effect on your commute. 46 to 51 with a chance lingering at 7:00. from noon on we will have a nexus sunshine, clouds, breezy conditions and temperatures in the low to mid 50's. freezing cold temperatures. i will talk to you in a minute. reggie: memorial will be held for the security guard and former police officer killed while working with a tv news crew. he was shot in oakland last month. this killer has not been found. he pre-'s they worked as a police officer in hayward and san jose. his memorial will be at the san jose civic theater. we will stream it live on abc7news.com and on our bay area app. the late senator bob dole will lie in state in the u.s. capitol today. reggie: president biden will -- kumasi: president biden will join dole's window and family.

his casket will remain there for 24 hours. the capital will not be open for public viewing. his funeral will be tomorrow at washington national cathedral. he died sunday morning at the age of 98. life in prison without the possibility of parole, the new sentence for scott peterson who killed lacey and their unborn son. he had to be resentenced after the california supreme court overturned his sentence due to jury misconduct. yesterday, peterson came face to face his murdered wife's family. inside the courtroom in redwood city, his former mother-in-law blasted him for the deaths of her daughter and unborn grandson. she said, "no matter what happens in the future, lacey and connor will always be dead and you will always be their murderer." peterson says he is innocent.

that is a claim family members echoed outside the courtroom. >> he has been in prison over 18 years for a crime he did not commit. that is a heavy load to bear. kumasi: peterson did not make a former statement. the judge would not allow it. he will remain in the san mateo county jail until an appeal for a new trial. reggie: official say even though the omicron variant does not seem as dangerous as delta, it appears to spread faster. that could pose a threat for hospitals as we head into winter. 200 million americans are vaccinated but that meet--but that leaves more than 100 million nonvaccinated. covert cases are up since october. the governors of maine and new hampshire are activating the national guard to help overwhelm hospitals. in massachusetts, one hospital is at 120% capacity. >> if you look at the top five states, they generally are having around 50% vaccination rate.

i certainly expect we will see substantial differences in the size of holiday surges this winter based around proportion of patients vaccinated. reggie: this morning, senators are rejecting president biden's vaccine mandate for private businesses. joe manchin and jon tester across party lines, voting with republicans to repeal the vaccine or test mandate for businesses with more than 100 employees. even if the house joins the senate and the overturning the mandate, president biden says he will use his veto power to keep the mandate in place. kumasi: the head of the california medical board and former mayor of walnut creek says she was targeted at her home and at work. christina lawson shared this tweet of her terrifying experience on monday. lawson claims an alleged anti-vaccine group set in an suv as she left her home. they followed her to her parking

garage. the group claimed they were just trying to interview her. lawson has been in contact with police. she leads the california medical board and charts of licensing and disciplining doctors. she served as walnut creek's mayor from 2013 to 2014. reggie: new data from the national safety council says the number of deadly crashes is up and tying it to the pandemic. amy hollyfield is live on the road with more. amy: it is rough out here on the road during this pandemic. the number of fatal car accidents in 2020 was up 7.2% from 2019. that was the year of the lockdown. in 2021, the number went up again significantly. the first six months of this year, fatal car crashes were up 16%.

research shows driving behavior has changed during the pandemic. people are not wearing their seat belt as. much and disputing more. we talked to a professor at stanford about this and he thinks this could be because of the pandemic and he believes it is because of the discontent people are feeling. >> if i don't have to get a vaccination, i don't have to stop at red lights or obey speed limits. that attitude about not having social responsibility is dangerous. amy: there is no peak time or place for these crashes. data shows fatalities are up on city roads, rural highways, rural roads, highways and back roads, day or night, among every age group between 16 and 65. across the board, driving behavior has changed. it is something we all need to examine and think about. kumasi: thank you.

announcement we could see today. >> the attitude about not having social responsibility is dangerous. kumasi: make sure you take it slow out there because a lot of people are not. these scary statistics we are seeing on the roadways. experts say they might know what will be behind it. reggie: we will have rain, snow, more rain. if you look at the top right-hand corner of the screen, that is tahoe this morning. it has been blowing like that for a while. i keep getting distracted by it in the corner of my eye. [laughter] mike: it is almost unbelievable to think that is snow falling at that rate. that is nothing compared to what is coming this weekend when we will have five to six feet of snow. we have to unwind the system first so i will keep us under a storm impact scale of light until 1:00. there is still a drizzle, a

chance of a shower and a couple hundredths of an inch of rain. poor visibility will increase as the winds pick up and scour out low-level moisture. our best radar is around morgan hill and gilroy. you can see the clearing that is taking place up across the north bay. here is what is going to happen with the clouds, the radar amended temperatures. 52 to 55 at lunch with those breezes. it will feel even cooler than that. not the best day for outdoor dining. temperatures around 53 to 57. a lot of us dropping into the 40's to low 50's by 7:00. frosty cold nights, heavy rain, even snow for us, coming up. kumasi: is not biden invites--and vice president harris will be meeting with the white house covid response team with any update on the omicron variant. we are waiting to learn more, including its transmissibility.

the fda could authorize booster shots for 16 and 17-year-olds as soon today. pfizer made the request for this age group two weeks ago. kaiser is reporting 11 cases at its oakland medical center tied to an out-of-state wedding. most of the cases are not omicron but the staff is only experiencing mild symptoms. 200 million americans are fully vaccinated. on average, federal data shows about one point 9 million shots are being administered every day. roads are getting significantly more dangerous. numbers show traffic deaths are up 18% for the first six months of the year. reggie: that does not seem to make sense. if of us are driving but more of us are dying. amy hollyfield is on the roads this morning with some of the reasons this could be happening. amy: are you wearing your seatbelt? have you been speeding?

it seems some of our good habits are going to the wayside on the roads. data is showing people are driving more recklessly since the pandemic started. this is new information from the national highway traffic administration. the number of fatal car accidents in 2020 was up seven point 7.2% from 2019. -- up 7.2% from 2019. this year the number went up again. fatal car accidents the first six months of this year were up 18%. professor told us he thinks the pandemic is to blame, saying the health risks people are facing is causing them to shove other risks over to the side. >> the risk of getting infected, the risk of dying, the risk of contaminating other peer -- other people and so on. you pushed aside other everyday risks.

amy: he also thinks a rebelliousness we are seeing from some people during the pandemic could be spreading over into other parts of their world. people who say i don't have to wear a mask or get a vaccination is transferring into other areas of their lives like driving and feeling like i don't have to stop at a red light or a base bid limits. attitudes are changing. the data reflect that. with fatal crashes going up, it is something to think about as we go about our day to day. reporting live from interstate 680, amy hollyfield. kumasi: law enforcement authorities in marin county are investigating a case of parents who knowingly sent a coveted -- a covid positive get to class. students had to quarantine over thanksgiving rate after being exposed to the student. the district attorney is aware of the potential health order violation and will review it once police reviewed the case.

any update on the markets, next. reggie: travis scott in his own words sharing his side of the story in his first public interview since the astroworld concert stampede. first, sue has a look at your commute. sue: we go straight to the bay bridge toll plaza. about one hour ago, the metering lights were turned on. now you can see the backup has the over crossings for a 10 minute delay getting to the tolls. you are sluggish on the upper deck through the tunnel into the western side of san francisco. here the emeryville camera. it is a solid stream of headlights from hercules all the way to the city, a 35 minute drive. it is not too bad. once it hits 40 minutes we will change that to an orange color and you will see significant slowing. for now, you are moving along at a good clip. we will check in with mike now. mike: i ran into some damp spots this morning but that was a couple of hours ago. most of that is moving away but

we have a chance through 9:00 of some drizzle and you can see the clouds clearing out. he was future radar. by lunch we have total sunshine. the sun will warm the ground and let go of that moisture. mostly sunny and fair weather commute this clouds develop. those clear out for a quick drop in temperatures this evening as breezes taper off. look at rainfall amounts, about nothing left in this system. the winds will be fastest along the coast, gusting up to 45 miles per hour while the rest of us could have guests 15 to 20 miles per hour, even up to 30. it will be a brisk afternoon. temperatures are running around 46 to 53 in the north bay. about 49 to 53 for the rest of us. it is not that chilly this morning, especially compared to what was coming on us tomorrow. 49 at 8:00 in the south bay. mid-50's from noon all the way through 4:00 and down to 48 that 8:00 tonight.

was posted to charlamagne tha god's youtube page. he was asked if he knew and when he knew what was going on as far as injuries and deaths. he said, "people pass and things happen at concerts, but something like that --." he also denied seeing any distress but said "anytime i could see anything like that, i did." 10 people were ultimately killed. scott is requesting his lawsuits be dismissed. reggie: a warning for people planning to travel to cancun, another shooting on the beach outside of a resort. this shooting happened tuesday. gunmen believed to be members of a drug cartel pulled up on the beach on jet skis and started shooting near the popular grand oasis hotel. american tort -- an american tourist was in his hotel room when he heard rounds of gunfire. >> it was a delayed reaction

from most of the people. i don't think they comprehended what was occurring. as soon as they figured it out, that is when it got chaotic. reggie: nobody was hurt. the gunmen got away. it was the third shooting at a cancun area beach in the past two months. the state department has issued a level three advisory encouraging americans to reconsider traveling to cancun. kumasi: and san jose, closing arguments in the elizabeth holmes trial will get underway. the defense rested its case. elizabeth holmes faces 11 counts of wire fraud and proceed to commit wire fraud. each count carries 220 years in prison. california lawmakers are working on a plan to make our state a six way for people seeking access to abortion. more than two dozen states plan to ban abortion if the u.s. supreme court ok's mississippi's

we are down 143 points. the s&p 500 closed 3%, just missing setting a new record high. today we are off so we will see if we rebound. kumasi: instagram's ceo is pledging the company will do more to protect young users. the ceo testified before a senate panel yesterday. they are facing scrutiny over the impact instagram has on young people. lawmakers asked about researchers -- about research showing teenagers are easily able to access accounts that sell drugs. >> i don't think you can take one or two examples and indicate that that is what happens in the platform broadly. kumasi: hours before the testimony, instagram allowed feet -- instagram announced features that will allow parents

to control how much time kids spend on the app. -- instagram says it instagram clear it is creating new options , not making everybody switch back to the chronological feed. the new options rollout early next year. reggie: officials in new zealand are looking to make smoking tobacco a thing of the past. the country announced a plan to raise the legal age to buy tobacco, making it so residents who are currently 14 years old will never be able to purchase it. this is part of new zealand's smoke-free 2025 action plan. according to the health minister, smoking is the leading cause of preventable death in the country. kumasi: twitter is testing a feature that would allow you to add content warning to photos and videos. it is a change to the all or none method. it allows you to flag a tweet
