building a better bay area moving forward finding solutions. this is abc 7 news. hi there. i'm kristen z. you're watching getting answers. live on abc 7 hulu live and wherever you stream celebrate the lunar new year with a hands-on learning experience. we're talking to the oakland museum of california about how you can bring in the year of the tiger in person or virtually also we're speaking to the family of a missing oakley woman nine days after her disappearance. they're sharing the latest in the effort to find the nursing school graduates, but first even as san francisco struggles with a sharp increase in violent attacks and property crimes the public rift between san francisco's police chief and district attorney is growing even wider this week police. chief bill scott terminated his

department's mou memorandum of understanding with the da's office. basically, it was a deal for the da to investigate police shootings deaths and police custody. other incidents in which police conduct is called into question. everybody who has anything to do with this mlu and impacts of it all depend on this being a fair system that we all have confidence in. that's what this is about. all right. well now in response a new exclusive interview with dhsa boudin it was conducted by our media partner the san francisco standard which shares abc 7's mission to build a better bay area. our departments have to function as a team if we're going to keep san francisco safe, and we're doing our best to do that in very difficult circumstances. there are lots of people out there who would love to see us fighting and pointing the finger at each other and refusing to work together. san francisco deserves better and they're going to get better for me. all right. well, san francisco may deserve better, but this certainly is a

lot of finger pointing on both sides reporter. michael barba joins us live to talk about his conversation with chase. abudin michael. thanks for joining us. thank you for having me before we get into what boudin told you explain to our viewers what triggered this deals off from the police right with? you it has to do with the trial of police officer starting next week. tell us about it. yeah, that's right. so basically in advance of this. starting next week a defense attorney for the officer filed a motion seeking to dismiss the case and she's alleging that there was misconduct by the district attorney's office. she says that she felt pressured to withhold evidence in the case and that revelation really troubled police. chief bill scott who went ahead and pulled the department out. this long-standing agreement with the district attorney's office. all right, but what is the reality here? i mean, it can't just be a he

said he said with regard to whether a da investigator. actually withheld evidence did the judge weigh in on this? the judge did way in on this. i believe that she said that she didn't see the exculpatory value in the evidence. meaning that she didn't see. how this evidence being withheld impact. the case at hand, but that's kind of a different question as to whether or not the district attorney's office is violating this you that it has with the police department? all right. this puts a very bright spotlight on a riff that's been growing between the police department which investigates crimes and the da's office which prosecutes crimes those of us who grew up watching law and order are familiar with those two working hand in hand, right? it's quite the opposite here why it really is i mean ever since the da has taken office, you know, this is a very progressive district attorney, but even then he and the police chief has have really tried to show that they are united front.

you know, they they appeared in this psa together where they basically we are working in lockstep shoulder to shoulder hand in hand. and i think really what we saw this week. is that relationship really just kind of falling apart publicly or at least it's giving us a lot more reason. question whether or not they're working as closely together as they say i've said they are previously. look as more big cities have elected progressive das this kind of dynamic has been playing out. but is there another big city where it's this intense? i mean san francisco unique in that regard. you know, there's a lot of progressive prosecutors who have been elected across the nation. i don't think this is unique to san francisco. i also don't necessarily think that the rift between da boudin and chief scott is unique to them previously in san francisco. we've seen da's and police chiefs quarrel over issues and

disagreements. i think that just this week though. it was particularly intense in a way that we quite seen before what did boudin tell you in that interview in terms of? how he views the timing of the announcement what da boudin told me is that he doesn't think it's a coincidence that this announcement came just you know, right before this trial is about to begin in court. i mean, this is the first time that he's about to put a san francisco police. are on trial he's charged several but none of those cases have gone to trial before and we finally have one starting next. week so he doesn't think it's it's coincidental that that came up. and he's questioning whether or not the chief is really politicizing the issues that he has with the agreement between the two departments when you listen to boudin and scott you hear scott saying boudin is not prosecuting the cases that police hand them boudin says police are the ones who are not

solving crimes or making arrests and that is prosecution rate is actually quite high. does the data that you've seen show i mean, you know or is maybe the lack of independently compiled data part of the problem the muddiness? i think it's been really hard to assess the situation right now in part because of the pandemic you have to remember that district attorney boudin came into office, you know, right when the pandemic was was hitting so it's really hard to compare his tenure with the 10 years of district attorneys before him because he's making charging decisions at a very different time that said, i mean you can compare his his charging data to other count. in and we haven't really quite seen that analysis done yet because there hasn't been so much time that he's been off if you look at the last few ten years or the last few days. does he mark a very dramatic shift from his predecessor?

i mean susie loftus was briefly in that role that the mayor temporarily appointed her to but when you look at george gaston, you know how big of a difference is there? i think that him and district attorney george gaskone really see eye to eye on a lot of stuff a lot of issues and gaston has gone on to become a reform prosecutor in los angeles. in the same way that jason boudin is presenting himself here in san francisco. i think the the big difference really though is you've seen the da's office under boudin a kind of a complete turnover, and there's a lot more former public defenders. now who are working as lion prosecutors in the office. that is very true. look. okay. so if this mou is ended what does that mean? because internal affairs used to investigate central police misconduct from within right? so does it go back to that?

what this mou was really doing was it was outlining the free flow of information between the district attorney's office and the police department and it was talking about the criminal investigations in particular. so the investigations into whether or not the officers who used force violated the law by using force my understanding is that those investigations will still go on. it's really just a question of who is the see who's going to be taking the lead on that whether or not the district attorney's office will still be notified immediately after a police shooting incurs whether or not they'll be able to have the lead on interviews with officers who were involved in these cases. so there's still a lot of open questions. we don't have all the answers. we do know that the police department has said they asked the california department of justice to potentially step in or explore other alternatives for who can do these independent.

investigations and we will have to see where that goes. so rob bonta's office would potentially be the one to step in. okay. um, look, why should the public be concerned that there is this huge split between the police and the da's office and i'm looking at city with rising crime you know, i think it's it's really just these are the two law enforcement officials that are charged with keeping san francisco safe, and there's a lot of fear out there right now about and it doesn't look good to have the two officials fighting when you really want them to be comforting san francisco and and letting them know that they're doing everything they can to keep the city safe and to reduce crime and punish people who are committing them did boudin say anything to you that indicated that he might be extending and all of branch that there is a way that he and police chiefs god could work together. i believe that the da's office e

enlisting more eyes and ears maybe triggering somebody's have something they saw maybe generate new leads, but please let me know if you know i ask you a question that you can't or don't. you talk about we definitely respect that, but i know it's been day 9 anything. knew that gives you some hope something to work with. now huge support from the police. department and that's that's all. that's all we can work off of. yeah, there's seemingly very little out there, but take us. a day one when and where was the last time that you or another family member saw alexis? we were actually on facetime with her and around like 4:30. and she it was just a normal day. she just dropped my little brother at school. asked me to pick up a package from the post office and that

was in and she told me that she wanted to meet up. come pick it up. that's awesome. when did you realize she was not home? that's something was amiss. the next morning when my little brother texted me and asked me if if i knew where she was and then i thought it was just normal. i thought she was just had a friend's house love late and then on our way back. then my parents started calling me and my cousins. what my dad called me on. and told me it was something more serious. yeah. formula volatility support. what about her phone? have you tried calling? does she have her phone on her? we have no idea when we when all of us try to call it and text it. calls would go straight to voicemail. text will just go unnoticed

answer is that unusual for her? very unusual because she always has her phone on her 24/7 right and she didn't say anything about where she might be planning to go any suggestion of something specific you can hang your hat on or give you something to work off of nothing. no from last i've heard from everyone else they the last thing they told them all of her friends was there they were coming to see me or she was coming to see me and she told me she was gonna come see me and that's yeah, okay, obviously that didn't happen, but i know you've searched and i know you found her car right tell me about where that was and and you know, what you found in there. well, we found found found found best friend's house in oakley. um when we found it, i saw the

keys were installing ignition and my cousin opened the door and the car door was unlocked. first and then my parents got there in the first thing they asked me to do was to open the trunk so i opened the chocolate there was nothing there but first of her belongings was in there. no purse no phone. no, purse no phone. um, wow. okay. what was she wearing when she went missing? a white tank top a a a hoodie black jeans and black and white and green jordans can hopefully folks are listening and of course we have that. station on our website. did you search a room? is there anything that you notice was missing? just her purse that we can. find that's it. the jacket that you usually u wears that's mine. i saw it in her car so she

switched jackets. something else's population police have not named a person of interest or suspect that's important. to point out but antioch police did search for ex-boyfriends home in antioch, and they took some items. did he the ex-boyfriend tell you whether he has seen alexis? around this time um from what he told us he saw her. last night and oh oh oh saying something different? that wednesday night and he said she left his house at around 9 pm. all right. there's a lot for investigators to sort through but you as family i know you're just trying to get our case out there her face out there. you have billboards up you have flyers out there. what else is? upcoming search that people can take part in or is there some other way for folks to help?

tuesday, but the lunar new year celebration lasts two full weeks, and it's a wonderful time. engage in and appreciate some cultural activities for the family joining us now from the oakland museum of california. omca is linda john director of learning experience and programs linda. how are you doing? happy new year. hi kristen. i'm doing great. happy lunar new year to you as well indeed. now. i know omca has been celebrating lunar new year for 21 years, right? that's correct. so tomorrow will be our 21st annual lunar new year celebrations. we've been doing this for a really long time and excited to be able to be a place for people gather for the first time in this capacity in over two years. all right, so you didn't do it last year, but your big event is tomorrow and it's going to be in person right? tell us about it. what will visitors cn do? yeah, so it's gonna be at the

oakland museum, which is right next to lake merritt. it will be a very family-friendly celebration with activities that are great for all audiences. so children adults millennials elders, the programs are really designed to you for all audiences. you can expect oliver chin beloved storytime teller, he will be here doing readings of his new book. you're the tiger as well as promoting his new graphic novel series called awesome asian-americans. we're hosting the toy sean benevolent association lion dancers who are going to put on a 30-minute dance performance kind of weaving their way around the museum getting people excited for year of the tiger. we also have an amazing vietnamese musician called meningo who will be sharing traditional vietnamese music with the community. and we are also having a gamalon group perform and that will

include seeing and dancing and the lastly we've got a lot of programs going on but in response to the violence against asian americans that we've seen in the last couple of years during the pandemic we're holding space for a healing circle for the community to kind of get together and connect and reflect and show solidarity with one another. yeah that healing circle is on tuesday. right, is that correct? yeah. okay, so we have an in-person one tomorrow live and then we have a zoom healing circle tuesday from 6:30 to 7:30 pm. i see. alright, that is very meaningful because you know, we have seen more attacks on asian americans recently, but anti-asian sentiments have really been a part of california history. so it's good for people to learn the history. and of course part of doing that is to partake in cultural celebrations and learning more about other cultures and hist so i want to ask you i saw a lot of pictures of arts and crafts activities. i know those were from a couple
