>> building a better bay area, moving forward, finding solutions. this is abc 7 news. >> bay area health officers can make an announcement about what needs to happen for the indoor mask mandate to be lifted again. good evening. >> thank you for joining us. you're watching abc 7 news at 5:00 on abc seven, hulu live, and where you stream. health officials are finalizing plans to ease mask mandates across the bay area. a confirmation that an announcement could come by the end of this week. san francisco's health department is considering lifting the mandate in settings that are low risk and with low contact rates. it is also looking at places where people are fully

vaccinated. new cases and hospitalizations are trending down in all bay area counties. if and when the mandate is lifted, officials suggest continuing to mask up as a precaution. >> it has been about two weeks since pfizer booster shots became available for certain americans. people in the bay area are showing up for appointments to find out there are no doses available. luz pena is part of our vaccine team and look into what is contributing. >> in at least two east bay locations, cvs pharmacy is canceling appointments. sometimes letting people know an hour in advance. but the majority of customers had no idea. they showed up and were told to book an appointment for next week. october 5, the day elizabeth rayner and william were scheduled to get there pfizer booster shots. they don't know each other, but are facing the same setbacks. >> i had originally an appointment scheduled for the clayton cvs.

they called me and their refrigerator had gone bad. i rescheduled online for this site. >> then you show up today and what do they say? >> they don't have any. >> william got a text message an hour before his appointment. >> 11:15, i get a text that the appointment was canceled. >> elizabeth did not get a text. instead, she drove 40 minutes to hear the news from the pharmacist. >> scheduled for next week. it is crazy. i'm going to get a vaccine. people pushed by their family or something, they come in, have a negative thing, and go it is not meant to be. that is the sad part. >> we know at least two cvs locations, one in montclair, a second in walnut creek where staff members are putting out signs to let customers know they are out of boosters. according to the pharmacist at the cvs, they gave out close to 80 vaccines a day. today, zero. >> i thought i had an

appointment for friday from a booster shot. i was just notified there was a sign on the door. >> they just learned about the cvs booster shortage today. >> this is new information to all of us today. it is always frustrating for somebody to have an appointment for a vaccine and find out it is not available. >> cvs spokesperson responded in part "the high demand for booster shots in some locations may have exceeded the initial allocation we received from the government." in response -- a response that did not sit well with elizabeth. >> it didn't address the problem of identifying people ahead of time and telling the metal. >> cvs said it is not widespread, but did not give specifics as to when the pharmacies will get booster shots. both alameda and contra costa counties are getting vaccines from the state. the county sites are still opero

t a booster shot today. luz pena, abc 7 news. >> johnson & johnson has asked the fda to authorize booster shots for its covid-19 vaccine. a committee is set to meet next week to consider that and a booster request from moderna. 93% of berkeley residents 12 and older are fully vaccinated. it includes students at uc berkeley, chaz a vaccine mandate. the white house -- which has a vaccine mandate. the white house says americans 12 and older have -- received at least one dose. >> new details and the shooting of an oakland manned by an fbi agent. the fbi invited us and the mercury news to an interview to dispute allocations made by the man's family. melanie woodrow is on the story. >> on september 13 at 3:22 in the afternoon, and fbi special agent deputized as a u.s.

marshal attempted to serve one federal and two state arrest warrants for jonathan cortez at a store in oakland. fbi san francisco special agent in charge said the agent was clearly marked as law enforcement. he would not say what the arrest warrants were for. >> mr. cortez did not obey lawful commands. he subsequently drew a 40 caliber handgun from a bag. at which point, the agent had a reason to believe the subject posed an immediate danger of death or serious physical injury to himself. >> the fbi agent shot cortez one time in his torso. cortez was later pronounced dead at the hospital. there were approximately 12 other task force members outside the store exiting vehicles. yesterday, cortez's family held a press conference on the steps of oakland city hall. >> say his name. reporter: the fbi disputed allegations made by the family ts i entdeour cover, harassed

our family members, and arrested two individuals. one at the funeral and one at the reception at a dining place where we had it afterwards. >> no fbi personnel were at the funeral. there was no fbi enforcement action. there was no action taken on behalf of the fbi. reporter: the u.s. marshals service did execute an arrest warrant after the funeral at a different location. a u.s. marshals service spokesperson said they arrested a 30 seven-year-old on behalf of san mateo police department for assault with a weapon and probation violation. both felony warrants. outside of a restaurant in daly city. cortez's uncle said roberts had been a pallbearer at cortez's funeral. the family has asked to see surveillance video from where the fbi agent shot cortez. >> we want that footage to be released. >> the oakland police department

took possession of the video as they are investigating the shooting. a spokesperson says the oakland police department is working with the alameda county district attorney's office and fbi to determine who will be responsible for releasing the video. they would not see the status of the fbi agent who shot and killed cortez. melanie woodrow, abc 7 news. >> frances haugen testified before senate subcommittee today. she said facebook prioritizes profits over people and manipulated content it was harmful to young users. isabella salas has more. >> facebook needs to take response ability. >> facebook trending. a big mess for the social media giant. >> i came to realize the devastating truth. almost no one outside of facebook knows what happens inside of facebook. >> frances haugen testified in a senate subcommittee. you four hours after a massive outage took out facebook, whatsapp, and instagram. >> the leadership knows how to make facebook and instagram safer, but will not make the

deaths every changes because they put their astronomical profits before people. >> former facebook product manager is looking at the algorithms, accusing them of leading young users to harmful content, like anorexia. >> we have to make sure the next generation is just as engaged in instagram as the current one. the way they will do that is by making sure the children establish habits before they have good self-regulation. by hooking kids. >> that is why she is pleading for congressional oversight. rare bipartisan agreement. >> we resolve our differences and introduce legislation. let's go to work. >> our differences are very minor, or they seem very minor, in the face of the revelations we now see. >> facebook's spokesperson weighing in on the testimony. >> the majority of young people and instagram are having a good experience. that is borne out by the documents stolen.

>> in west marin county, some residents who rely solely on well water are reaching a tipping point where they can soon have more water left. now they are asking the water district to supply them with water from the already depleting reservoirs. as liz kreutz reports, there aren't many other options. >> that is the sound of a hollow well. >> normally it is a dense sound. >> after months of drought, she says it is the new reality. >> there are some days if you are the last person to wake up, good luck flushing the toilet. >> she is the sanctuary manager at an animal sanctuary her family owns and operates in west marin. it is also where her family lives. they rely on properties for wells for all of their water. another sign of how depleted

these wells are, this echo of an empty tank. that, in turn, has meant less water for irrigation. the vineyards on their property are dry. the olive trees are sadly dead. >> we've been taking one shower a week, pretty much, and doing military style showers every other day. >> their family is not alone. many residents are finding wells drying up to a point where they can completely run out of water. the county is asking the water district to supply water from the local reservoirs to these families. >> there are programs for when you run out of water and have no other choice. >> if it passes, they will provide the equivalent of 55 gallons of water per person per day for every aqua bull -- applicable household. reservoirs are already depleting. the supervisor says it will have a minimal impact on supply, and there is not really another option. >> customers cannot find

>> a woman died in a house firing oakland around 5:20 a.m. on pearson street near morcom avenue, not far from mills college. the victim was found in the kitchen. a battalion chief told abc 7 news the home had been yellow tagged by the city before the fire because of structural

issues to the stairs and the garage. a new environmental report is shedding light on a problem affecting every californian. that problem is air pollution. the environment california research and policy center found wildfires were the leading cause of poor air quality last year. more than 38 million californians, roughly 98% of us, breathe polluted air for at least 30 days. this increases the risk for premature death, asthma attacks, and cancer. the policy center says air pollution is a public health emergency and single group that is especially vulnerable. >> we like to highlight essential workers and farmworkers who are mostly undocumented and work every day to put food on our tables but don't have labor rights, access to medical care, but are expected to work every single day. >> the greater los angeles area had the worst air pollution in 2020, experiencing seven months of unhealthy air. >> the san jose city council is

considering a new plan to provide emergency housing for the city's homeless population. if approved, it would be built at this overflow parking lot at the police administration building. the plan is to break ground this fall and have it completed in six months. it would add 76 units to the city's growing homeless housing portfolio. >> it is important for people to see these are communities that are simply strange people moving in from a strange land. these are our residents, our community members. they are here, and we should be welcoming to them. >> the units are considered transitional housing. total cost of the project is estimated at $13 million. >> in the east bay, debate over the construction of a new senior community. it would be built on land near heather farm park in walnut creek. leslie brinkley is digging into what is at stake. >> a group called seven hills

ranch is spearheading an effort to stop the structure of 30 acres here, which some have dubbed a rossmoor junior. if built, it would support views of mount diablo from 354 housing units, most of them apartment style buildings with parking garages. >> there's also an element where they are single-story buildings, looking kind of like villas. >> the city of walnut creek would weigh in on a list of concerns, including affordability and traffic. >> traffic concerns, if there were a significant development, the impact to the neighborhood. >> my biggest issue is the impact on the environment, density, how many trees they will take out. close to 400, 300 of which are a special species, highly protected, oak trees. >> the developer pointed out what could make this a cutting-edge retirement community with a new medical

facility. >> the unique aspect is the health care center next to the main campus, which includes assisted living, memory care, and skilled nursing. as residents age and need higher care, their convenient access. >> the county is in the process of drafting up an environmental impact report read they will then get input from the public before the board of supervisors takes a vote next spring or summer. in walnut creek, leslie brinkley. >> san francisco state university is celebrating the opening and naming of its first new academic building in 25 years. the george and judy marcus hall for the liberal and creative arts is the new home to the broadcast and electronic communications arts department. it was donated by and named after two sf state alums in the largest gift the university has ever received. >> i want to thank them for their commitment to supporting this incredible institute.

low clouds stacked up around the bay area. it is cooler, 58 in san francisco. san jose, 69. 78 in morgan hill. along the coast, some clouds. santa cruz. here's a look at the temperatures. 66 in napa. our warmest spots only made it to the low 80's. 76 in livermore. cold front pushing into the pacific northwest. ramped up onshore winds. they are getting rain. it has been a drop in temperatures, the wind is up. take a look at the hourly wind forecast. not so windy. tomorrow afternoon, it gets breezy to gusty. it will keep the cooling going. some beautiful skies over the golden gate bridge. a mix of clouds and sun. good air quality. we keep the trend going for the next three days. this is one of my favorite shots.
