to the hospital, and they did a routine checkup in the emergency department, and they identified an infection of his blood. they're also telling us that he probably likely had a urinary tract infection that caused the infection to go to the blood. >> reporter: according to the hospital, clinton was given an iv and is responding well to antibiotics. it's the latest health scare for the 75-year-old since leaving office. he had quadruple bypass surgery in 2004 and a pair of stents implanted in 2010. >> sepsis can be a serious matter. we are concerned about a decrease in blood pressure and we also need to monitor the heart. president clinton is about to be transitioned to oral antibiotics. it is less likely that the infection has affected his heart because in that case, you would be on antibiotics for six weeks through the iv line. >> reporter: in the past the former president has attributed his health problems to a bad diet, a busy work schedule and ignoring warning signs. >> since i left the white house, maybe if i had stayed on a lower

fat diet, you konw, maybe if i had not eaten so many hamburgers and steaks, you know, which i love, maybe if i had slightly less stress in my life and worked as hard as i did since i left office, maybe it would have been different. >> doctors say they hope to discharge clinton soon, maybe as early as today. now the investigation into january's attack on the u.s. capitol. former trump aide steve bannon is refusing to comply with a subpoena, so now the committee investigating the riot is fighting back threatening to hold him in contempt. this dispute could have major implications for the entire investigation moving forward. this morning, the congressional committee investigating the january 6th attack at the capitol is now pursuing criminal charges against steve bannon after the former white house aide defied their subpoena. the panel's chairman, congressman bennie thompson, saying the select committee will use every tool at its disposal to get the information it seeks. >> we're left with no other choice than to ask the justice

department, lock him up and hold him in contempt, and clearly that might send enough of a message that he will agree to talk to us. >> reporter: the panel will vote on contempt charges against bannon on tuesday, then the full house controlled by democrats will vote on the recommendation. if approved, the justice department will have the final say on whether to charge bannon. >> the battle over bannon's testimony is about more than bannon. it will have big implications for others close to trump who the committee wants to testify. >> reporter: 19 subpoenas have been issued in the investigation so far as the committee seeks information about the role former president trump may have played in the capitol riot. earlier this week the committee questioned trump's former acting attorney general jeffrey rosen for eight hours. >> nobody is off-limits to a subpoena from this committee. >> reporter: meanwhile in virginia, a republican candidate for governor is distancing himself from this event where his supporters pledged allegiance to a flag that is said to have been flown at a

january 6th rally before the riot. >> she's carrying an american flag that was carried at the peaceful rally with donald j. trump on january 6th. >> reporter: the candidate, glenn youngkin, says he had no role in the rally and didn't even attend. > the whole idea of the flag thing seems kind of weird to me and is wrong, but i don't know enough about it yet but it does seem weird and wrong. >> as for bannon, if charges against him move forward, it will likely delay the committee's investigation into the riot. a contempt charge could carry a one-year prison sentence. the most restrictive abortion law in the country has survived yet another legal challenge. a federal appeals court has rejected the justice department's latest attempt to stop the law in texas, which bans nearly all abortions. the law has been difficult to challenge because it places enforcement in the hands of private citizens allowing them to sue anyone who helps a woman get an abortion. the battle is likely headed to the supreme court. a bipartisan commission

asked by president biden to explore potential changes to the supreme court says there's no legal obstacle to expanding the court beyond nine justices, but it's divided on whether adding more justices would be wise. however, the commission's draft report supports term limits for the justices. the commission holds a public meeting today to discuss the assessments. let's talk about the supply chain crisis across the country. it's putting the holiday season in jeopardy. with only four weeks until black friday, dozens of cargo ships are lined up outside major ports in los angeles and long beach, california. consumers are finding more empty store shelves, the result of pandemic-related labor shortages. experts say it's already too late to prevent shortages this holiday season. >> i think we are in or at least four to six months for it to actually catch a break, so i think we're going to have to go through the peak seasons with the bottlenecks, and although the bottlenecks may actually move from the ports into the inland, but the delays, i do anticipate them to be continued

through the holiday season. >> some major retailers like walmart and home depot are starting to move cargo overnight to ease some of those logjams but experts say the best advice, shop early and shop local. good advice as always. a new kind of drone could soon help move cargo at ports around the world. this electric cargo drone is being tested in germany. it could carry 400 pounds up to 70 feet in the air. turning to the pandemic, new concern about the holiday travel season because of the number of unvaccinated tsa workers. meanwhile, chicago is on edge amid a fierce battle over forcing police officers to get vaccinated. and in washington this morning, another vaccine booster shot just got the green light from fda advisers. abc's dan lieberman has the latest. >> we do have a unanimous 19 out of 19 yes votes. >> reporter: a key vote from the fda panel yesterday recommending a third booster shot of the moderna vaccine to be given six months after the second dose for anyone 65 and older, 18 and

older at high risk from an underlying health condition and whose job may be put at greater risk for exposure to the virus. the moderna vaccine remains highly effective showing less waning over time than pfizer and j&j. the moderna booster would be only a half dose, data showing that it's enough to restore protection. today the panel will review the johnson & johnson booster, along with data on the effectiveness of mixing vaccines. >> i suspect they may recommend a mixing and a matching strategy for j&j. we'll have to see what the panel really decides. >> reporter: ahead of that fda meeting, the president praised the country's vaccination efforts. >> it's working. we're making progress. nationally daily cases are down 47%. >> reporter: yet the battle over vaccine mandates and looming deadlines remain. in chicago, the police union telling their officers not to share their vaccination status by today's deadline. >> i know the residents and businesses have expressed
