than it does with your guilt or innocence. >> we talk about justice, we preach justice, but as a nation we don't practice it on death row. reporter: governor newsom placed a moratorium on executions. >> i don't support the death penalty and never have. reporter: he's moving to dismantle the death row by moving inmates to other prisons. >> the voters of the state of california have advanced the principle of requiring that population to do work they have not been able to do in the current facility. we are in the process of pushing the population out of the row -- the physical death row -- and moving a number of people safely and very thoughtfully, there is a judicious process in the general population. reporter: in 1993, his 12-year-old daughter was kidnapped during a slumber party at her home and killed. her perpetrator remains on death row. >> these individuals are segregated for a very good purpose. they are among the most dangerous people in our society.

chief delivered a message directly to his firefighters monday morning, as he announced 47-year-old fire captain mr. max fortuna was shot and killed while on duty. 21 year veteran was a husband and father to two grown children. a procession took place as his body was moved from the hospital to the san joaquin county sheriff's department. firefighters, carrying his flag draped casket inside. >> he every day and never complained about being on the job. reporter: it was just before 5 a.m. when firefighters responded to a dumpster fire close to a building at washington and aurora streets. officials were trying to put the fire out and shots were fired. >> we have multiple gunshots to the back door. we have one hit. reporter: stockton police responded and took a 67-year-old man into custody. they also recovered a firearm at the scene. investigators have not released details about what led up to the shooting. but robert sommerville iii

says his dad is the man police have in custody. he believes this was all a terrible accident. >> first i want to say my condolences to the firefighter's family -- i cannot even -- i would not even want to be in the situation right now. reporter: he says his father uses the building for a variety of things but mainly to build food trucks. he says he works late hours and many times falls asleep at the shop. the warehouse so large, he says that is impossible to hear someone knock on the door. he thinks his father may have been startled awake and was trying to protect himself. >> it is my understanding my father thought someone was breaking in. reporter: we reached out to the police department to see if the suspect they have in custody will be arrested, if so what charges they will be looked on. officials are still working with the da to make that determination. jessica harrington, abc7 news. dan: police released a video of

a deadly shooting at a sfo when officers responded to a report of a suspicious man at the airport. nelson is seen on video wandering the international terminal what up -- carrying what appeared to be two handguns and a knife. investigators later revealed the guns were replicas. the video shows him talking with officers, trying to get them to drop the weapons. nelson apologized, that he raised one of the guns toward the officers. one officer shot him and he fell. while on the ground, police that he reached again for a gun, and he was shot and killed. ama: happening tonight, winds, expected to pack up and an advisory is going into effect. dan: let's go to sandy patel. meteorologist: as we look at the view from our camera, you can see it is calm, but that is going to change come early tomorrow morning. right now, windsor 23 mph on mount diablo.

of emergency medicine at the busiest hospital in san francisco about what they are experiencing now. reporter: it is a significant downfall according to the latest data. covid cases are down by 50%. 10% down and hospitalizations --in hospitalizations. this doctor is citing omicron has turned the corner in san francisco. >> in a room of 20 people in san francisco today, there is probably a 30%-50% chance one of the people has covid. reporter: from inside the hospital, we spoke to the two chiefs of the busiest emergency departments in san francisco. dr. raven is finally seeing a drop. >> three weeks ago i think we were in the 140's. today we are in the 90's. that is a significant drop in hospitalizations. but it's still more than we would like to see. reporter: at zuckerberg san francisco general hospital, dr.

caldwell is reporting a peak in cases, admitting 10 to 15 patients per day in the last two weeks. >> we are in a similar boat then we have been for the last 10 days to two weeks. we are in the mid 50's and above in terms of patients in the hospital. reporter: both ers are noticing a trend of those who are coming in with covid now. >> higher's risk are in those who are unvaccinated and then those vaccinated with the initial schedule but did not get boosted. reporter: even with all this, we had to ask -- >> are you feeling hopeful? >> i am feeling hopeful. we haven't seen the impact in the hospitals in. i believe there is that light at the end of the tunnel. reporter: the doctor believes we will be closer to an endemic in the next four weeks. >> i'm pretty comfortable predicting that will be where we go. and that puts us at least an original endemic state. meaning that is not dominating people's lives.

reporter: hospitalizations historically like behind case counts by a week or two. that's why emergency medicine doctors believe we are not out of the woods yet. ama: today marks two years since the very first case of covid was detected and -- in santa clara county. officials say the county is now in a more hopeful place. reporter: it's been two years to the day since the first covid case was reported in santa clara county. the county has since documented over 275,000 cases of covid, 2000 have died. now in the midst of the omicron wave, santa clara account public health officer dr. sarah cody says we are on our way out of it. >> just under 12% of those who we tested our positive. down from 17%. which is good. our case rate is about half of what it was at the peak. reporter: she points to better

knowledge and preventing covid, vaccinations, boosters, more testing, and new drugs on the horizon to help treat covid. a main focus of the news conference today was the two-year anniversary, for the county also announced a revision to the former president obama testing order, echoing what they said three weeks ago, the county says it is still giving out a disproportionate amount of covid tests compared to large health-care providers. may offer kaiser, stanford, and other foundations give a covid test within 24 hours to patients who had covid symptoms were in close contact. if they can, they have to let the county know about it. health-care providers can offer antigen test in addition to the pcr tests to satisfy the requirement. >> they cannot refer the patient to a different hud scale -- different health care provider or county run testing facility. reporter: a doctor says we are at a better place and we were two years ago today, but we still have to be ready for what she calls. peaks and valleys.

dan: a man is accused of killing a woman and teenage son. police responded to a house on lemon tree way on saturday after a call from a concerned neighbor in antioch. inside the home, they found a 15-year-old boy and a 30-year-old woman dead with severe trauma wounds. >> the male suspect and the female victim were in a dating

relationship and were originally from georgia. the suspect had outstanding warrants in georgia for domestic violence against the female victim. reporter: dan: dan: a redwood police officer spotted the suspect a day later at a train station in redwood city and took him into custody. ama: two recent assaults are prompting a warning for hikers . police are misleading assaults that took place on trails in the st. joseph hill open space preserve. the first attack happened january 13th. police say a man armed with a knife threatened an attacked to people on the jones trail. saturday, a man with a similar description attacked a hiker from behind. police are urging hikers to remain vigilant and carry a cell phone. dan: the effort to find a young woman missing from oakley is expanding. the 24-year-old was last seen thursday taking her brother home from school. her disappearance is suspicious because her car was abandoned in an area she is unfamiliar with. the keys were still in the

ignition. a group today posted and handed out flyers. her family says it is obviously taking on an emotional toll. >> you feel guilt to be like -- to do anything else or to think about anything else. just because we don't know what happened to her. we have to look at where she could be. reporter: relatives say she recently finished a program for medical assistance. she wanted to pursue a career in nursing. they've started a facebook group to find her. it is called "help help bring alexis gabe home." ama: optimism for the year ahead as people get ready to bring in the new -- the lunar new ye i'm greg, i'm 68 years old. i do motivational speaking in addition to the substitute teaching. i honestly feel that that's my calling-- to give back to younger people. i think most adults will start realizing that they don't recall things as quickly as they used to or they don't remember things as vividly as they once did.

madden, who died last month at age 85. today the nfl announced the event will be held on monday february 14 at the oakland coliseum. a day earlier than first announced. the event is being labeled as one more monday night football event at the coliseum. his teams posted the best monday night record during the 1970's. losing only once in 13 games. tickets will go on sale later this week. the proceeds go to the madden foundation to benefit educational opportunities for oakland children. dan: still ahead, hearing from the 49ers one day after the nfc championship loss. chris
