stored d.n.a. from every rape kit collected is routine practice. it has been happening since 2016 if not earlier. this is a statewide problem. but his office could only point to one specific case. >> district attorney chasa budine alleging that they are accessing rape kit d.n.a. and using it to identify suspects in other unrelated crimes. >> our conversation with the crime lab suggest that this is a routine practice not only in san francisco but in other crime labs across the state. >> d.a. cited one specific case. based on her d.n.a. collected in a rape exam follow ago domestic violence incident. >> were you first made aware of this? >> last week.

d.n.a. can be used for purposes unrelated to the investigation and prosecution of sexual assault. >> the d.a. made it clear this is a statewide problem adding he doesn't know how many thousands of cases may be implicated. yet, his office was only able to reference one case. >> the d.a. has dropped it dismissing the charges. chief scott told us the department's d.n.a. collection policies have been legally vetted and adhere with state and national forensic standards. but added police have immediately began reviewing the policies and are in talks with the city attorney about how to move forward. live in the newsroom, stephanie sierra, abc7 news. >> this announcement comes at a tense time between the police and the d.a.'s office. a lot of friction there struggling to move forward. they don't have a memorandum or an agreement where they can move in lockstep. have they indicated they're going to work together? and if so how will they do that? >> yes, it really is a tense time.

but chief scott pointed out, whatever disagreements he has with the d.a. are set aside from this issue. they both agree that if this practice is happening it needs be addressed. and the chief says it needs to end. as far as what's happening now, sfpd chief -- assistant chief are reviewing the matter and they tell us they're going to corporate the d.a.'s office. we'll see what happens. larry: steph, thank you. >> now to latest covid-19 developments. the c.d.c. said that omicron now account for 100% of new cases in the u.s. >> the pace of americans getting booster shots has reached a new low. and that's really a concern for health officials. 64% of the population is fully vaccinated. but 50% of people eligible for the booster have not gotten one. >> here in california, today's seven-day positivity rate is now down to 5.7%. >> starting tomorrow, 8-9 bay

area counties will lift their mask mandate. tim johns looks at how both business owners and customers feel about taking off the mask after nearly two years. tim: after two years of masking, masks are finally coming off starting wednesday. >> i don't think we're quite over it yet but it's a great first step. >> lori thomas is the director of the golden gate restaurant association. she expects to have a varying array of masking policies. >> always a mask with you because i know different places will require them even to enter where you think no, there isn't. >> and several business owners say they're happy to let their customers take the lead. >> i think a lot of us are strung out with the whole mask thing at this point. >> not enforcing it on their own but encouraging their shoppers

first, it does depend where you live in california. same goes for businesses. they can make their own rules when it comes for safety for employees. so whether you're going to the grocery store or you're headed to your office, you might industrial to wear a mask. it doesn't matter if you're vaccinated or not, you have to wear it on a bus, a train or in an airport. also if you go inside a hospital or any healthcare facility. and you'll have to put this on inside prisons, homeless shelters and in place that is provide childcare. what about kids? unvaccinated kids older than 2 will still need to wear a mask indoors. and that brings us to the hot topic of schools. they still have to wear them. but at the end of the month, it could change. and it is important to know the state still strongly recommends you wear that mask when possible

changing of mission requirements to better reflect national demographics. >> these things are important. but when you're facing this urgent crisis they're not what you should be fest focusing on. you don't get a second chance to do third grade. if you don't read well, you fall behind. you're much more at risk for dropping out. >> my issue with the way this began is from parent who is didn't have a connection to san francisco. they were fairly new to the city. >> gabriella lopez is the board president. there are seven members but only three can be recalled at this time. she's one of them. >> i also stand by not being able to reopen schools when we want in a tier that it was safe to do so and teachers didn't have access to 2 vaccine. >> lopez along with colleagues, allison collins and foana have delayed back to in-person learning saying reopening has been priority number one but has to be done safely and

considering race is a major factor. >> i live and work in communit communities who were suffering throughout the pandemic, who had the least resources, who were the most impacted, who were genuinely living for their life. >> all of us are met with this challenge of insuring that our schools provide a high quality education to students regardless of their skin tone, regardless of their zip code and regardless of their parents' education level. >> many parents are on the board side. >> number one, i do not subscribe to cancel culture and that's exactly what this is. >> number two, this is an expensive distraction that dilute and pollutes any and all efforts to provide an equitable and fair education to black students. what do you say to parent who is say my kid can't learn at home. why wasn't that number one priority by far? >> your kid can't learn in a coffin either. >> there are many people who live in single family homes who live with multiple generations.

and when we think about that, and we think about how maybe loved ones could have died from this virus, the board did the right thing. >> for these parents the recall may be between like-minded liberals but they say it's been exploited by forces outside their district. >> look at who's blind this recall, there are billionaire who is don't have children in our school or children period that want to buy our school board and take away our voices. >> local, the offices are a pipeline to political power, right? controlling that and having people that are aligned with you and will vote the way you want them to vote, you know, you're basically able to buy public policy >> this could be the first political blood that's drawn because it's a recall elections because california has the abilities to recall public officials than in most other states. you also have real world consequencesments >> you have to look at it and what tease right thing to do for our kids right now?
