we spoke to city officials about what needs to change. >> a safety alert following a pair of assaults on a popular hiking trail. >> one county is relaxing its vaccine mandate for gyms in restaurants. how some local venues are responding. >> warm weather, temperatures coming up. abc news at 11:00 starts right now. >> building a better bay area moving forward, finding solutions, this is abc 7 news. >> and man is dead after being shot on northbound interstate 880. the stretch of freeway was shut down while investigators scoured the lanes for evidence. there are still more questions than answers. good evening. ama: abc 7 news reporter luz pena joins us live to create local leaders are demanding change as the number of recent freeway shootings continues to climb. >> this is a fatal highway shooting, the fifth in the last nine months in oakland.

the four previous shootings remain unsolved. chp is investigating the case, but has not given any information about what may have let up to the shooting or any possible suspects. this is the second fatal highway shooting of the year in oakland. the incident was first reported to be a fatal collision. >> the driver is unresponsive. >> around 5:45 p.m., shutdown northbound interstate 880 diverting traffic at oak street. >> it is unacceptable. any homicide, any violent crime is unacceptable. >> in the last nine months, there have been five fatal highway shootings on and freeways. last may, two people were killed on a party bus on 580. in october, jasper was killed on i-8 80. an antioch woman was killed on i-8 80. an alameda county sheriff's

recruit was shot and killed on i-5. 80 now another person shot and killed on the 880 freeway. oakland councilmember calling for change. >> we need to step up our efforts and work with, have our police departments along the 880 corridor work with chp to track down. >>, contra costa county was facing about 115 shootings in a 13 month period. hercules city councilmember dan romero was the first city leader to search for solutions and push for highway cameras. he is suggesting the same for oakland. >> three people have to die on interstate 880 to take action. the request to the state of california, department of transportation. we have the state sitting on $40 billion of reserves. >> the freeways are the responsibility of the california state transportation agency. >> if the state government wants

to put certain kinds of surveillance cameras on our state highways and they are shown to be something that could help solve violent crimes, that is fine, we should try it out and see how it works. >> last month, governor newsom spoke about his plan to crack down on gun violence. he said his office is continuing to review tools that could help chp officers like highway cameras. in the newsroom, luz pena. ama: we sent this push alert on our mobile app and we confirmed this incident was a shooting. if you want breaking news alerts in the future, download the app. dan: people in contra costa county won't have to whip out their vaccine card is often. as of today, the county is relaxing its requirement to show proof of vaccination in some indoor settings, like gyms and restaurants. tim johns has reactions from businesses in walnut creek. >> contra costa county took a step back toward normal.

the county health department announcing places like restaurants and bars would no longer have to require proof of vaccination from customers in order to be inside. >> none of these health orders were ever meant to be permanent. these were temporary measures for public health measures to protect people's health. >> the order had been in place since last september, but the county says it feels comfortable allowing the new rules thanks to declining case numbers and vaccination rates topping 80%. >> i think if you are a diner going to a restaurant in contra costa county, you can feel pretty safe that the person or the people sitting next to you are also vaccinated. >> the relaxation takes effect immediately and some restaurants tell us they are happy. one of those is an restaurant in walnut creek. >> i feel like i have to check everyone, which i really did not like to do, but i still had to do that. >> others are happy to see the

requirements go and comforted by the high level of vaccination in the community. >> it makes us feel more safer, it makes us work up to 100% to what we can do. >> some diners still with mixed feelings, believed to be moving in the right direction, but remaining cautious. >> i want to be safe, i want to have a good time, i want all of these people to have a good time, but i don't want to get sick. >> in contra costa county, tim johns. dan: some of the other key covid headlines, sonoma county is lifting its ban on large gatherings next thursday. the health director says there are clear signs we have moved past the winter surge, with cases and hospitalizations declining. the cpc has given formal approval to moderna's covid-19 vaccine. until now, it was only allowed under emergency use authorization. the pandemics u.s. death toll topped 900,000 people according to an analysis of the data by johns hopkins university. ama: hundreds of people took

part in a rally and march as part of a last-minute push to prevent the closure and merger of more than a dozen oakland schools. ♪ through the week with students, teachers, and parents taking to the streets. a report found 15,000 students have left the district or moved out of the city in the past 20 years. the drop means oakland loses out on millions of dollars in state funding. another reason for the proposal is the school district is saddled with the cost of maintaining 80 schools. some parents think there has to be a better way of closing schools and merging them. >> you cannot balance the budget on the backs of schools, especially schools with stable populations, and happy kids that are performing well. >> the school board is expected to vote on the proposal when it meets tuesday. >> the west contra costa unified

school district has reached an agreement with its teachers union on some covid safety measures. the new deal voted on by union members will have the district providing kn95 masks daily for all students and staff. weekly testing will be conducted at all school sites, twice weekly testing for all classes if there is one positive covid case. baseline testing will be conducted after february break and spring break and the district also agreed to an increase in pay for substitutes and villains. -- fill ins. ama: let's get to sandhya patel for how warm it is going to be. sandhya: it sounds so strange. warm and winter. it is going to be, but not tonight. it is chilly. temperatures have fallen into the 30's and 40's for many areas. tomorrow morning, it will feel like winter. it was a beach day. santa cruz, this was the view this afternoon. you will see views like this

assault suspect at large. >> defin defin attention and i definitely had a thought of should we go on this hike, but i looked around, there were still people. >> there have been two recent attacks along walking trails in the area. the first happened on january 13. a man armed with a knife threatened and attacked two people in of the jones trail. this past saturday at about 5:10 p.m., and man with a similar description attacked a hiker from behind on the manzanita trail. >> i could see were there could be some issues because parts of this trailer pretty remote. >> on friday, we spotted many hikers and a regional open space ranger parked along the walking trail, a welcome sight for those wanting to get outdoors after working from home. >> this is a safe place to just exercise, work from home, get out of the house, and the fact that people are still doing bad things is very alarming. >> among the list of tips from

ama: new developments following a deadly police shooting in minneapolis. you may find this video upsetting. body camera footage captured the incident as officers found a man under a blanket on a couch with a gun in his hand. seconds later, an officer open fire after police say he pointed the gun at officers. police were investigating a homicide, but he was not named in the warrant. his family said he has no criminal record and legally owned the handgun. his mother is demanding justice. >> i want the police officer that murdered my son to be prosecuted and fired. ama: the case is drawing comparisons to the breonna taylor case. she was shot and killed in louisville as police served a no-knock warrant in 2020. dan: the man accused of assaulting a 49ers fan at the

nfc championship is free on bond one day after his arrest. today, the inglewood mayor identify the suspect is 33-year-old brian alexis of los angeles. his arrest came after police traced a vehicle. the fight happened during a tailgate party last sunday. daniel luna from oakland was wearing a white jersey and the suspect was in a yellow jersey. >> the individual in the white jersey pushes the individual in the yellow jersey. the individual in the yellow jersey pushes the individual in the white jersey and then strikes him once in the face area. the individual in the white jersey falls backwards, hits his head on the pavement, does not move after that. >> luna remains in a medically induced coma,'s family says they are grateful and arrest was made. the suspect's mother said her son acted in self-defense and

urged people not to rush to judgment. >> new details about the couple and their dog snowbound in a remote cabin in sierra county for nearly two months. this is video from a chp helicopter sent into rescue them. they tried to get out on their own, but all the snow made it impossible. >> between the cabin and getting out, there were areas that were probably 6, 8, 10 feet of snow on the roadway. ama: they finally decided to call the sheriff's office, hiking in our to find a spot with self-service. >> they were starting to get critically low on food and they thought they better start getting an exit plan to make it out. before things got dire. ama: thankfully, they did make it out. the couple was in good spirits and did not need medical attention after the rescue. dan: what a story. in the east bay, here is some great news. a beloved berkeley breakfast spot betty's oceanview diner is

going to reopen. it will reopen by the end of the month under new ownership, but with the same menu and employees. it will also have a slight name change and go by oceanview diner. the previous owner announced the restaurant was closing after nearly 40 years because of a variety of reasons. the new ownership group plans on turning the restaurant into a co-op. ama: if you plan on buying flowers for a special someone this valentine's day, order early. supply chain issues have caused a global shortage of fresh flowers. the problem is related to disruptions to air shipments, labor shortages, and the high demand holiday. >> one airline cancels and then whoever is behind it got the pressure to pick up what is behind. >> if you are looking for something super specific, you might not be able to get it. the earlier you can order, the better. ama: you can expect to pay more. two dozen long stem roses are going for as much as $250 at
