>> yes, she is. we begin with breaking news. a major ruling by a federal judge against former president tump. rejecting his claim of executive privilege to keep the house committee investigating the january 6th insurrection from gaining access to his white house records. chief washington correspondent jon karl is on capitol hill with the latest. good morning, jon. >> reporter: good morning, george. if the federal judge's ruling stands, the january 6th committee will get access to a treasure trove of white house documents and possibly videos and photographs as well that will shed light on exactly what donald trump and his top aides were up to right before and during the capitol riot. donald trump had sued to prevent the national archives from turning his white house documents and records over to the january 6th committee invoking the doctrine of executive privilege that a president has a right to get confidential advice from his aides. but the judge flatly rejected the claim that executive privilege applies in this case especially because donald trump is no longer president and the

current president has agreed the documents should be released. his position he may override the express will of the executive branch appears to be premised on the notion that his executive power exists in perpetuity, but presidents are not kings and plaintiff is not president. the committee is hoping to get call logs, emails and notes to determine what was happening inside the white house on and shortly before january 6th. they are also interested in video including outtakes of the infamous video trump released that night where he asked rioters to go home but also praised them. >> we love you. you're very special. >> reporter: a source who was there for the taping of that video tells abc news that multiple earlier takes were rejected because trump praised the rioters but he didn't tell them to go home. the committee is zeroing in on donald trump's inner circle ly befo on ja6th issuing 16 subpoenas over the

past two days. among them some familiar faces, kayleigh mcenany, the former white house press secretary, also senior adviser stephen miller and john mcatee who at 29 years old became one of trump's most powerful and fiercely loyal aides, and molly michael, his personal secretary who sat right outside the oval office. >> jon, the big question right now, does former president trump have any real chance on appeal? >> reporter: look, george, he's definitely going to appeal. this will be decided at the appellate court, potentially the supreme court. in a statement overnight his spokesperson said, quote, the battle to defend executive privilege for presidents past and future was destined to be decided by the appellate courts. most legal scholars say this was a strong ruling by this federal judge and consistent with what most constitutional experts would say will be the case. executive privilege does not apply to former presidents. >> there's no disagreement

between the executive and congressional branch right now. jon karl, thanks very much. robin? we turn to aaron rodgers and the packers. the quarterback and the team have been fined for violating covid protocols as rodgers says he takes full responsibility for misleading anyone with satements about his vaccine status. will reeve joins us with more on this. good morning, willing. >> good morning, robin. aaron rodgers had an ugly off season with the packers. there were contract squabbles and a fear he'd quit football rather than return to the team. ultimately he did come back to green bay where he earns a reported $1.6 million per game. the fine he received for breaking nfl protocols in covid is the designated amount collectively bargained between the league and the players union. almost $15,000. he should be able to cover it. overnight, green bay packers quarterback aaron rodgers fined nearly $15,000 for attending a party unmasked and his team fined $300,000 for covid

protocol violations, including allowing rodgers to go maskless at press conferences. >> rodgers tosses in the end zone. >> reporter: this as rodgers owned up to faking people out about his vaccination status on "the pat mcafee show" tuesday. >> i shared an opinion that's polarizing. i get it and i misled some people about my status which i take full responsibility of, those comments. >> reporter: previously the reigning nfl mvp appeared to confirm he had been vaccinated in this exchange. >> are you vaccinated and what's your status on vaccinations? >> yeah, i've been immunized. >> reporter: the nfl does not have a vaccination mandate for players or employees but has imposed strict protocols for unvaccinated players like rodgers. >> rodgers is inside the pylon. touchdown, packers. >> reporter: the future hall of famer says he received an alternative treatment to boost his immunity in lieu of the shot reportedly appealing the nfl to consider that treatment equivalent to being vaccinated. a request reportedly denied by the league which has designated rodgers unvaccinated.

i don't know how they could have allowed those things to happen to him or anyone else's child. >> i could never imagine anything like this just happening. [ crowd chanting stop the show ] >> reporter: both live nation and travis scott have been criticized for not stopping the concert earlier but houston's mayor sylvester turner says that ending the show sooner could have made things worse. >> got thousands and thousands that are crammed in and they don't know what's happened. >> reporter: for the first time we are hearing from one of the medics brought in to help speaking out on tiktok describing an under staffed medical team thrust into an out of control crowd. >> i had so many people reach out to me, tug on my jacket, grab my shoulder and was like, please help me. i broke my foot. please help me, i dislocated my shoulder. please help me, i feel like i'm going to pass out and i had to tell all of them, i will try to come back for you but people are literally dead right now that i need to go help.

>> reporter: richardson says he blamed the crowd for what happened. they only wanted to get as close to the stage as possible. george, just a chilling firsthand account of what was happening at that concert. >> marcus moore, thank you so much. we're now going to get the latest on the pandemic. pfizer has formally asked the fda to authorize booster shots for everyone 18 and over. trevor ault is at pfizer headquarters in new york with the details. good morning, trevor. >> reporter: good morning, george. so pfizer was turned away from this sweeping booster shot approval just six weeks ago but they believe they have the data to go for it once again. what the company is presenting are the findings from a trial of 10,000 participates that was done during the delta variant wave and shows it raises efficacy to 95% regardless of a person's age. the only people vaccinated by pfizer who are eligible for a booster shot are people 65 and up or those considered high risk because of other health conditions or their work.

leading health experts like dr. anthony fauci have been saying it is likely boosters will soon be available to all adults and there are reports this could come even before thanksgiving and it's possible the fda could simply authorize and make the announcement of the authorization publicly without bringing it before a panel as they did the first time. robin? >> we'll wait and see, thank you. now to the case against kyle rittenhouse, the man charged with killing two people during protests in wisconsin last year. prosecutors shown dramatic drone video of the shooting as the defense kicks off its case. alex perez is at the courthouse in kenosha, wisconsin, for us. good morning, alex. >> reporter: hey, good morning, robin. that drone video was sent to a crime lab to be enhanced as it was being shown. jurors were taking a lot of notes. this morning, kyle rittenhouse's defense calling more witnesses after prosecutors rested their case tuesday. the prosecution showing jurors new key evidence, enhanced drone video that captured the moments rittenhouse shot and killed

joseph rosenbaum. the medical examiner who performed rosenbaum's autopsy testifying he believes of the several shots rosenbaum suffered it was the shot that entered his back that killed him. >> if an individual is moving forward and they sustain that injury, that entered by the groin and went to the hip, could that cause them to fold forward? >> that's possible. >> reporter: prosecutors argue rosenbaum fell forward because of his injuries, but the defense arguing rosenbaum wasn't falling but lunging towards rittenhouse to grab his weapon. >> if i had my hands out i'm even closer, correct? >> yes. >> if i'm lunging and going for your gun, which is an extension away from your body, closer still? >> yes. >> reporter: the defense calling to the stand others who were patrolling the streets alongside rittenhouse during protests in august of 2020. some say rosenbaum made threats that night. >> rosenbaum started shouting

back at us that he's going to -- pardon me, judge, for saying this and everybody else -- but he was going to kill us [ bleep ]. >> reporter: nicholas smith saw rittenhouse after the shooting describing him as sweating and pale. >> he repeats i just shot someone over and over. >> reporter: rittenhouse did at one point in court look away when the jury was being shown some graphic pictures. it remains unclear if he'll take the stand in his own defense. robin? >> all right, alex, we know you'll stay on the case for us. thank you. george? we turn to a new government forecast on skyrocketing fuel bills. gasoline, natural gas and home heating all seeing price spikes. rebecca jarvis has the latest. >> reporter: according to those new numbers released by the energy information administration, everything from your pump prices to heating your home is going to cost americans more in the coming weeks. they expect the nearly half of u.s. households using natural gas will spend 29% more on their fuel bills this year than last winter. 48% more if it's a particularly cold winter.

heating oil is expected to jump 39% from last year. propane is expected to rise 46% and electricity is expected to increase 6%. meantime, consumers are also paying more on everything from their groceries to their clothes, cars and shelter. just moments ago the bureau of labor reporting that inflation jumped 6.2% in october versus a year ago to a 30-year climb. >> what about gas prices? >> the department of energy expects gasoline prices which are currently at their highest monthly average since september of 2014 to continue climbing this month to an average of $3.32 a gallon before falling so they will and they are expected to fall next month to $3.16 a gallon on average. some better news there. george? >> rebecca jarvis, thanks. michael? all right, george, turning now to the basketball debate, making noise on the court after using the same basketball for nearly 40 years, the nba switched it up and some of the players are crying foul. t.j. holmes is here to break it

roughest crossings on the planet. that is coming up. george? right now we're getting an interview with the santa fe district attorney leading the investigation into the movie set of alec baldwin. we go to kaylee hartung who is live in new mexico. >> reporter: george, we're three weeks in a case that brought international attention to new mexico but the d.a. is not rushing the process. she says until the sheriff's department hands over all the evidence to her, her hands are tied. so she warns it could be months more before she's able to determine who if anyone is criminally liable. >> so prosecutors have to deal in facts and evidence. >> reporter: the santa fe district attorney deciding whether to press charges after that fatal movie shooting in an exclusive interview with abc news now refuting claims by the attorneys hired to defend crew members at the center of the investigation. how did live ammunition end up on the set? >> we don't have an answer to that yet. i know that some defense attorneys have come up with conspiracy theories and used the word sabotage. we do not have proof. >> do you believe sabotage is a

possibility? >> no. >> reporter: just last week on "gma" an attorney for the film's armorer trying to turn attention away from the 24-year-old in charge of all weapons onset. >> we're afraid that could have been what happened here, that somebody intended to sabotage this set with a live round intentionally placed in a box of dummies. >> if it were to be found that this was a case of sabotage, would you be looking at a murder charge? >> certainly a higher level of murder charge than we would potentially be looking at with the facts we have now, yes. the defense attorneys, we don't have the same information that they do but until we have it in our hands it doesn't play into the decision-making process. >> reporter: mary carmack-altwies is prepared to wait months for the investigation into halyna hutchins' death to be completed, but evidence so far suggests to her this tragedy was avoidable. >> i think the most concerning thing is that there were so many levels of failures on that set. >> is it your understanding that

mre live rounds than that one were found on the set? >> yes. >> do you have an understanding of how many? >> i do, but i can't release that information at this time. >> are you concerned as a legal matter about the other live rounds found on the set? >> absolutely. we still don't know how they got on the set and how they got there i think will be one of the most important factors going into a charging decision. it's probably more important to focus on what led up to the shooting because the moment of the shooting, we know that at least mr. baldwin had no idea that the gun was loaded. so it's more how did that gun get loaded? what levels of failure happened and were those levels of failure criminal? >> how much have you learned about hannah gutierrez reed's qualifications to be in the job she was in?

>> that's one of the areas of inquiry that we are certainly pursuing and that the detective that is in charge of this investigation is going to be asking her during her second interview. >> reporter: the chain of custody of the gun that fired the fatal shot has been called into question. do you know who loaded the gun? >> we do, yes. >> reporter: the d.a. declining to say who loaded it. according to a search warrant affidavit the assistant director dave halls handed the gun to alec baldwin, but his attorney on fox news saying he did not. >> in the affidavits it states that my client grabbed the gun off of a prop cart and handed it to baldwin. that absolutely did not happen. >> is it your belief that dave halls handed the gun to alec baldwin? >> yes, that does seem to be the case. >> reporter: authorities say nearly 100 people were on the new mexico set when the shooting occurred. more than half have already been interviewed.

>> everyone initially was very cooperative, but adding in attorneys adds in an extra level of complication. we don't have laws that have been written for this kind of incident. >> there is no precedent for a case like this? >> certainly not in new mexico. >> are you prepared to press criminal charges? >> if the circumstances warrant it, absolutely. we will do our best to get justice for halyna hutchins and joel souza. >> reporter: the calls for change in halyna's name have been reverberating through hollywood and alec baldwin earlier this week saying he wants every set using guns, fake or otherwise, to have a police officer present to monitor weapon safety. the d.a. telling us she wants to be a part of that change that could come to film and television sets here in new mexico. guys? >> a lot of news there. thank you, kaylee. now to the latest in meghan markle's legal fight against the uk tabloids. after she won the privacy case the newspaper group is launching an appeal.

were up and down and now my stomach is rolling even with my patch. i'm surviving here but these are a rite of passage. this passage, these waves for any sea explorer and the exciting thing is all of you are coming along with the ride without any of the nausea that goes along with it as we show you the first ever live drone shot from the infamous drake passage. >> we would like to be the first to welcome you. >> reporter: on the third day of our journey our crew arrived in ushuaia, argentina, to go on the "endurance." its first journey south since the pandemic shut it down. our floating home for the next two weeks as we explore antarctica and its wildlife from whales and seals to penguins. here we are pushing off the coast of argentina. we have 500 nautical miles ahead of us and some pretty rough seas

before we finally reach the bottom of the earth. this morning, we face a new challenge. it was a rough night, very rocky and i'm feeling a little nauseated. we are now crossing drake passage, a place in the water where the atlantic and pacific ocean meet. the currents of each ocean crashing into each other causing swells and wind speeds at hurricane force. average depths of 11,000 feet. 30-foot waves are not uncommon. there aren't any land masses to slow down the strength of these waves and these photos prove it. taken on an earlier lindblad expedition they show the power of the drake passage as waves crash over the bow. >> see which way the breakfast goes for you tomorrow. there's magic ahead of us. >> reporter: we have another 24 hours before we see icebergs on the horizon. >> this is a spaceship on water. >> reporter: this is what this vessel is made for. built to navigate polar conditions, the "endurance" is

sophisticated equipped with what's known as an x bow, a device that's built to slice through waves and create a smoother ride. expeditions like this one are put together by sven lindblad whose family legacy is built in ice. his father lars led the first group of people who were not trained expeditioners, many of them women, to antarctica back in 1966. now these expeditions highlighting the danger climate change poses to antarctica and the rest of the world. >> we're at a tipping point if we don't change our behavior real fast. >> what happens in antarctica affects the entire world. >> does not stay in antarctica. >> reporter: i have to say thank goodness for that x bow on this ship. we are navigating 18-foot swells right now and we're still feeling them but i can't imagine if we didn't have this technology with us. and get this, guys, you know i'm up for almost anything but i have been convinced once we get

if this federal judge ruling stands, the january 6th committee will get access to a treasure trove of white house documents, possibly including videos and photographs that would shed light on exactly what donald trump and his top aides were up to right before and during the capitol riot. donald trump had sued to prevent the national archives from turning his white house documents and records over to the january 6th committee. invoking the doctrine of executive privilege that a president has a right to get confidential advice from his aides. but the judge flatly rejected the claim that executive privilege applies in this case, especially because donald trump is no longer president and the current president has agreed the documents should be released. his position that he may override the express will of the executive branch appears to be premised on the notion that his executive power exists in perpetuity, but presidents are not kings and plaintiff is not president. the committee is hoping to get call logs, emails and notes to determine what was happening

inside the white house on and shortly before january 6th. they are also interested in video including outtakes of the infamous video trump released that night where he asked rioters to go home but he also praised them. >> we love you. you're very special. >> reporter: a source who was there for the taping that have video tells abc news that multiple earlier takes were rejected because trump praised the rioters but he didn't tell them to go home. a trump spokesperson said the former president trump will appeal the ruling. george, even if he doesn't win, the big question is how long will that appeal process take because if trump doesn't win, what he wants to do is to delay the work of this committee. >> yeah, that's been pretty clear. jon, thanks very much. robin? now the latest on that fallout for aaron rodgers and the packers. the quarterback and the team have been fined for violating covid protocols. let's go back to will reeve with more on this again. will, good morning. >> hey, robin.

welcome back t welcome back to "gma." thanks to man-made snow, killington, vermont, skiing and snowboarding already. check it out. you can see it's man made because in the distance you don't see any snow. the university of vermont did a study about climate change and vermont and especially in winters they are warming rapidly. we have seen big change on the order of two degrees on average of a warming since 1900 for the state of vermont. you say two degrees doesn't sound big. it is when you spread it out and especially when you get into a snow season getting shorter. they told us precipitation has also increased significantly to 21% and what this means, why it's a big deal, about 70 bird species will disappear in about 25 years thanks to warming so there's something to pick you up

country but serving their community and today they think that they're getting interviewed by the local station and they have no idea they're going to be on national tv, nor what they're about to get.
