the fog moves around a bit and we have temperatures moving this morning -- we see some sunshine with some upper 50's. reggie: the u.s. is now averaging more than 100,000 new covid cases per day, the highest it has been in two months. however, look as california. the test positivity rate is actually going down. it was at 3% a week ago and is now at 2.2%. then there's the new york city covid-19 vaccine mandate for all private sector employees. that goes into effect december 20 seventh. the covid-19 omicron variant continues to spread quickly across the country. kumasi: prompting newly revised recommendations from the cdc. jobina has more on how it might be affecting your holiday plans. jobina: the cdc is urging you to use a rapid test before you head

into an indoor gathering, even if you are vaccinated and don't have any symptoms. getting vaccinated to protect unvaccinated children, older individuals, those who are immuno compromised or people at risk of severe disease. cases across the country are up 27% in the last week. omicron variant has been confirmed in at least 19 states. >> we have not only had an incredible covid seurge, but a surge of those who are critically ill. jobina: 130 three children tested positive. now more than 733 have tested positive, and be more contagious and gleeful -- and lethal and less more money is designated to fight emerging threats.

kumasi: and the county health department is facing questions about how and if it's vaccine mandate is being enforced. amy: county officials are calling the approach leading with education, but that is leading to confusion in the restaurant industry. they have to check for vaccination cards in contra costa county before letting diners inside. they have had more than 80 complaints in november, but not a single citation or fine was issued. that has some restaurant owners wondering what is going on and some supervisors questioning this policy. >> i am disappointed and troubled by not seeing any fines issued in november, think fines are often needed often as a message to other restaurants. amy: in october, health

some 40 pearl harbor survivors and veterans are expected to attend the ceremony in hawaii. one day after the attack, the u.s. declared war on japan and officially entered world war ii. reggie: in hawaii right now, an unusually strong winter storm is hitting the island. torrential rain could cause catastrophic, even life-threatening flooding. that is the latest of the national weather service of honolulu. the governor declared a state of emergency. nearly a foot of rain has fallen on maui over the last 24 hours. the western hawaiian islands are under a flood watch through this afternoon. lisa: much lighter rain here we are looking at a couple hundreds, maybe through the -- couple hundredths,

through some mist and drizzle and pockets through your morning commute with fog, reduced visibility and reduced road -- slick roadways to contend with. we are coming up on brighter conditions, looking at mild visibility -- a mild visibility in sand capos, a mile and a quarter in san jose. on thursday, we will get mist, see this system bring sierra snow, but as we look at the rainfall amounts, maybe a couple of hundredths on thursday, but in the sunday and monday, just to begin, we will get over an inch of rain. it looks like there is more rain after that. we have been watching the system out there, but for this morning, it is a little misty out there and slow in spots. jobina? jobina: let's start with a look in the south bay, following two new crashes. the first is in san jose on northbound 280.

you see a slight slowdown coming in on the map, a crash between a car and a big rig, and another slowdown starting to pop in on our sensors from the map. all southbound lanes are blocked there. oakland, 880 at the coliseum camera, the headlights are traveling southbound, for your reference, and that brake lights, it is getting busy on 880. this is the bay bridge toll plaza. metering lights came on at 5:46. here's an interesting traffic story. we have new details about the extra money you will soon be paying at bay bridge tolls. despite being approved by taxpayers to fund transportation projects, the increased toll revenue is going straight into legal limbo. according to our media partner, the east times, more than $315 million in soleimani is caught up it -- in toll money is up in litigation.

two white men were charged with beating and killing emmett, but were acquitted. here's what they had to say about the close of the investigation. >> emmett till's death has caused some changes and through his death, we can see how far we have come and how much work we still have to do. kumasi: the investigation was reopened when the accuser recanted her accusation in an interview in 2008. emmett till's death will be remembered as the start of the civil rights movement. reggie: the annual jack london square tree lighting is expected to happen saturday night, despite the fact that someone set the 52- on fire. surveillance video shows someone setting the fully decorated tree on fire, leaving behind a

canister. firefighters were only 200 yards away, so they were able to put that fire out within minutes. >> to have someone potentially jeopardize that, jeopardize it in a safe space every week, that's a frustrating moment right now. reggie: only 10% of the tree suffered significant damage and is not in danger of falling. the oakland police department's core native with police on the investigation. -- the oakland fire department is coordinating with police on the investigation. kumasi: and it took nearly a year for the group to finish this project, but a tree is crafted from 900 granny squares and stands on it 12 foot high metal frame -- frame. volunteers came together on facebook to put together this display. and a family in germany now holds the world record for having the most christmas trees in their home. reggie: how many christmas trees does it take to break that world

on one tree anyway. here's a look at the system skipping by the bay area, pushing into the central valley and leaving us with some mist and drizzle through the bay. the coastal hills and the wet pavement here in san francisco, and just last hour, the hills of the east bay picking up one 100 or 21 hundredths -- 1/100th, or 2/100ths. damp on the golden gate bridge, which continues through the morning, then we look for sunshine to arrive, temperatures this afternoon, the same system the same thing, a couple hundredths, but it will bring the stronger system into sunday, monday, potentially tuesday. here's what's left of the system today, we will go through the afternoon with the thinning cloud deck. we fill out on wednesday and on thursday, there is the system that wants to bring mountain

snow. we need it, because as we look at our snowpack, only 11% of normal for the northern sierra, 16% of normal for the seven -- central sierra, and this will take us through thursday. ski resorts, a couple of inches, but wait until you see what comes for the weekend system. they have nothing there, but this will take us through next monday, where we will see anywhere from an inch and a half to two inches into monday night. it looks like there could be more active weather behind that, so that looks promising. temperatures climbing to about 60 this afternoon. it will take a while and be cool, air quality will be moderate. our level 1 system winding down, and looking at the next system coming in late tomorrow into thursday. a couple hundredths,

january 31. reggie: and the u.s. will not be sending a diplomatic delegation to the 2022 winter olympics in china. the white house announced this yesterday, citing what it calls genocide and ongoing crimes against humanity inching -- in xingjin support. >> we will be cheering them on from home. we will not be participating in the fanfare of the games. and it's the oakland a's annual week of giving. the oakland a's made donations for the boys and girls foundation, as well as the softball club. they provided equipment, scholarships, and access to clinics. now to a playful lab in minnesota with very good manners. kumasi: this dog was kind enough

storm by the end of the weekend. reggie: anti-protesters shut down -- anti-vax shut down a city council meeting. amy hollyfield is in the newsroom with a response to what is becoming a tricky situation. amy: what a night in healdsburg. the city council meeting had to move from in person to zoom. protesters were tapping on the windows of city hall during a city council meeting, demanding to be let inside. vaccination is required to enter city hall. these protesters called the mandate "unconstitutional and unnecessary," and at one point, they did go inside city hall, most of them unmasked. that's when city officials shut down the in-person meeting and moved to zoom. >> i know all my fellow council members and city staff are also feeling quite disturbed by what is going on this evening. to be in a situation where we

were essentially in harm's way and we had to lock the doors to the chamber. amy: healdsburg is at the forefront of this debate because one city councilmember, schuyler palacio's, has admitted she is not vaccinated. this means she cannot attend the meetings in person. palacios says the cityy face a lawsuit over the mandate. kumasi: thank you, amy. bay area health officials warned that we are on the verge of another covid surge across the country, but the omicron variant may mean that our next wave will be milder. health experts expect the bay area will see the beginning stages of a surge within two weeks. dr. peter chin-hong says the majority of patients in the hospital are unvaccinated and younger. cases are reported to be milder than delta, meaning patients are not in the icu and most are not

on oxygen. >> the fact that they are not requiring oxygen in the hospital is a good sign. it mainly shows that there is a robust inflammation that causes the lungs to get all plugged up. kumasi: doctors say it is possible that the conclusion drawn from this data could change. dr. chin-hong says we should know more in a couple of weeks. vaccination requirements are extending to children who attend events at the sep center. reggie: they will need to show proof of vaccination or have a negative covid test. since kids under five cannot get vaccinated yet, they have to show a negative test taken within 72 hours. some parents we talked to say they are happy with this news. >> it gives an extra layer of protection as well, so we are comfortable in the event and we can enjoy it. >> it will definitely take some

kumasi: the pleasanton city council today is set to vote on tougher smoking restrictions. this would ban smoking in townhomes, condos and buildings with three or more attached units that don't have separate ventilation systems. smoking would also be banned in common areas like hallways, lobbies, community rooms or parking lots. the ban would extend into outdoor private spaces where secondhand smoke could drift. similar bands are now in effect in neighboring cities. reggie: we are committed to building a better bay area, including protecting our climate and environment. we continue to set the example for reaching a sustainable future. in the south bay today, a new vision for a greener future in santa clara county goes before
