-- of san francisco settled in a separate lawsuit for $7,000. >> we give these men and women a baton and tell them they can use it to protect themselves against assaulted people. -- assaultive people. reporter: activists believe excessive force was used and are upset there were no black jurors. they say the not guilty verdicts are not a total loss here. >> as long as her district attorney keeps the faith and continues to keep the pressure on. officers will hesitate in being abusive. knowing they could possibly also go to trial. reporter: the district attorney says his office will continue to fight to make sure all communities are safe. stangl's lawyer now questioning how this case even made it in front of a judge. >> it feels great to have officer stangl vindicated in this way.

i would like to say we shouldn't be surprised when a police officer goes and does exactly what he has been trying to do. reporter: i was told that the da was not available for an interview. the das office has not said if that fourth charge will be refiled. the office will only say they will be back in court at 9:00 tuesday. stangl's lawyer did not comment on what is next for her client. dan: today, san francisco stat,a senator introduced registers -- regulation. the legislation comes after the san francisco da's office accuse the police department of using dna collected from right victims to investigate other crimes. this bill would make that practice illegal and prohibit victims dna from being placed in any searchable database. san francisco police chief says he fully supports this proposal.

santa clara counties district attorney reassured victims it has never misused their dna. >> we want to protect victims of sexual assault, not collect evidence from them they can be used against them later. we haven't and will never do that. dan: tomorrow the santa clara county board of supervisors will ask for an extensive report on its crime lab's policies regarding survivors dna samples. ama: for the third time in five days, a driver has hit a pedestrian in san jose. today's crash happened at capital expressway and story road. the pedestrian is hospitalized but stable. officers don't know yet whether that person was in a marked crosswalk. the driver stayed on scene and is cooperating. the two other pedestrians hit in the past week survive. one of the as is -- incidence was a hit-and-run. dan: helping news, ukrainian officials are claiming to russian planes shot down over capital.
