> the statewide mask mandate set to expire soon but will masks still be required in the bay area? >> two fishermen rescued. the whereabouts of a third still unknown. sandhya: rising temperatures and possible records. abc 7 news at 11:00 starts right now. >> building a better bay area, finding solutions. this is abc 7 news. dan: one week from tomorrow, more californians will be able to go maskless indoors. governor newsom announcing today the statewide mask mandate will be ending february 15, but what will that mean for the bay area? counties still have to decide whether they will follow the state's lead. we shall see.

thank you for joining us. ama: ryan curry got in touch with local health officers tonight and has more details. ryan: california is set to drop its mask mandate. governor newsom tweeted the medical expire next week. he mentioned cases are down and hospitalizations are stable. >> the bay area is looking good in all metrics. cases are down by more than 60% in the last two weeks. hospitalizations are down which is probably the most important metric. ryan: dr. peter chin-hong says the state is in a mess better spot now -- a much better spot now. >> there are vaccines, boosters and natural immunity together which makes a large force field. ryan: but it is possible masks will still be required in parts of the bay area. as the statewide mandate expires, counties can have mandates of their own. all bay area counties other than

marin have a mandate right now. we asked if they will go along with the state's lead. san francisco, alameda and contra costa say they will evaluate cases locally. >> we are still waiting to hear from other counties about their plans, but some businesses are hoping they just follow the state. >> it causes a lot of frustration, and then try to police it, it is impossible. ryan: adam owns a gym in sonoma. the health officer told the press democrat they are still discussing whether to keep their mandate but he thinks it is time to let it expire. he thinks it will help his business and others recover faster. >> by lifting that mandate, when normalcy will finally return, i'm sure that the demographic that we have lost over the last two years will slowly return. ama: and taking a look at other covid headlines. multiple states are easing mask mandates.

now in effect. anyone five years and older needs to be vaccinated to go inside any locations including restaurants, bars and gym. all workers have to show they are boosted. california's covid sick leave law is back. workers will receive up to two weeks of paid sick leave. it expires at the end of september. dan: holding candles, law stood in the rain on the capitol steps tonight holding a moment of silence for those more than 900,000 people who have died in the u.s. so far from covid-19. the united states hit the milestone on friday as we reported at the time, less than two months after hitting 800,000 deaths because of the virus. if you want to stay up-to-date on the latest covid headlines, we have information on our website, including a place where

you can ask your questions. ama: new details about a story we first brought u.s. breaking news on abc 7 news. a fishermen is still missing after he and two others were slept into the ocean near the mere bish outlook -- muir beach outlook. j.r. stone has more. j.r.: you are looking at sky seven video showing one of two fishermen being rescued from the rocks along the water at the beach overlook. a third fishermen, a cousin, was swept into the ocean and has not been found. >> the waves just grabbed him and swallowed him. j.r.: he was one of the two rescued in this area. the three had been fishing on the rocks monday afternoon when the waves intensified. he described the moment his cousin jose was struggling in the water and then the moments afterwards when he threw off his clothing and jumped into try to save him.

>> he was asking help me, help me. the waves were insanely big and pulling me down as well. i was swallowing a lot of water. i had to save myself. i let him go. >> the coast guard, national park service and numerous local agencies have been looking but have had no luck in finding jose. >> water temperatures and stuff like that, if you don't have a rescue within the first half-hour, you are not going to have one. j.r.: family members holding out hope. jose's fiancee could be seen standing with park rangers into the evening in hopes of promising news. >> it was really cold. trust me, it was really cold. at that point, i was trying to save my cousin than the water. i tried but there was nothing more i could have done. j.r.: family members say they will be back out here come tuesday morning.

the fiancee tells me she understands they were fishing in a dangerous location and is hopeful going forward people do their best to stay out of on save situations. j.r. stone, abc 7 news. dan: oi dramatic video shows a n crashing a stolen san jose police suv into another suv this afternoon. >> oh! bro! dan: this afternoon right in front of the regional medical center, we are told a man was a patient at the hospital and got into a fight with security. an officer got out of the suv to chase him. the suspect managed to slip into the vehicle and drive off. the man recounted what happened. he was stopped at traffic at the time. >> i was trying to figure out why these cars were not going. sure enough, i see two cop cars coming the opposite direction. i just start recording and i see

this cop doing doughnuts swerving. what the heck? dan: two officers suffered minor injuries and the suspect was taken into custody. ama: things will be heating up this week so let's get to sandhya patel with more on this unseasonably warm weather. sandhya: even the trees are confused. we will be confused. i will show you why. we have this area of high pressure that is a strong ridge, the storm track is nowhere near the bay area. we have an excessive heat watch wednesday through friday for southern california. in the bay area, as you take a look at the temperatures, it is going to be warm for winter tomorrow. 76 in santa rosa. 15 degrees above the average of 61. san jose, 10 degrees above. redwood city, 10 degrees higher than you should be. i will be back to let you know exactly how long this warmth will last coming up. dan: thanks.

developing news, a school district vote is set for tomorrow on whether to close, merge or shrink 18 oakland schools to close a budget gap. a small group of students were kept out of school and parents say they will do the same thing the entire week. parents hope it gets the attention of administrators because the absences will cost the district state funding. it is not slated to close, but sixth through eighth grade would move to another school. >> i am really upset they are trying to close all these schools. we are trying to make oakland great. why are they going against us? dan: the principal did notipal d return our call for comment. this is one of several actions happening around oakland, including some walkouts and a hunger strike. ama: a bay area family's plea for help gets a response. only abc 7 shows you the case

dan: justice for jaxon. that is a rallying cry for a family grieving the loss of their son for more than two years now. they allege his death was not

properly investigated because he was asian and gay. ama: thousands of people including a state senator or on investigators to do more. dion lim has the story. >> jaxon was very much the vibrant jokester. a little mischievous but always with a big heart and empathy. dion: it is the love of life that according to jim sales make it so hard to comprehend their son is no longer in this world. >> i was just so proud to see him and the man he was growing into being. dion: jaxon was found dead in a san francisco apartment on march 2, 2020. he met a man on a dating app and there were drugs in his system. sfpd released a statement showing there were no signs of foul play. the sales family alleges they were kept in the dark. >> we spent the first year trying to get reports. we got the final report of what happened to our son in november

2020. dion: they believe their son's case was dismissed as an accidental overdose because of his sexual orientation. >> he is asian, gay. when i heard the medical examiner tell me the gay community always uses ghb, very dismissive. dion: this is a complicated case, but this is not a story about the drugs found in his system or the circumstances of where he was found. it is about a family's fight for fairness in the community rallying behind them. the family's chang petition has more than 40,000 signatures. senator scott weiner also wrote this letter asking for sfpd and the m.e.'s support. >> we need to make sure that the community has trust in our government, including the police, medical examiner.

parents shouldn't have to speculate about what happened to their child that has died. dion: no matter the outcome, the family hopes one thing, that his legacy will set an example for others. >> regardless of sexual orientation, he should have an equal investigation as anyone else. dion: and inspire other families of children in the lgbtq community to have a voice. dion lim, abc 7 news. ama: a man is under arrest accused of multiple stocking intalking incidents. on january 29, three female students reported being followed by a gray honda civic as they walked home. the women saw the same car circling the neighborhood and called police. when officers spoke to the suspect, a 26-year-old, he reportedly told them the area was full of women who want him. detectives learned of similar incidents in oakland that

happened in september of last year. in one instance, a woman was reportedly groped. dan: at a hearing today in the scott peterson trial, a juror at the center of his misconduct claims will be granted immunity. the juror is supposed to testify on february 25. if you takes the fifth amendment, the district attorney is prepared to grant herd immunity. peterson's lawyers say that the juror lighted during his selection process when she claims she never been the victim of a crime or involved in a lawsuit. ama: the justice department may be open to allowing so-called safe injection sites where people can openly use drugs. it was evaluating such facilities and talking to regulators. this is a change in stans from the trump administration under which prosecutor successfully fought against a plan to open a safe injection site in philadelphia. the san francisco mayor began the process of possibly opening two sites.

advocates hailed the safe havens as a way to curb overdose deaths. dan: we learned about the first gop candidate who will run against governor newsom this year. the chronicle reports republican state senator brian dolly will announce his candidacy for governor tomorrow. he was first elected to the assembly in 2012 in a heavily republican district which includes reading and grass valley. before that, he served on the glass in county board of supervisors for 16 years. the gubernatorial primary is scheduled for june 7. ama: if you want to lose weight, maybe hit the snooze on your alarm. researchers at the university of chicago took a group of young overweight adults who typically slept less than 6.5 hours and have them sleep two hours more each night. after two weeks, many of those who got the extra sleep decreased their calorie intake by an average of 270 calories and up to 500 calories a day. researchers say eating 270 fewer calories daily would result in the loss of 26 pounds over three

spring outside so why not? dan: it all ties together. sandhya: it really does not feel like february. it is more like april or may. i want to show you what you can expect this week. rising temperatures. yes, it is winter but we are talking about increased fire danger. record temperatures possible wednesday through friday and areas of moderate air quality. why are we seeing this high pressure build in? we are seeing the flow around the high pressure coming off the land, blowing towards the ocean. when you get that offshore flow, the down sloping wind, it tends to warm us up. take a look at the winds. they will be ramping up not so much tomorrow but getting gusty wednesday afternoon into thursday. when you get those gusty, dry offshore winds along with the lack of rain, you have the fire danger going up. i want to show you what it will look like.

the highest fire danger right now for tuesday night is in the yellows and oranges. you will notice it is parts of the east bay and santa cruz mountains going into wednesday. not strong wind, just a drying wind. you can see back toward san francisco. warmer days the rest of the work week. records possible wednesday through friday and it will be breezy in the hills with increased fire concern. a lovely view of san francisco. air quality will be good to moderate tuesday and wednesday. winds begin to pick up. i do want to show you the temperature trend -- it is not showing you so we will skip that. it will be well above average. we will show you the pollen count. high for tuesday, juniper, ash, cedar and pine -- it will be moderate. if you suffer from allergies, tree pollen is your biggest nemesis right now. 40's, 50's on the temperatures right now.

tomorrow morning dropping into the 30's to low 50's. some patches of fog, although not expecting the thick fog and widespread fog along the coast. south bay temperatures, san jose, 72. it is going to be a mild to warm one. 71 in redwood city. downtown san francisco, upper 60's. north bay, 76 in santa rosa. 71 in san rafael. in the east bay in oakland, it will be warm for this time of year. 70, walnut creek. i want to show you what is ahead. one computer model is hinting perhaps mid february, we might just see some showers. the other computer model is dry. warming trend for tuesday. that warmth pushes temperatures into the possibility of record territory as we head towards thursday. 80's inland. upper 70's friday. as we go into the weekend, the heat will back off.
