a bill that removed personal belief as an exemption for vaccine requirements. he is a leukemia survivor and could not attend school at the time because 7% of his fellow students were not immunized against diseases which could have killed him. now he is vaccinated against covid, but -- >> i am still slightly immunocompromised. i applaud governor newsom. it is the right thing to do. a lot of people who are vaccine hesitant and things, but they do not always realize that there are specific threats to people who are too young or too medically fragile to be vaccinated. what we tell people is that vaccine refusal is a decision that endangers others. >> i'm vaccinated. my kids are vaccinated. kate: liz is a special education teacher in marin, and kids as young as three in her class are not authorized for a covid vaccine. she is also calling for those

verifying vaccination status for all students in all grades will be a massive undertaking. typically they check the status of kids in transitional grade levels, for example, a child attending kindergarten and going to school for the first time, but this mandate has a much broader reach. >> in the south bay, san francisco employees who are not vaccinated and do not have an exemption will have a one-week grace period to get a shot before they are put on a one-week unpaid suspension. >> we can do much to protect against future variants by ensuring more folks get vaccinated. with regard to the work force, there are two great risks. one, someone might be at greater risk of infecting a coworker. the second, an individual might be at greater risk of infecting a member of the community that we are all serving. >> the initial deadline for employees to be vaccinated was yesterday. none vaccinated, nonexempt

employees will have an option to return after their suspension, but they will have to be tested for covid once a week on their own time and time. afterwards, they could face further action that might include termination. now to a potential breakthrough for those battling covid. merck has developed a pill that slashes the risk of being hospitalized or dying in half. it still needs approval, but could be authorized within weeks of that approval. the white house is expected to double the supply of at-home rapid tests over the next two months, promising to keep costs to consumers low, and vaccines for children ages five and under -- five to 12 are coming soon. >> the fda knows the urgency with which our children need a vaccine. they will be guided by science and safety. >> the white house is focusing on the 7 million -- 70 million americans who are eligible to

get vaccinated, but have not done it yet. dr. fauci urging americans not to let their guard down even as the current surgeon subsides. >> a water main break near alamo is causing problems, including a sinkhole. leslie joins us live with the latest. leslie: i am here along hemme avenue. it was a muddy mess earlier. danville boulevard has since were -- since we opened in many directions, but come on over, you've got a front row seat to see the sinkhole that formed. 179 homes still do not have water after the dramatic rake in the middle of the night. it looked more like the rapids in a river than a suburban street. a major break in the water main started the waterworks. >> we got to see a geyser in the middle of alamo. that does not happen every day. >> i did not realize main breaks

get so bad. leslie: by don, a huge sinkhole formed. the flow could not be turned off for more than eight hours because crews had trouble accessing the valve because of the torrents of water and mud. >> i got nervous as more and more of the parking lot started disappearing. i had to call people and let them know the school was closed. i was kind of shocked that it was this much water. >> this preschool close for the day because this road provides the only access. >> there have been three water main breaks. this is the third in a week in alamo. >> this is under investigation. we are trying to determine the cause. the pipe that burst is an eight inch asbestos pipe that was installed in 1989. leslie: the same time that burst in the middle of the week.

some homes sustained damage that is still being assessed, including flooding in yards and even a washed out portion of this driveway. east bay mud is asking people who were affected to contact them directly. most of the water flowed under the street, into a storm drain, and eventually into san ramon creek. east bay regional park says assessing the impact of millions of gallons of chlorinated water going into that creek. the latest word that i have as far as reopening, water should be turned on, they hope, tomorrow morning. they are going to be working through the night, and they hope to put a temporary fix in so cars can pass through over the weekend. live in alamo, leslie brinkley, abc 7 news. kristin: sky seven video from earlier today showing the aftermath of a severe crash on interstate 880, in which two

cars involved caught on fire. one of them was fully adult. officials reported to the scene just before noon. five cars were involved in the collision. two were treated for nonserious injuries. casey: denise -- larry: in the south bay this morning, students had to evacuate los alamos high school after reports of a bomb threat. law enforcement received a call that there was an explosive device on campus. shortly after, authorities raised to the school and were pleased to see evacuations were already underway. >> they know how to evacuate. they have done a wonderful job, frankly, in initiating these evacuations. larry: a few hours ago, a search was completed. authorities did not find any explosive devices on campus. authorities are currently investigating where the initial call of the bomb threat came from. kristen: on abuse scandalal

larry: a highly anticipated east bay football mash-up canceled because of covid concerns. climate high school in oakland was supposed to play pittsburgh high school tonight, but oakland unified says that will not happen because of positive covid cases. pittsburgh's highest coach told our media partners at the bay area news group that the team is trying to find a new opponent. kristen: the fourth annual -- celebration takes place next week in san francisco. officials say while their world be adjustments this year, the tradition will largely -- while there will be adjustments this year, the tradition will largely be the same. >> we are going to ensure that we have staff out there. our plainclothes staff will be in uniform. our people will be working with the police department. the most boring thing is to be a

larry: president biden is v is i that two stalled spending bills at the center of his economic agenda will get past. mr. biden traveled to capitol hill today to meet behind closed doors with lawmakers in his own party, hoping to bridge the divide between the $2 trillion infrastructure bill and legislation that provides $3.5 trillion for measures like family leave and low prescription drug prices. moderates think the latter packages too big. progressives do not think so. so they are holding up a vote on this bill.

pres. biden: it does not matter if it is in six minutes, six days, or six weeks, we are going to get it done. larry: nancy pelosi tells abc 7 news that lawmakers and progressives -- that moderate and progressive lawmakers are reaching an agreement. nearly 4000 federal employees are being furloughed because highway funding lapsed when no vote was held on that infrastructure bill. there could be a vote today becomes prolonged the projects. kristen: minority owned businesses in oakland are receiving a boost courtesy of comcast. the telecom giant announced it will be providing $10,000 grants to a total of 100 small businesses owned by black, indigenous, hispanic, and asian american people, among others. the money is coming from a program called comcast rise, which stands for representation,

strength, and empowerment. one business is a company specializing in manikins. >> because so many small businesses did not get a ppp loan, this amount will be a game changer. $10,000 can really make a big difference. kristen: in addition to the money, the businesses will be receiving a technology update, including high-speed internet service for a year as well as new laptops and mobile devices. supreme court justice brett kavanaugh tested positive for covid-19 just days before the court's next term is set to begin. the positive result came from a routine test yesterday. kavanaugh has been vaccinated since january and is not showing any symptoms. his wife and daughters tested negative today and the other justices tested negative this week. larry: hey sexual misconduct scandal is prompting the women's soccer league to cancel all of its games this weekend.

players in the league requested the suspension after the investigation of paul riley, the coach of the north carolina courage. "the athletic" detailed allegations of sexual misconduct, harassment, and coercion. he is the second coach to be fired this week. the other was let go because of verbal abuse. there are no teams in this league in the bay area. kristen: part of building a better bay area includes uplifting issues of racial and social justice. attorneys argue that using a pittsburgh mahomes rapidly works in a murder conviction was racially biased -- a pittsburgh man's rap lyrics conviction was racially biased. what are attorneys hoping will come out of this? reporter: they are hoping that their defendant, gary brian junior, gets a new trial.

one person i spoke to today calls this an innocent of rhyme and punishment. brian they are hoping the newly passed racial justice act will change that. inside the contra costa county superior court room friday, what is believed to be the first test of california's new racial justice act. >> we are asking for a new trial, a fair trial without racial bias. >> to judge expecting to weigh whether racial bias influenced a two conviction -- influenced a conviction of a rapper. ♪ >> deadly antioch apartment complex shooting, where he was injured. attorneys are arguing the use of bryant's music during the trial

to allegedly paint him as a violent man with gang affiliation was racially biased. >> like music is treated differently, and the presentation to the jury of lyrics for my client's rap music as literal confirmations to crime was based in stereotype. julian: california's racial justice act was passed by state lawmakers in september 2020, following the murder of george floyd and cause for criminal justice reform. it prohibits the state from seeking a criminal conviction or sentence on the basis of race, ethnicity, or national origin. >> it enables a defendant to raise a claim that there is racial bias. julian of rap lyrics in criminal proceedings against black men rhyme and punishment, where the lyrics are the trial instead of the person. >> is used almost exclusively against black defendants, so it

is basically a stereotype. if you are a rapper and you are saying this, it must mean you are doing all of this stuff, and it is an interpretation of what those lyrics mean. julian: according to court document, bryant used the lyrics to connect him with the broad day gang and extend his sentence. his mother tells me h in a gang and wants to hunger her -- --his mother tells me he was never in a gang. >> he was never a violent person. julian: the judge has yet to rule on whether bryant will get a new trial. we also know the aclu is closely watching this case. they believe it could be a landmark decision when it comes to the interpretation of that new racial justice act. we are also wondering if this is

larry: today walmart announced it is scrapping layaway completely before the upcoming holiday shopping season. it is going to be replaced with a by now, pay later financing option that will allow all of five customers to take the item home right away. they will be charged between 10% and 30% interest depending on their credit score. alcohol, groceries, food, personal care products, and pet supplies are excluded. my initial reaction to that is i am a bit concerned when i hear 30% interest. spencer: the overall plan sounds pretty good. you can take the item home right away, pay a little interest. i guess they left out the word little. 10% to 30% sounds steep. kristen: by now, pay later you could just do with your credit card. larry: not everybody has a credit card.

to announce district 5 as an eviction free zone just because the landlord comes to you and says i want you out. that doesn't mean you don't have rights with the statewide eviction moratorium now expired state and local leaders are reminding renters of their rights under california law the san francisco apartment association tells abc 7 news new procedural rules require landlords to apply for rent relief before sending any notices to pay rent. the rules will apply through march of next year giving renters and landlords time for the rental assistance program to fully first funds before eviction is even on the table the california department of housing and community development says for rental protections to be extended to eligible households. those households must enter the rental assistance program applications are coming in by the thousands last time. i looked we were over 32,000 folks since since monday coming in at this rate. the department says it's on pace to break anything. they've seen before it really verifies what we've kind of all known as true is that there's a
