threatened by arbery before the fatal gunshots. >> right now, a closer look at both trials. this morning, two high-profile trials gripping america. both of them racially charged, hinging on video and predicating on the argument of self-defense. travis mcmichael surprised juries by taking the stand in his own defense, speaking publicly for the first time about shooting and killing ahmaud arbery last year. >> i was thinking about my son. it sounds weird. that's the first thing that hit me. >> reporter: video shows mcmichael shooting arbery, after what they claim was a citizen arre arrest. they are seen waiting for arbery. there's a struggle before arbery is shot. mcmichael told jurors he was scared for his life after arbery grabbed his gun. >> what did you do?

>> i shot. >> why? >> he had my gun. he struck me, this is a life-or-death situation. >> reporter: before the shooting, arbery is seen wou wandering through a construction site. mcmichael said he was trying to stop blurglars at the time. >> when you got inside the truck, you had your phone with you. >> yes, i had my phone. >> and you didn't call 911 at that point? >> i did not. >> reporter: in the meantime, in kenosha, wisconsin, today is day three of jury deliberations in the kyle rittenhouse trial. on wednesday, the jury rewatched drone video from the night rittenhouse shot three people, killing two of them. it shows rittenhouse profolked the crowd, by putting down a fire extinguisher and raising his gun. now, defense attorneys say

prosecution provided them with a lower quality version of that video. >> somehow in detective howard transmitting it to everyone, if it was e-mailed, it was come peszed. >> reporter: rittenhouse claims he was in kenosha at the time to protect property. reverend al sharpton tells abc's linsey davis, he is hoping for peace in kenosha and south georgia, no matter what the verdicts are in the trials. >> let's not talk about the violence that may happen. let's talk about the violence that did happen, the killing of ahmed arbery, that did happen. the killing of two men and wounding of another in kenosha. that did happen. before we forecast what might happen, let's do justice to the t violence that did happen. >> stay with abc news for continuing coverage of both trials today on our streaming channel, abc news live. the house has censured paul gosar and stripped him of his

committee assignments for posting a video depicting violence against democrats. only two republicans, liz cheney and adam kinzinger, joined democrats to censure him for inciting violence. >> does anyone in this chamber find this behavior acceptable? would you allow depictions of violence against women, against colleagues, would you allow that in your home? >> i do not espouse violence towards anyone. i voluntarily took the cartoon down, not because it was a threat. but some thought it was. >> after the vote, gosar retweeted the same video again. this time, he used his personal account instead of the official one run by his staff. the month-long strike at john deere is over, after work approved a new contract. employees will get better pension plans and an $8,500 bonus.

workers across the country have gained new leverage because of the labor shortage. new questions this morning about what can be done about rising gas prices. the white house wants to know if the big oil companies are taking advantage of drivers. em nguyen is here with more. >> reporter: good morning, andrew. president biden is calling for an investigation into gas prices, just as you know millions of americans prepare to hit the road for thanksgiving. with gas prices at a seven-year high, president biden is calling on the federal trade commission to investigate its illegal conduct is to blame. >> right now, it's difficult. >> reporter: biden writing in a better to the ftc, in the last month, the price of unfinished gasoline is down more than 5%, while gas prices are up 3% at the time. exxon and chevron were on-track to double their net income, compared to 2019. and saying, i do not accept

hard-working americans paying more for gas because of anti-competitor of illegal conduct. the industry pushing back, calling biden's move a distraction and saying postpandemic demand for gas is outpacing supply. the average price nationwide is $3.41 a gallon. that's up $1.29 from last year. in recent weeks, the white house has been pushed on how it plans to address soaring fuel costs. few specifics have been offered. >> we're looking at every tool in our arsenal. >> reporter: republicans have slammed green initiatives, saying the white house is waging war on emergency. the white house toured an electric vehicle factory in detroit, touting his infrastructure bill. >> we're going to kick-start batteries, materials and recycling. new loans and new tax credits. creating new purchase incentives for consumers to buy american-made, union-made clean

vehicles. >> reporter: still, the administration is take heat from environmentalist, after opening more of the gulf of mexico to oil and gas drilling. the biden administration is reportedly asking countries like china to consider tapping into their oil reserves, in order to bring down the cost of gas. >> em, thank you. an investigation is under way at a lab in pennsylvania after several vials labeled smallpox were found in a freezer. samples were known only to be stored in russia and at the cdc in atlanta. the vials appear to be intact and there's no sign that anyone has been exposed. the fda is expected to authorize pfizer and moderna covid booster shots for all adults as soon as today. if that happens, the cdc's final signoffs could come tomorrow. overdose deaths in the u.s. have hit a record high during

the pandemic. more than 100,000 americans died of an overdose between april 2020 and april 2021. that's one death every five minutes. experts say lockdowns played a role. >> those who suffer from drug abuse disease, instead of using drugs with others to ensure their safety, they used it alone at their own detriment. >> 75% of overdose deaths during that time were from opioids. historic flooding has forced an entire city to evacuate in british columbia, canada. officials say the evacuation order could be in place for one week. the canadian military has been mobilized to help victims on a flooded farm. people rescued cows using boats and jetskis. and time now for a look at your thursday weather. here we go. some potential trouble for thanksgiving travel. a storm system early next week could bring heavy rain and snow

i got you. come on. come on. >> let me go. >> come on. >> this was the scene as police officers in atlanta pulled a man from his burning car. the vehicle had plowed through two houses before crashing and bursting into flames. the man sufferd only minor injuries. a woman in washington state survived a truly horrifying crash. traffic slowed down when a big rig slammed into her red nissan from behind. the truck flattened her car. amazingly, she pulled herself out of the wreckage, sufferi in only a few minor injuries. two men convicted of assassinating malcolm x are expected to be exonerated today, nearly six decades after the civil rights icon was gunned down. the two men always maintained their innocence. the manhattan d.a. reopened the investigation last year after a netflix docuseries raised questions about key evidence withheld from the trial. >> everybody knew these two men

were innocent. and their families suffered so much from this. it's a shame it didn't happen earlier. >> a third man convicted admitted to being involved in the murder and identified two other gunmen. but they were never arrested. some are now calling for a congressional investigation. a new lawsuit has been filed in connection with the deadly shooting on the set of alec baldwin's movie. a script supervisor for "rust," claims safety protocols were not followed. and an attorney want toss know why baldwin fired a gun when the script never called for it. >> mr. baldwin chose to play russian roulette when he fired a gun without checking it and without having the armorer do so in his presence. his behavior and that of the producers on "rust," was reckless. >> the lawsuit seeks unspecified damages. no comment from baldwin or the other producers.

reprieve. andrea fujii explains why. >> reporter: this morning, a death row inmate who claimed his innocence for more than 20 years is set to be executed, unless oklahoma's governor intervenes. >> take a knee >>ep julius jonprotesting outside the governor's mansion last night. the confrontation leading to at least one arrest. [ singing ] >> reporter: hours earlier, demonstrators voicing their support at the state capitol. local students walking out of class, lepleading with the governor to grant jones clemency. his mother is refusing to give up. >> i don't get to hug him. and he's not this monster that people have portrayed him to be. i feel empty. the system is broken. >> reporter: jones was convicted, along with his high school friend, in the 1999 shooting of paul howell, on

oklahoma city businessman, who was carjacked and killed in his driveway after getting ice cream with his daughters. jones says he was with his own family when howell was killed and claims he was framed by his friend. that friend testified against jones and was released from prison after 15 years. >> i wasn't involved in anything anyway. i wasn't present. i didn't know he had been killed until after the fact. >> reporter: the parole board has twice voted, most recently last week, to recommend the governor grant clemency and commute jones' sentence to life in prison, saying there's too many holes in the case. lawmakers on both sides are pushing to save jones' life. kim kardashian, viola davis, and steph curry, coming to jones' defense. but paul howell's family telling a different story, insisting jones is the killer. they want today's execution to proceed. >> i'm here to warn you, he is not innocent. what if this was your family member that was murdered. >> reporter: jones' supporters
