the shooting happened on new year's eve at the sun valley mall in concord. cornell barnard spoke to people who ran and hid for cover. >> everybody is running out. reporter: chaos on new year's eve. gunfire sending shoppers running for cover. >> i heard the shot and at first i could not believe what i had heard. then people tried coming in and confirmed it. i stayed right where i was. cornell: one person was wounded. it began as a robbery around 3:30, but when someone tried to help the robbery victim, suspects opened fire. >> we tried to hide. cornell: he says he hid with a customer in the back of his perfume shop. >> when i went out of the shop i

saw the customer was helping the victims along with other people. cornell: the mall was evacuated. the suspects took off. the unidentified victim was taken to the medical center where they were in stable but critical condition. in 2021, concord police responded twice to the sun valley mall. two robberies in the spring and the fall. a smash and grab robbery last november inside a jewelry store. suspects smashing display cases with hammers. and last may a shooting left one man wounded. the shooter got away. police are not saying if the crimes could be related. in this robbery, authorities are asking for information and tips from the public. cornell barnard, abc 7 news. jobina: police are investigating a deadly shooting in the richmond district last night that happened near 3rd avenue and cornwall street. neighbors say that are struggling with increasing crime. >> you hear carjacking, car break in, theft.

jobina: now to the pandemic. the u.s. is facing its worst surge on record. more americans are testing positive daily than at any other point in this two-year pandemic. in new york state, infections reached an all-time high for the third straight day. their seven-day positivity rate is just shy of 20%, which is one in five tests coming back positive. global travel has also been impacted. 4200 flights have been canceled worldwide so far today because of omicron, staffing issues, and bad weather. many families in the bay area are struggling to get children tested for covid before they return to school on monday. testing appointments or rapid tests are hard to find. starting tomorrow, san francisco unified will offer mobile rapid testing at the district office on franklin street. school sites will also be testing students throughout next week. and if you want to find information on how to get a covid test, just go to

abc7news.com/coronavirus. moving onto the latest on a mural that has been vandalized in san francisco's castro district, honoring those whose lives were lost to the aids crisis. it has defaced by graffiti. this is not the first time it has happened to the 23-year-old mural. but this is different of the worst and most severe. the damage is expected to cost $50,000 to repair and restore, putting the future of the mural in jeopardy. it was originally funded by a grant from the san francisco arts commission. developing news from albuquerque, where 21 people have been rescued from a tram that got stuck in the air because of icy conditions. it was a 14 hour ordeal on board the tramway. frigid conditions disabled the gondola late last night over a mountainous area. the undersheriff for the local sheriff's office flew several missions to bring the stranded writers from a ridgetop back down to safety. >> he picked them up in his

helicopter, flew them back here to the ground where they were medically assessed. that process was repeated about nine flights to get everyone out. jobina: we are told everyone on board had blankets, water, and are in good condition. new details on that destructive colorado wildfire. three people are missing and presumed dead. two days after the fire, snow now cover destroyed homes and is complicating search efforts. elizabeth scholes he hears from people who lost their homes. reporter: residents getting their first looks at the destruction following devastating wildfire spread officials calling it the worst in state history. the home where he grew up, burned to the ground. >> it is just gone. reporter: the fires fueled by a combination of drought and high winds. >> the fire was moving basically at the same speed as the wind. reporter: those winds packing

jobina: a sizable crowd ushered in the new year along san francisco's waterfront despite the official show being canceled. my goodness. some revelers brought their own illegal fireworks, launching them right as the clock hit midnight. the city canceled their official fireworks display because of the open crown variant. on the roads, the highway patrol says they have already made 263 dui arrests, 8% higher than new year's eve last year. the chp will continue its maximum enforcement period through tomorrow night. the new year means new laws. california cities have more local control over how speed limits are set to it using an old rule that essentially caused speed limits to go up every few years. a new police decertification law

will present officers accused of law enforcement -- the minimum wage increases to $15 an hour for businesses with 26 or more employees. restaurants and bars can no longer deliver cocktails, but you can still get them to go that includes beer and wine, for five more years. under another new law, all california residents and businesses are required to separate food scraps from the rest of the trash. every city will have a different compost program and there is already one in san francisco. some garbage companies will provide separate bins, others will ask you to add food scraps to the greenways to been. -- green waste bin. violators could face fined up to $100 starting in 2024. those are just some of the new laws for california in 2022. you can find a full list on our website, abc7news.com.

a massive sewage spill has closed at least five beaches in southern california. about 7 million gallons of raw sewage has spilled into a flood control waterway in los angeles county since thursday afternoon. officials contained the spell yesterday, but they are still working to repair a sewer main that collapsed in carson. last summer several beaches were closed when 17 million gallons of raw sewage were discharged into santa monica bay from a treatment plant. supply chain issues are going to hit us hard in the while it. in the world's biggest furniture seller says it is going to hike prices. just how much we will have to pay. spencer: very cold weather is coming our way tonight. a freeze warning will be in effect for our inland valleys. i will give you a close-up look
