will remain open, for now. hours before the deadline, joe biden signing the deal granting funding through december 3rd, avoiding a shutdown that would have affected thousands of federal workers. now, the focus turns to legislation at the heard of his agenda, the $1.2 trillion infrastructure bill, which includes billions for roads, bridges, broad band and would create jobs. the deadline to vote on that bill came and went thursday, with moderate and progressive democrats failing to reach and agreement on a larger social safety net package. negotiations resuming with the possible vote as early as today. progressives standing firm with their demand that congress pass a bill on human infrastructure, covering early education to the battle against climate change. but the price tag of $3.5 trillion over ten years, something too steep for moderate democrats in the senate. senators john muller and kyrsten sinema were trying to hammer out

a deal, john muller pushing for a $1.5 trillion package instead. >> we're working as hard as we can. >> reporter: general psaki still optimistic saying -- >> reporter: nancy pelosi seep leaving the capitol, saying progress sifs and moderates to closer to an agreement than it appears. she has indicated that infrastructure bill could come to a vote today. she's not brought bills to the floor, she does haven't the votes to pass them. elizabeth? >> alex, thank you. breaking news from los angeles overnight. an underground explosion has knocked out power to thousands of residents. it's unclear what caused the explosion affecting the area's electrical equipment. no injuries are reported about 7,000 homes and businesses are affected. a federal appeals court is allowing the biden

administration to continue using a trump era policy to deport migrants before they have a chance to seek asylum. the policy, known as title 42, is based on curbing the spread of covid and was used to expel thousands of haitians who gathered under a texas bridge. one report predicted up to 400,000 migrants could head for the u.s. border next month if title 42 was lifted. meanwhile, the secretary of homeland security has announced new guidelines directing immigration officers to pursue undocumented migrants only if they pose a threat. a 13-year-old boy in tennessee accused of shooting his classmate at their elementary school is in custody this morning. police in memphis say the teen opened fire in a stairwell hitting another 13-year-old. the classmates were rushed to a church nearby. >> my daughter had texted me and told me it was a little boy in her classroom that got shot and said come and get me. >> they came out with smiles and hugged us. so they okay. they okay.

>> the victim is in critical condition. the alleged shooter was arrested after running from the scene. he's expected to be charged with attempted murder. now to facebook, under fire for the effect it's having on teen's mental health. during a hearing tuesday, one senator revealed his staff posed as a 13-year-old girl using a fake account. and what followed was disturbing. >> reporter: this morning, congress calling out facebook for hiding research about the negative effects social media, including its instagram app, can have on young people. >> while facebook publicly denied that instagram is deeply harmful for teens, privately, facebook researchers, and experts, have been ringing the alarm for years. >> reporter: an investigation by "the wall street journal" revealed facebook's own research found 32% of teen girls said when they feel bad about their bodies, instagram made them feel

worse. and teens blame instagram for increases in the rate of anxiety and depression. during a senate hearing thursday, lawmakers compared to company to big tobacco. >> in truth, facebook has taken big tobacco's playboo. it's hidden its own research on addiction, and the toxic effects of its products. >> reporter: to steady its effects, blumenthal says his office posed as a 13-year-old girl on a fake instagram account and followed accounts on extreme dieting and eating disorders. >> within a day, its recommendations were exclusively filled with accounts that promote self-injury and eating disorders. >> reporter: facebook argues teens connecting with other teens has an overall positive impact on their mental health. >> we're constantly trying to improve safety and privacy protections for young people. >> reporter: then came the issue

of policing fake accounts. >> they are fake instagram accounts. instas often are intended to avoid parent's oversight. >> this is not something we built. >> reporter: facebook has suspended its development of instagram for kids under 13. and they are looking to release more information on the subject of teen'smental health. >> andrea, thank you. another story about teenager's health, a concerning trend in the use of e-cigarettes. about 2 million teenagers vape and 25% of them do it every day. most use flavored cigarettes. some unvaccinated teachers in new york are waiting to hear from the u.s. supreme court. they've asked the justices to

block the city's covid vaccine mandate. the city says all public schoolteachers must have at least one shot of the vaccine by this afternoon or they will lose their job. the teachers claim that's not fair. >> i'm giving up first and foremost how i support my family. i'm a single mom. so my son relies on me to pay the bills. i have faith in the decision that i have come to between me and god. >> it's unclear if the supreme court will even consider their case or t case. meanwhile, some good news about covid cases and hospitalizations across the u.s. the cdc says infections are down 33% in the last month, and hospitalizations are down 15% in the last week. but there is a growing problem. a shortage of rapid covid tests. demand is up more than 600% in some areas in recent weeks. new video of the lava from hawaii's kilauea volcano.

petito case and the search for her fiance, brian laundrie. we have new details on the phone calls made from laundrie's house. this morning, newly uncovered police reports are shedding new light on the gabby petito case, and the search for brian laundrie. according to records on pained by abc news, officers were called to the laundrie family home multiple times before petito was reported missing. police responded to the house in north port florida twice on september 10th and three times on september 11th, which is the day me teepetito's family reporr missing. gabby petito's father made all of the calls, concerned about her whereabouts. laundrie has been missin for two weeks since returning from a cross country trip. can you tell us why you were at the laundrie house? fbi agents returned there yesterday spending time inside the house and the camper brian and his parents took on a trip just days before he went missing. the laundrie family's attorney says agents collected personal
