department of defense, something that never came to be even though she claimed it did. she later admitted it did not. >> was a device ever deployed the battlefield? was it ever deployed in a medevac helicopter? reporter: prosecutors showed emails between them as early as 2011. in one email, he described how he wanted to get their announced devices implemented. he has since distanced himself from elizabeth holmes calling his involvement a mistake during a 2019 interview on pbs. >> the bottom line is we all make mistakes at times and it was obviously a mistake on my part to be a part of it.

got aggressive with the staff. >> she was standing on the sidewalk crying and he walked back in and was screaming at the hostess and he went back in four more times to talk to the manager. reporter: the restaurant confirmed they were there and had contacted the fbi. >> worst-case they displeased with the service? that still doesn't seem like that much anger is worth something like that. in that moment, gabby reminded me of how she seemed in that body camera video with the cop. she seemed distraught. she was being apologetic for his behavior and wanted to defuse the situation. she was visibly upset and crying. you could feel his temper. he was angry and passed off.

u.s. labor department just released the weekly jobs report. an increase of 16,000 from revised numbers the prior week. continuing claims also to more than 2.8 4 million, 103,000 more than revised numbers and 240 thousand more than forecasted. a small sign the housing market might be cooling off a bit, the association of realtors said in august existing home sales fell 2% compared to july, the biggest drop off since the spring. the new york stock exchange trading this morning and we are up significantly 411 points. kumasi: a popular festival returning to walnut creek. thousands will be at the walnut festival this year.
