we are following every turn in this story because it impacts your health. that is one focus of our commitment to building a better. and tonight the in-n-out in pleasant hill is back open after it was shut down by the health department for refusing to check diners' vaccine status and now supporters of the restaurant plan to protest. live in san ramon where the protesters are expected to get busy making their voices heard in a moment. >> protesters started arriving moments ago to make their voices heard. some people we spoke with are upset about the ongoing conflict between in-n-out burger and the contra costa county made it for vaccination requirements, but for some people on the board of supervisors, they say it should not be that hard to check vaccination status. outdoor dining and drive-through lines, that is what every

>> they are doing the right thing and they are keeping not only their customer but -- customers healthy but they are making sure their service -- servers and plays are healthy. >> in-n-out burger said we refuse to become the vaccination police for any government, it is invasive and unsafe to force restaurant associates to segregate those intimate -- into those who may be served and who may not. the governor did not take aside, saying people should -- >> i encourage everybody to take seriously local health orders and support businesses that support the state. i appreciate they are a california-based company. >> you can see the protesters a gathering outside of the san ramon in-n-out. i reached out to in-n-out burger in the county health services to get an idea about where things stand in for an interview.

they declined and one thing they mentioned to me cannot county health services said in-n-out burger is in compliance with the vaccination medic because they only requiring outdoor dining in drive-through. that way going about it does not require anybody to show proof of vaccination status. dan: how long to -- in-n-out plan on sticking with outdoor dining? >> they are doing what they're doing to avoid further conflict with the county health apartment. they are not trying to hide it. you can see at the locations where we were today, san ramon and pleasant hill, any signs on the windows and indoors that say they are not allowing indoor dining at this time. dan: thanks. breaking news in oakland. all lanes of westbound interstate 580 are closed near high street because of a shooting on the freeway. sky seven is over the scene.

extracurricular activities like sports and graduation. >> the third option would be to wait for the full info mentation from the state that we know is coming, most likely in the fall of 2022. >> in order to convince students and parents to get the vaccine, the school district focus on doing outreach and educational campaigns. >> this mother told us if the vaccine is required, she will keep her child at home. >> some of those kids will end up in independent study and we understand that and we will be expanding our capacity to make sure kids are able to do that. >> yesterday and fda advisory panel approved the pfizer vaccine for children five to 11 one member questioned whether every kid in that age group needs the shot. or should it be given only to high-risk children? >> i don't think it's going to give the health care community and parents the options to choose what is best for the children. >> even if children five to 11 begin to get vaccinated as early

as next month, this new mandate would not apply to them because it would not give that age group enough time to fully comply. in oakland, leeann melendez, abc 7 news. dan: through the pandemic we have been tracking how it is affecting the economy. it is a pillar of our commitment to building a better bay area. a new report released today shows san francisco struggling to bounce back. it is falling behind other major cities, getting employees back to the office. stephanie sierra is in the newsroom with a look at some of the reasons that is happening. stephanie: experts say part of it stems from san francisco being such a remote friendly work city, along with the fact that prior to the pandemic the city was coming off a 10 year old in boom. the new construction left more empty space to lease out. getting employees back to the office means a big part of san francisco's economy will bounce back too.

ama: we are learning more about a stabbing in the financial district that we reported yesterday. they started with a random attack and ended with a good samaritan being stabbed. tim johns has details in our newsroom. >> around 12:16 tuesday a woman was stabbed near mission and stewart streets in san francisco. sf pd confirms it was a random attack, when a seven-year-old suspect -- the 27-year-old suspect pushed her to the ground. the woman saw it happen and thought it was a robbery so she started following him. >> two ladies were running with her they saw it was a police car in.

cracks he saw what unfolded. >> i saw the police officer with the ladies going up the street. cracks we saw people -- >> we saw people gathering on the corner and i saw her down on the ground. >> when the 31-year-old woman confronted him he stabbed her and kicked her before running away. with the help of eyewitness accounts officers identified and arrested him who physically resisted. he also had an outstanding arrest warrant and was booked at san francisco county jail on multiple counts including attentive homicide. speaking tuesday afternoon, sf pd says hate crime elements are being looked at for this case. the senior citizen who was initially attacked was of asian descent. >> this crime along with every crime we investigate, we look into that aspect if there is a hate related bias to the motivation. >> while interest has been made,

terminal ballpark project, alameda county board supervisors joined the city of oakland in supporting the plan. major league baseball commissioner rob manfred told us it is a positive step, they will continue to pursue the project as well as the las vegas alternative. next the a's will announce the finalists after the world series. dan: the city of oakland will complete the environmental impact report by the end of the year. larry beil with more the project and what it means for the future of oakland. larry: this is one step and there are many more that need to be cleared but let's bring in film a tear -- phil to get more insight. we heard reluctance from the board of supervisors and that nine-hour meeting. somewhere between confused, concerned, uninformed to be honest. what is the biggest concern for alameda county taking part in

this project? >> the biggest concern is this is not just a one vote of approval. while the city says you're not going to have to put in any money, there is a fear that the alameda county order supervisors level, that the city is going to or could come back and ask for more money, possibly for help with a bond. anything that might wind up getting close to a deal that we had with the oakland raiders when they came back. that was a disaster and the board of supervisors do not want to repeat. they are saying we agree with this in principle and we want to see the details but we are not ready to jump in bed. larry: we will come back to the ritter situation because it is a cloud that hangs over every stadium decision -- raiders situation because it is a club that hangs over every stadium decision. there's another timeline, major league baseball want a final yes so they can move on.

everyone is winning on the environment impact report and the giant clock looming is the expiring term of the oakland mayor who is a huge supporter and if she is not an office and it drags out, it is a problem. >> she is probably the m.v.p. on the city side of the deal. she is the biggest booster, the one who has corralled the votes, she has pushed through the agreements and is negotiating with the a's. it's by her force of will that this project is going forward and she is going to be entering the final year of her term as mayor. that makes her a lame duck and it makes it hard for her to push forward the agenda. something like this which is a huge ballpark deal, which is always going to have controversy, could wind up eggs to the timing and the delays -- thanks to the timing and the delays taking center stage in the election to replace her. that is not what the a's want to be.

they don't want to be a political football or hardball or baseball in an upcoming mayor's race in the stadium could wind up being in that situation. larry: that leads us back to the raiders deal. we are going back 25 years. the city, the county all got upside down, it was a bad deal and it is still haunting oakland politicians. we heard in that meeting yesterday. we don't want this to be another raiders situation. the deals look nothing alike. there is no similarity between the raiders and what the a's have proposed but it is on the third rail that no politician wants to touch. >> they have in common is the use of public funds, whether it is federal, state, local, regional or a mix, the use of public funds. after the raiders deal where alameda county and oakland city residents and taxpayers were

paying $10 million a year to still pay off that debt, it is absolutely the third rail. nobody wants a repeat. what is going on here as they are trying to negotiate this deal while getting it approved. i've never seen a deal like this done before and neither have a lot of people involved. here's the bottom line. nobody wants to be the one that says yes, we are going to do it. but nobody for sure once to be the one that says no, we are not going to do it. nobody wants a repeat of the deal from before but nobody wants to be the person or group that sent the third sports team out of the east bay and left them with nothing. larry: not a yes and not know which leads us where we are. thank you for your insight. ama: next, a showdown on capitol hill that may impact the future of your sick pay. dan: the deal democrats are expected to make and what it

dan: state lawmakers were furious with the edd renewed its partnership with bank of america to deliver on a limit benefits. they renew the contract for two years in spite of rampant fraud on edd debit cards and thousands of frozen accounts. ama: it left many workers without unemployment benefits during the worst of the pandemic and now it says it is setting up a system to get around that trouble with direct deposit and benefits. but when? michael finney is here with the latest. >> at first it seemed like a debit card was a great idea, a good way to deliver benefits since not everyone has a bank account. during the pandemic hackers were draining money off the cards in the bank was freezing accounts. now edd says it will set up direct deposit but it won't be soon. >> $7,000 was taken out of my account. it hurts. >> you took $16,000 from the

account, where did it go? >> stories kept pouring in, unemployed workers finding hackers draining their edd debit cards and when they filed a claim, bank of america restore their phones only to take the money back out and freeze their accounts entirely. the bank said the claims were suspicious but it left thousands without any income during the pandemic. >> i'm a victim and i'm a victim and i being treated like a criminal. >> they renewed the contract for up to two more years and at a hearing monday state lawmakers asked edd for a long-awaited solution. >> rb going to allow direct deposit so we avoid the debit card fiasco we have been dealing with since the pandemic? >> we will but it's probably a couple of years off. >> the director says she is asking banks for proposals to set up a direct deposit program but it will not happen anytime soon even though most states do
