we have some news now on the last minute changes in the big adjustment for everybody. >> yes, even for us in the newsroom. one of the teachers unions called this an unavoidable hot mess. while many school districts have safety measures in place, testing or the lack of consistent testing has become the issue for schools and families. the spread shows us that we were caught offguard. >> the union representing teachers in san francisco told us one school so many educators out for the day, related to cases of the omicron variant. san francisco unified confirmed more than 600 educators called out sick. >> we have been filling some with substitutes, but we don't have enough substitutes. >> this parent picked up her daughter who came in contact with a student who was positive.

she told me her children safety is our priority, and every parent should be as responsible. the teachers union said they would meet tomorrow with school district officials to make more decisive measures to keep students and staff safe, including testing at all schools. at this point, only teachers are given a n95 masks. >> we still don't have an agreement from ask for the students. the only thing available to students is surgical masks. >> the union is trying to avoid a walkout, like in chicago, were teachers called the protocols lacking. >> we did receive the kids from late yesterday -- from the state late yesterday. we are working on those. >> san francisco unified has hired a company to help them distribute these kits to every

school. other districts are being asked to also distribute n95 masks to everyone in school. one teacher teacher teacher tear right before classes resumed. >> it is exhausting and scary. a lot of teachers feel like they would be the next one out, that it is cascading and moving quickly now. there is a lot of fear. >> the state shipped tests for san francisco schools, but there is an issue here that is being criticized by many, and that is testing at school districts is recommended, but it is not required. they encourage it, but again, they will let you in the building even if you have no test results. many colleges i know and also private schools will not let you in the building or will not let

you on campus unless you show the negative test. >> every institution has their own set of rules. it is hard to get your arms around this. so many teachers out, it's not like you have a huge surplus of substitutes. how sustainable is this going forward? >> it is not. san francisco, for example, there are only 200 subs in the entire district. people who are not in the classroom such as administrators , they are now having to teach. i asked how much longer how m go on. the districts are betting on what the health departments are telling him, that this will not last. -- spencer: -- them, that this search will not last. at this point, we are close to pressing the panic button. >> thank you. >> masking in schools will be a

this was absolute gridlock. that prompted authorities to issue a traffic alert. police arrived to help direct traffic. in hayward, some folks were waiting to get tested for at least two hours. they said it is worth it to protect the family. that testing site is run by a nonprofit an appointment to recommended. what should you do if you get covid? everything keeps changing. the newest cdc guidelines argue should isolate for five days. day zero is the date you should test positive or when symptoms started, whichever comes later. after five days of isolation, new covid test, positive, five more days, and if it's negative, you can endure isolation, but it is recommended you wear our mask any time you are around other people for the next five. kristen: a member of our our vaccine team joins us live now.

good to see you. let's start with the big news. california is extending the indoor mask requirement until at least february 15. did you think this is a good idea? will it make a difference? >> i think it will make a difference. we can confidently say if you are fully vaccinated, you are well protected against omicron. we need to learn what it would look like throughout january, and if masks are one way to slow the transmission, not stop, but slow it, keep the masks in place, the safest thing to do, especially with testing delays. kristen: i want to touch on revised cdc guidelines, five days, testing, isolating, for they come at first, no test, so to speak, whereas california did say, test on day five, if you're clear, clear next day, then you get out, in the meantime, bay area counties are taking

that sticking with the ten-day isolation policy. it is so confusing. what is your vice? >> don't feel alone. when in doubt, you have to take that extended time. the full 10 days, wear our mask, especially if you are returning to family and friends and going back to work. the issue with the cdc guidelines and i commend the california department of health as they did not include testing it also people had this assumption that if you're a simple medicament you are not with the virus, and we know there is a population who was still do that, and the majority, but you can, to be safe, but i have no symptoms, five days i'm good, the problem now with the wording is that if you want to take a test or have access, i don't see a lot of people following through. not only the lines, but some people thing i will not wait for seven hours. i don't have any symptoms so whatever. in those situations, keep the mask go the full 10 days. it is frustrating right now. kristen: it is.

i did hear what you were referring to, study that says on day five, 31% are still infectious, so really, if you don't test, that is a third of the people getting out mixing with the population. >> people must ask their selves that own question. 30% of people can still shed their virus, so are you comfortable with your high-risk, liquid someone, hanging out at work, like hey, i tested for positive, five days ago, i feel great. >> that is the answer. what's talk about boosters. today, we are getting close, waiting for cdc approval, but the fda saying let's get boosters for 12 to 15-year-olds and some people in the bay area super excited and can't wait make appointments, but then more than a third of those in that age group are still not getting their first shot. what does that mean for the boosters? where are we headed? >> it is an important statement that boosters are needed for

kristen: the alameda sheriff's office is now offering grief counseling is ordered after a recruit died tuesday. we have the latest on the investigation. >> flags are at half-staff of the fallen deputies. the flags were lowered to honor a recruit who died tuesday after being shot while heading home. >> a car struck the wall, andl,d the driver inside the vehicle was shot. >> chp said they thought it was a car crash, but once officers got to the car, they realized the recruit crash the car after being shot. first responders rushed him to the hospital, where he died. >> this was not as usual for t 172nd academy to come to work

when their fellow academy mate is no longer here. >> the recruit was expected to graduate in february. the sheriffs office said they canceled classes today and for the rest of the week and are offering counseling services to others in the class. >> we encouraged the recruits to talk about. get together, talk about. people have different ways of grieving, so we are letting that happen. there is no formal academy today. >> chp officials are leading the investigation and still looking for suspects. they are now asking for the public's help, specifically for people driving in that area and have cameras in their cars. >> review your footage and see if you notice anything in your video cameras that could help us with this case. >> chp is asking anyone with information to contact them as soon as possible. kristen: on midday

asked the oakland mayor for an update on the plan to install license plate readers. she said she had spoken with the governor about the plan. >> he has pledged to work with me in the state legislature. this would need to go through the budget process. he will announce his budget in a few days, but it is in a negotiation with the state legislators. larry: the -- kristen: the freeway shootings are not just an oakland problem. she is calling for the community to come together then the violence. larry: $1 billion is up for grabs in federal funding to help california homeowners who have fallen behind on their mortgage payments during the pandemic. >> every california homeowner eligible for more, which -- mortgage relief will have the chance to draw down those funds to save their home and keep their dreams alive. larry: applications are being accepted by the california

kristen: out to the latest in the conviction of elizabeth holmes. larry: she was found guilty on four counts. members of the jury are speaking to abc news. kristen: the reporter has delayed us. reporter: we are now getting a closer look into the deliberations of the trial of elizabeth holmes. jurors now revealing how the panel work together behind the scenes to reach their decision. juror number 11 system. >> we ended up using sheets to put our notes on and pasting them to the court room wall.

it was our war room. reporter: juror number telling abc news that three days into deliberations, jurors reached a decision on eight of the 11 counts, and spent the remaining four days deadlocked on the three accounts that were eventually declared a mistrial. they say they ranked witness credibility using stars. one witness testimony stood out from a former theranos board member, james mattis. >> it was four stars stars witnesses, especially general matters. reporter: as for the allegations that elizabeth holmes was abused by another person, claims denied, he says the jury else sympathetic to the claims, but avoided the subject because they did not think it was relevant to the charges. the two men say the jury

that would redefine what robbery and theft is. it would have to include possibly serious injury to be a felony. right now, that bill got sidelined because people were not ready to go further, that the pendulum swings and it is in the center now. what he says is needed is to start talking about this, to get this in front of lawmakers and possibly in front of voters. he is willing to work, change it, and does not think everything will go through the way he is expecting it. he says we have to start talking about this, because otherwise we will not go anyway. larry: this is clearly not imminent and would take a while. one of the problems is is is iss are becoming more sophisticated, particularly in the amounts they steal, working in groups, then distribute the stuff they stole, and it is very organized. >> it is. that is new.

we used to see the robberies would happen and they would sell them at flea markets and swap meets, but now there is the internet. you can sell it abroad. you can sell it anywhere. the seller can be anonymous. rather than stereo equipment, were seeing high-end clothing with video equipment, everything out there, so it will have to be not only the theft, but the supply chain that gets it to the people paying for it. it has to start somewhere. what he is saying is let's get it going, rather than pointing fingers and saying it is over here, but what about this and that? larry: we will see if it gets traction. thank you. kristen: we have an update to yesterday's deadly freeway shooting that claimed the life of a young recruit. he has been identified.

some doctors are looking at the risk for a double pandemic. it is exactly what it sounds like. having both together at once. cases have been detected in new york, houston, israel, philippines, in one case in los angeles as well. my worry is people might not think they have covid paired they might think they have the flu. it is confusing. >> it is. not a surprise. we dodged the flu bullet last year. this year may be something different. i think it goes back to getting vaccinated for the flu, getting vaccinated for coronavirus and doing everything you and protect yourself and each other. larry: i think we had a couple of years where you did not see a

if you consider your pets your children, the pope says no. you're wrong. pope francis a couples who choose to have pets instead of kids are selfish. he calls the decision a detriment to civilization and claims it leads to a loss of humanity. he is urging couples who can't have children to consider adoption. he has long been critical of humans prioritizing pets over children. he made similar comments in 2014. you want to jump in on this? you want to take on the pope? >> first of all, i would disagree with the pope and shaming people who decide not to have kids as being selfish. that is ridiculous. i would say pets are not children, that is true. we love our pets, but they are different than children. i do agree that if you can have
