east san jose. police say dems knew their attacker and gave investigators his name and car information. authorities found his car abandoned near highway 35, and before 5:00 a truck on the freeway hit and killed the suspect. >> the investigation is ongoing. we don't know what is obtained motivated this individual to commit these stabbings during the investigation. we were in the process of obtaining an arrest warrant for attempted murder for this incident. a tragic sequence of events. kristen: the stabbing victim faced moderate injuries. they're trying to terminate the suspect died by suicide. they received calls from drivers saying the man was jumping in front of cars, the driver who hit him could not confirm that, saying he appeared. the man's name has not been released. larry: a disturbing trend, an

increase in gun violence victims to levels we have not seen since 2016. kristen: the announcement comes days after a cuff -- a couple and their wedding drug avert the victims of an attempted robbery on their wedding day. melanie woodrow has the story. >> san francisco newlyweds who wanted to be proud of their wedding and share photos with family matters who could not be there due to covid are now terrified to show their faces captured on their special day. >> it is disappointing. >> they asked not to have their identity revealed after someone jumped out of their car and attempted to steal the camera at california and powell streets. photographer mendoza says he held onto the camera because the photos were not backed up and he had another camera previously stolen. >> looking back, i realize the danger, my life was at risk. >> he ended the couple hid in a nearby parking garage. >> we blame the criminal, but i

feel the city has gone to a horrible place. >> nothing is more important than to make sure the people who live in this city, who work in the city, who visit san francisco feel safe as they walked on the streets. >> today the san francisco mayor and the police chief announced the 2021 crime statistics for the city. homicides are up as our gun violence victims, which includes fatal and nonfatal incidents. >> that is the highest we have been since 2016. >> to confirm one of the suspects in the attempted robbery of mendoza reportedly had a gun. >> one of this -- us woke up as a grown man could have been a widower, it is beyond belief. >> assaults are up. >> we have to do more in our investigations to solve these. >> the police chief and mayor

emphasized the need for funding for officers, which mendoza wants too. >> more police presence in some of these iconic areas is important. >> the couple says they feel forever bonded having shared their happiest and possibly scariest moment of their lives with mendoza. larry: the first lawsuit against the city of san jose has been filed us than 24 hours after the city approved a controversial ordinance, a rule that requires good owners to buy liability insurance and pay a live -- pay an annual fee. zach went as -- zach the details. >> we promised if they passed this we would see them in court and last night, we did just that. we sued them. >> that following an hours long city council meeting last night approving a first of its kind ordinance in the country. in six months, gunowners will have to have liability insurance

and pay a fee of $25 that would go to a nonprofit, the money to be used for firearms safety training, suicide prevention, domestic violence prevention and more. >> the second amendment protects every citizen's right to own a gun. it is not require taxpayers to subsidize that right. >> our goal in this lawsuit is to make sure that this law does not go into effect. >> the attorney present in the gun rights group says criminals will not comply. >> it will be law-abiding citizens who deter crime by having weapons in their homes who are going to be the ones who bear the burden of this unconstitutional ordinance. >> san jose mayor responded to the group and lawsuit today with a law firm representing the city pro bono. he says criminal gun use is not the only focus of the law, citing studies that show high rates of suicide by gun and gun inflicted injuries. >> we are employing an approach that addresses the many forms of death and injury inflicted with

with fentanyl. today's effort to punish opioid drugmakers and getting help for people in addiction. california's attorney general announced that more than 400 cities and counties have signed onto a historic $26 billion settlement with the nation's three major forms suitable distributors and drugmaker johnson & johnson. this makes the cities and counties eligible for a share of the settlement money to go toward drug dependency recovery efforts. the companies have until february 25 to finalize the settlement. >> oakland unified school district has a preliminary list of schools it wants to close to cut costs and deal with a budget shortfall, but the list was not meant to be published. it was and now the district is facing parents and teachers of those schools. they are outraged. leanne melendez joining us live with more. >> many parents find out this afternoon that their child's school was on that list of possible closures.

that was a surprise to many and so was how quickly this process is going. there will be a final vote on february 8. >> mike hutchinson wants everyone to know that he is the one who released the list of schools that may end up closing. the oakland school board member first posted it on social media. >> i did not leak anything. this was not privileged or confidential. i did my job by reporting to my constituents and the community information i had received about their schools being under threat for closure. >> oakland superintendent set out a note stating that the information shared was from a draft. it is not the final set of recommendations. this is a map with the proposed closures for this year. among them, this elementary school. today the staff began determining flyers to parents interested in having a meeting on this possible closure. henderson, a grandmother, has

had a deep connection with the school. >> are losing not only of education, a support system, their friends, their teachers. this is all in one into service. >> the district needs two/$50 million from next year's budget, but hutchinson insists there is no budget deficit. >> what we are doing is going through a series of budget adjustments to free up more money to raise compensation for staff going forward. but we are not in budget crisis. we have money in our reserves. >> then the issue of declining enrollment, which affects the district did. before the schools in oakland it shut down because of the pandemic, the number of students enrolled as of march 13, 2020 was 35,904. at the beginning of this year, the recorded number on august 23, 2021 was 34,970. 904 -- 934 fewer students.

that is less money coming from the state per student. sarah teaches at this high school, also on the preliminary closure list. she says there should be community input. >> the final closure vote will happen february 8 and schools are not going to be notified there on that list until january 20. the whole thing is outrageous. >> another argument being made is that when you compare california's largest district, oakland has the highest ratio of schools to students. the district argues that keeping all of those schools open means they spend more money to maintain them. but let us put this in perspective. 20 years ago, oakland embraced public charter schools. more than any other district in california. i don't think anyone would argue that giving parents a choice also meant that traditional public schools have lost students. in the newsroom, we had

melendez, abc 7 news. kristen: i spoke with the superintendent of education of california about oakland and west contra costa school district the teachers on the cusp of possible strikes this week. >> people are raising real concerns about wanting access to covid mitigation measures. they are right to be concerned because when school opened in january, we saw some of the highest case rates. at the same time, i would acknowledge that we know many of our district in the bay area are doing everything they can to get those resources. if you look at a district like oakland where they said every student and staff person can have access to kn95s, before school opened in west contra costa i was in touch with the superintendent who were setting up over the weekend before school started days for families to get covid to contests. while these are public and it issues, our districts are doing everything they can. we want more than anything for

rate is at 18.7%. kristen: despite the good news about a possible omicron peak, hospital systems across the bay area are overwhelmed. icus in three-bagger area counties are -- three bay area counties are full. stephanie sierra has been crunching the numbers and joins us now. spencer: our dust sandhya: our dust stephanie:-- stephanie: our analysis showing this. these counties do not believe they have officially peaked from omicron just yet. preparing for the peak. the omicron peak. the signal some sense of normalcy lies ahead. san francisco, santa clara, karen counties heading in that direction. but most of the bay area has yet to reach that as icus continue develop. solano county health officer

says there have been more hospitalizations during omicron than any surge in the pandemic, but the icus are not as packed as previously seen in other waves. >> only about a third of them are being taken up by covid and during delta, it was half. stephanie: are you concerned it will get worse? >> i am. i don't think we are at the worst of it yet. stephanie: the abc 7 news i team's analysis found that this is one of five counties that all reported on average more than 80% of icu beds were occupied in mid-january. the rest of bay area counties fell below that, san francisco i-73, alameda 69%, sonoma 68% leaving marin with the lowest at 44%. >> the peak of our search is behind us. it is important to know that rates are still high and the

decline is not rapid. stephanie: the slow decline and recovery is expected across the bay area. >> the hospitals are certainly under strain. stephanie: hospital capacity in several counties like alameda or example continue drinking from early to mid january, partly because hospitalizations lagged behind several weeks. >> we are about at where we were at the peak of last winter's surge, but it has been more challenging given how much virus is around. stephanie: the infectious nature of the virus compounded with other illnesses is hitting hospitals hard. our analysis found about one third of the 61 hospitals across the bay are at least 90% full. >> every winter, hospitals are saturated and a lot of people are in the icu because of respiratory diseases in the winter. >> people showing up who had ano

larry: time for the four at 4:00. we begin with cryptocurrency and the value that is tanking. prices have plummeted, wiping out $1.34 trillion of value globally since reaching an all-time high in november. it is half of the total market according to coin market cap. one in six americans have invested or traded in crypto. the plunge comes when stocks are also down as investors brace for interest rate hikes coming this year. the popularity of crypto is supposed to be that it acts as a hedge against inflation, which we are experiencing now. but it is not hedging, it is plunging. bitcoin, the most popular crypto, was that 64 or $65,000 in november, it's now about 36,000. if you have been in crypto for a while, you go if 50% drops, it is wednesday. if you are banking on this, your

to talk about the impact of climate change. >> they are finicky because of the heat and the humidity. just like grapes. they will be ok because they are hardy, but other grapes will have a hard time. it is happening across the board , but this time we are focusing on coffee growers because of their finicky crops. it will hurt all of our crops. larry: do you think we will see massive migration? you are able to plan some things in certain areas and then you have to move it elsewhere. >> weather is the biggest determination of where people migrate, because of farm-based economies or pallets or tables. but as we are able to adapt and modify crops, we will not see it take place as much. but in countries that are less advanced than ours, you will see that migration happened. they have to move to where they can plant food and live.
