a fire iter writing, this is when it got real. >> it comes as another family is torn apart by the tragedy. a college student is now the ninth person to die from their injury. >> now we're hearing from scott's attorney who condemns what he calls finger pointing but we begin with the new time line of the chaos. overnight logs obtained from our houston station revealing new details on the events leading to that deadly surge at a houston concert a week ago today. the minute-by-minute logs show by 9:23 a.m. crowds had breached the main gates, nearly 40 minutes before the festival was set to open. by 9:48 the first patient had been transported to a hospital and by 10:02 a firefighter noting fences had been damaged and there was no control of participants. >> from the beginning it was not going well. >> reporter: by 1:21 p.m., eight hours before travis scott took the stage, all five ambulances on site will taking patients to hospitals, and just before

5:00 p.m. police reporting dangerous crowd conditions inside the venue and at 9:18, the first report of a crush injury, a chilling sign of things to come. >> i want my baby back, you know? i won't be able to live without her. >> reporter: this morning the mother of 22-year-old bharti shahani breaking down after announcing her daughter's death. shahani went to the music festival in houston one week ago with her sister and cousin but lost each other in the deadly crowd surge. >> i was holding her hand, and once that happened, the next time i saw her, she was in the er unconscious on a ventilator. >> reporter: shahani now the ninth person to die in the tragedy. all of the victims under the age of 30. her cousin saying her death was avoidable. >> if the producers, the venue, the organizers and live nation had done their job, if they had

hired properly vetted security and trained medics, if they hadn't packed us in on all three sides with barricades, they suffocated us. they did this to bharti. >> many are also blaming performer travis scott for not stopping the show sooner. he and the organizers are now facing multiple lawsuits and scott's attorney telling our station in houston city leaders should stop finger-pointing. >> nobody really knows exactly what the breakdown was. it seems to be an institutional breakdown that happened. >> a 9-year-old boy who was also injured at the festival remains in a medically induced coma. witnesses for both sides of the kyle rittenhouse murder trial have testified. now the lawyers are preparing their closing arguments. rittenhouse could get life in prison for gunning down three people, killing two of them. he claims he fired in self-defense. here's abc's morgan norwood. >> reporter: the stage is set for closing arguments to begin on monday in the trial of kyle rittenhouse. the defense resting its case

late thursday, 24 hours after rittenhouse took the stand in his own defense. rittenhouse is charged with killing joseph rosenbaum and anthony huber and injuring gaige grosskreutz with an ar-15. the 18-year-old arguing self-defense. in court jurors shown new images of the moments before the shooting. they were captured by blogger drew hernandez, the defense calling him to the stand. >> did you observe him acting in an aggressive manner to anyone that you observed? >> in no way, shape or form. the first time i saw kyle he actually de-escalated a situation. >> reporter: prosecutors trend pressing hernandez about social media behavior and whether he has an agenda. >> have you ever posted anything on social media -- >> yes. >> -- in support of kyle rittenhouse? >> one could argue, yes. >> reporter: the defense also bringing in an expert who analyzed the video from the protest and testified rittenhouse killed rosenbaum and huber and injured grosskreutz in a matter of 2 minutes and 55 seconds. grosskreutz the only person to survive being shot by

rittenhouse reacting to his tearful testimony. >> people right there. >> reporter: speaking exclusively to our michael strahan on "good morning america." >> to me it seemed like a child who had just gotten caught doing something that he wasn't supposed to. more upset that he was caught and less upset about what he had done. >> reporter: today the judge will meet with both sides to go over jury instructions. now, the state indicated they would ask for lesser included charges to give the jury options should they feel the burden was not met for first degree and attempted first degree intentional homicide. mona. >> morgan, thank you. an appeals court temporarily blocked the release of records from the trump white house to the house committee attacking the attack on the capitol. lawmakers were supposed to receive the first batch of documents today, but the court set a hearing for november 30th on his claim of executive privilege. meanwhile, former white house chief of staff mark meadows is

refusing to testify before the committee. more indoor gatherings as the weather turns colder. elizabeth schulze is in washington with more. elizabeth, good morning. >> reporter: covid hot spots around the country could be a troubling sign for the winter months ahead. for the first time in months new covid cases nationwide are on the rise with 22 states reporting a surge in infections. >> our hospitals and icus are filling up with patients who are going on ventilators. >> reporter: hospitalizations up in 14 states from colorado to michigan to vermont. low on icu beds, some hospitals are rationing care. >> the patients of new mexico that need the care most will receive the care during this

time of unprecedented volume. >> reporter: health experts say this latest surge is fueled by unvaccinated americans, waning immunity from the vaccine and colder weather as more people gather indoors. >> with people starting to make together, i think it's an get - important time just to let everyone know that we've got to stay vigilant. >> reporter: officials in colorado and california are now encouraging every adult to get a covid booster. though u.s. health officials haven't given it the okay. many are still resisting the shots altogether. overnight during an anti-vaccine mandate protest at the golden gate bridge, at least five people were injured in a car crash. more than 107 million americans remain unvaccinated. maddie was among them when she got covid. she's now on a ventilator struggling to breathe. >> it's horrible. sorry.

arbery family. a georgia baby who went missing in thefami's sit his family left him asleep for just moments while they unloaded groceries. when they came back, the suv was gone with the baby inside. this morning, a mother breathing a sigh of relief after her 1-year-old son was found safe, 36 hours after being abducted. >> i'm speechless. i'm ecstatic. >> reporter: she says he was in hur suv as she unloaded groceries around 1:00 a.m. she says someone jumped into the vehicle and drove off with the baby still in the car seat. the suv was found late they are day. >> i've never been away from him like this, where it's like i don't know where he's at. >> reporter: but on thursday afternoon, he was found, cameras capturing the moment authorities removed him from this home. a woman at the home says she

britney shirts hours before a judge is set to decide whether to terminate her conservatorship. >> reporter: this morning, the free britney movement may come to fruition, as a los angeles judge could officially end her conservatorship that's been in mace for nearly 14 years. britney's father, jamie spears, had been in control of her estimated $60 million estate until september when the judge suspended him as her conservator and appointed a temporary one. and today's hearing could end the conservatorship all together. britney writing earlier in the week, this week is going to be very interesting for me. ♪ ♪ last summer, the nearly 40-year-old singer told the court for the first time that she was in an abusive conservatorship, claiming i was scared of my dad. in late october, her lawyer filed a motion to end the conservatorship that she has

endured for so long and she's pleaded with this court to let her have her life back. since its inception in 2008, jamie spears had fought to remain as conservator, but in a recent change of heart, he agreed to the motion. his lawyers saying jamie will do everything he can to protect and care for her. jamie believes that the conservatorship should end, immediately. and with no objections, abc legal analyst dan abrams expects britney to be free. >> i think it's likely now that on november 12th, we're going to see the end of the conservatorship, or at least the wheels rolling towards exactly how that conservatorship is going to end. >> britney spears is expected to attend today's hearing virtually. meanwhile, her attorney may be looking to pursue criminal charges against jamie spears, after a "new york times" documentary report found evidence of alleged illegal surveillance. mona, andrew? >> thank you. in sports, the dolphins'
