but when in doubt still wear a mask dr. patel says these new cdc metrics factor in the notion that we will not get to zero covid cases. they look at risk factors and how to protect those who are at most risk from the virus. san francisco. mayor london breeds said today. she's looking forward to actually seeing people's faces. once again. i think we all are she spoke about the possibility of the masked mandate being lifted in. francisco and said she believes that looser restrictions are coming and soon i would love to do it right away. i am seeing faces. i know the kids are. having real challenging time in school and definitely. i want to see them take their mask off and i'm trying to respect and support our public health officials and the data and what they say, but i think they're getting very close to making that change. everyone must still wear a mask in schools and hospitals. san francisco's current mandate, however, masks are no longer required indoors at restaurants gyms or offices if a person is

vaccinated dramatic day in court as a juror from scott peterson's murder trial was called to testify rachelle nice finds herself at the center of peterson's appeal at his quest to get his murder conviction tossed out abc 7 news reporter. zach fuentes spent the day in court joining us live now from redwood city zach. yeah, larry court wrapped up just under an hour ago and rochelle nice. who was this at the center of this is going to be continuing her testimony on monday now, it's important to note that if it's found that she did lie in any way to get on the jury. she's not going to be in trouble. she has been immunity, but it could lead to scott peterson being given a new trial now. we were here as rachelle nice arrived in court today. the judge did not allow still photographers or sketch artists to show her in the courtroom, but we were here this morning as she came now peterson was present as were some family members of his in laci peterson scott peterson's lawyers main objective is to prove that he did not get a fair trial because rachelle nice who was on the jury how the secret bias against

him in that she lied on her jury questionnaire to get on the jury now in her testimony today. she was questioned as why she didn't disclose in the air that she had gotten a restraining order while she was pregnant back in 2000. she said at the time she filed it that she really fears for her unborn child. now. she also pushed back against court documents saying that her live-in boyfriend at the time had assaulted her while she was pregnant instead. she said that it was her who hit that live-in boyfriend legal analyst stephen clark weighed in on what went on in the hearing today. it's clearly and it defendant is entitled to 12 impartial jurors, not 11. and so yes, i think this is going exact. the way the defense wants it to go. and not only was nice question about pastor straining order. she was also questioned about her financial history of fellow juror could testify that nice and hurt that juror had discussed that she was having financial problems and joked about a book deal and possible movie deals. now again, rochelle nice is going to be continuing her

testimony on monday at 10:15 that morning. i did talk with her attorney outside of the courtroom. he said that he's not going to say anything until she has finished that testimony scott peterson's attorney. they also did not want to comment and redwood city zach fuentes abc 7 news. q dozens of volunteers showed up today to search for alexis gabe. she's the oakley woman who vanished at the end of january abc 7ews reporurt u members whog for answers. i am super grateful and overwhelmed with all the support. gabe says the past few weeks have been some of the toughest of his life. we're trying to get back into our normal schedule a little bit though. it's still tough. but now the search for his sister is getting help from the community on friday dozens of volunteers came to antioch to search various abandoned fields. it's really a joint effort and just increases the manpower that is really necessary for on the ground surgeons. gabe has been missing since late january her family found her car abandoned on a residential

street several weeks ago. the family says gabe's ex-boyfriend was with her the night. she went missing officers searched the ex-boyfriend's home gave is still missing and police have not made any arrests. it's a big world out there. she's a small woman and it's a matter of eliminating various areas so we can then moved on to someplace else mark class and his foundation are coordinating the search he founded it in 1994 after his 12 year old daughter polly was kidnapped in killed class says team spread out to different areas. hoping to anything related to alexis gabe the clothing that she was wearing perhaps a telephone just anything that mike point us in a better direction. his goal is to help the gabe family, which is something the family says it is needed throughout this process. of course, we want to continue working on this 24/7 but the community tells us to go get some sleep go spend time with each other go, you know distract ourselves. the search for lexus gabe is

scheduled to continue throughout the weekend the family hopes to find something related to the case before sunday is over and anyone interested in helping out should come to the contra costa fairgrounds on the weekend in antioch, ryan curry abc 7 news. investigators in san francisco are trying to determine the of a fire that killed one person this morning at fire broke out an apartment building at buchanan and turk streets at about seven o'clock three adults and a baby escaped the burning building, but all four had to be taken to the hospital for treatment one of those victims did not survive. the city of oakland's calling it a major step forward in the effort to try to prevent illegal dumping 10 new high quality surveillance cameras. now up and operating in locations that have been identified as illegal dumping hot spots officials. say the footage captured by these cameras will be used to build cases against offenders with fines up to thousand dollars we are going to do more to enforce our laws against illegal dumping by getting to

the source making sure that we are holding accountable those repeat offenders who are trashing our neighborhoods. illegal dumping has long been a problem in oakland and it's only gotten worse in recent years. an analysis by the chronicle last year found that enough garbage was dumped in oakland to cover 13 football fields with trash three feet high. california senator alex padilla announced new legislation today to address the affordable housing and homelessness crises in california and the nation padilla says the housing for all active 2022 would invest in what he calls proven solutions to address the shortage of affordable housing and provide funding for existing programs to reduce homelessness. according to padilla. there's a shortage of nearly 7 million affordable housing units in the us recess has been moved indoors. at the east oakland pride elementary school. that's because a city's sewage pipeline that runs under the play yard has again, a sewage

has been bubbling up to the yard as a result sky 7 giving us a look at that situation a school district. spokesperson says the city needs to dig up the yard to access and repair the damaged line. some parents are keeping their kids home until the repairs are done in part because of the foul smell this line ruptured earlier this month as well. all right, checking out the weather now as we head into the weekend chilly this morning with some spots down in the 20s, but mike getting warmer still no rain, but you know, it could be a nice weekend right definitely going to be a nice weekend one day a little brighter than the other and a little bit warmer and no more record lows after this morning. here's potential record lows. can't call them official yet until the reporting stations turn in their data to the national weather service, and then they verify but these are the coldest temperatures i found in livermore napa in santa rosa. which would tie or set some new record low temperatures and it would be the third consecutive day. still haven't broken through that barrier still staying above 40 degrees.

we were 41 this morning from what i could tell in san francisco 42 tomorrow and then those temperatures jumping back into the upper 40s as we head through the weekend now in the afternoon hours. we're starting to feel the influence of those warmer mornings. you can see temperatures jumping a little bit above average sunday monday tuesday in san francisco and even more so as you get into some of the valleys like the south bay look at this low to mid a 70 sunday monday and tuesday. the sharp decline wednesday into thursday. that's our next chance of wet weather and they'll have that coming up in the accuweather seven day forecast larry. all right, mike see you in a few minutes with that dna evidence shows the south lake tahoe bear that everybody's calling hank. the tank is actually not alone, california department official wildlife now says new evidence shows. there are actually three bears. in fact, there could be more than three that are invading. homes in that area hank was thought to have damaged more than two dozen homes in the tahoe keys neighborhood. apparently, he's got friends out there with them fish and

black history month. we're focusing on bay area businesses that are doing to make a difference in the community and for black lives today. we're introducing you to the rise up bakery that's rethinking of san francisco staple sourdough bread and giving back one loaf at a time. sourdough is or could be is very small. i'm putting a lot of thought and high-end ingredients and i'm really working on trying to take care of people like i want to make the best most beautiful bread that i can so that that's the new idea of what bread should be. the pandemic was i was an aspiring chef i had worked at several different restaurants

and then once the pandemic kind of put on the lockdown. then we spent a lot of time at home and then i started baking trying to get your loaves to pop or to rise. is actually hard and so the day that i happen to crack that code i happen to be listening to hamilton musical in the background when you live in on your knees, you gotta rise up and i was like, oh that's i would be an awesome name for what i'm doing like rise up and it fit on so many different levels because in the song it's saying, you know, if you're being oppressed you got to rise up you got to speak up and there was all this stuff going on in the world and i was the same time working really really hard to make my bread. so it just it kind of all came together time and love is going into every loaf the logo is i wanted it to feel like what resistance means to me which is everyone standing at me saying we're not going to take this anymore. you know the status quo is an okay anymore. we need to make a change and that comes from people and bread

feeds the masses. so i just took those two things and put it together. this is my resistance. this is my rise up. this is my stand up and make something for the people by the people. this is something i can be a part of where i can make a change. i am a strong believer that that we should take care of one another and so i started program with rise up called the pay it forward there were times when i was young where i was homeless where we were homeless as a family and the only way we got by was on the kindness of others. and so i wanted to incorporate that into a monthly daily occurrence with what use my hands to do which is feed people and so i worked to put something up on my site where people could purchase a loaf for themselves and purchase a loaf to be paid forward and when i would get 60 80 100 of them, i would you know, make beautiful high-end high quality organic bread and i

would go deliver it to homeless shelters or to feed the elderly. so i basically keep track of that and give people an opportunity where if they want to make a difference. they can make a difference with me through me for the greater. good. i've been a guy who kind of swims upstream. you know, i'm too big to do this. i'm too tall to do that. i'm not the right color to do this. so starting this became away from me to express myself. i've never seen a black baker in my entire life. there are certain things that people don't equate with blackness. it's like oh if you're black you don't do this or oh, you know, our black if you do that and i've never really fit into any box anyway. but i definitely wanted people to see me as this is what i am and this is what i do. i will set a good example for other young black men and women i could be that too. i never thought i could ever be this. i never even looked to.

widespread enough that the weather service kept the frost advis. freeze warning going but if you live in one of those cold areas, you know what to do tonight the weekend. clouds, but that's on the back of some. former temperatures at night and also during the afternoon hours and then we've got that chance of rain next week and highs are going to take a real roller coaster ride from the beginning of the week to the end of the week right now if you're stepping out in san francisco. it's about 52 in the sunset. that's as cool as it gets the financial if you're about to leave work about 58 degrees. we've got temperatures are 63 right now. insanely, andrew, palo alto santa clara pleasanton is 62 58 right now in american canyon and coma the cool spot is about 53 degrees and all this is showing our warming trend is definitely taking off. we're up to seven degrees warmer than this time yesterday, but if you're heading out this evening, this is going to cool quickly already by six o'clock in the 40s at the coast mid-50s for the rest of us sun sets and under this clean. calm air we're down into the 40s everywhere by eight o'clock and mid-40s by nine o'clock. so if you're having people over

the 4-4 and we start with some history president biden announced judge. catanji brown jackson as his choice to replace stephen breyer on the supreme court. if confirmed she would become the first black woman to sit on the high court jackson is currently on an appellate court in washington dc this fulfills one of president biden's campaign promises. he had said he would nominate a black woman because it was long overdue it.
