welcome to the next level. ♪ ♪ moving forward, finding solutions, this is abc 7 news. this is abc 7 news. >> new details tonight about a man who disarmed a gunman and was shot by a san jose police officer. this happened at a san jose taco shop. the lawyer spoke with us tonight. thank you for joining us. i am dan ashley. ama: and i am ama daetz. j.r. stone has more. j.r.: behalf tuesday night before the officer fired shots at this taqueria. >> he got the gun away from the

gunman who we only know had intent to use that gun against other people in the restaurant. j.r.: pointer says that his client was eating at la victoria taqueria early sunday. he was approached and threatened by someone who was part of a group. a brawl broke out. surveillance video released by police shows the mallett -- mele. officers responding did not know that. they arrived and green had the gun in his hand. >> the individual does not drop the gun and one officer shot more than one time, striking the individual. j.r.: the police chief says that officers had been searching for a homicide suspect in a case a few hundred feet away. commands were clearly given to green but he did not drop the gun.

pointer says witness videos show a different story. >> the officers were walking up the stairs, my client is backing out, you hear them yell something, and within a second, there are guns shots. j.r.: green was shot in the abs, leg, and arm, and pointer says they plan on filing a lawsuit here and put the case in front of a jury. in san jose, j.r. stone, abc 7 news. dan: california's first in the nation reparations task force decided this evening of who should be eligible to receive compensation. this task force was created with the mission of documenting historical harms and determining what reparations for black americans should look like. tim johns is in the newsroom

tonight. tim: this was supposed to happen last month but was delayed until today to allow for more discussion. there is still no compensation plan in place. >> the motion carries. the committee of eligibility will be based by lineage determined by an individual being an african-american dissented from the child of an enslaved person or a free black person living in the united states prior to the end of the 19th century. tim: the vote came after a marathon debate and after the commission narrowly rejected a proposal that would have included all black americans in the state. those that weighed in via public comment were split. >> the hurt, harm, and damage that was done through the holocaust of enslavement and

american apartheid has left long-lasting effects on african-americans. >> if you do not choose lineage based reparations, you're continuing to silence the voices of my ancestors. >> this suggests no accountability for the disparages of black life in america. tim: there is still a lot of work to be done. the task force continues to meet tomorrow. they can meet to discuss how the law needs to be ready by july of next year. ama: thank you. president biden signed the emmett till anti-lynching act which makes lynching a federal hate crime. the act was named after the black teenager who was killed

and inspired this antilynching movement. congress passed the bill this month after 200 previous attempts at antilynching legislation failed. when it comes to issues of race and social justice, check out our list of resources of how to find your ally. dan: the cdc announced today that the omicron subvariant known as ba.2 is now the dominant covid variant in the united states. by the end of last week, ba.2 accounted for 55% of all cases. it is believed to be 30% more contagious than the original omicron variant. however experts say that there is no evidence that it evades protection from vaccines. ama: americans 50 years and older are now able to get a second booster shot. abc news reporter reena roy tells us more people can become

eligible for a second booster as early as next week. reporter: americans over 50 can now get a second booster shot with the fda authorizing the fourth dose tuesday morning. cdc also signing off. >> the fda believes this option will save more lives. reporter: federal health officials are offering this fourth shot but not formally recommending it, instead leaving it up to people to make their own decisions based on health, risk, and age. >> it is important to have a conversation with your medical provider to understand this. reporter: for those who got a johnson & johnson booster, they say you can get a pfizer or moderna boast -- booster five months after that dose. next week the fda will consider

a second booster shot for all americans and a potential variant specific booster, though experts say that most of vaccinated people are still well protected. the seven-day covid death average in the u.s. now at its lowest since august, with just below 700 virus related deaths reported each day. but some areas are seeing the rise in covid cases with ba.2 now estimated to be the dominant variant across the country. in new england, ba.2 is believed to be responsible for more than 70% of new cases. on the west coast, about 60%. those numbers are probably much higher with new cases being undercounted. federal health officials say reported test numbers have dropped 75% since the beginning of the year. dan: a fairfax home is a total ruin after collapsing overnight

on a steep hillside. fortunately no one was inside when this happened. the home's foundation was undergoing affairs when the retaining wall above the house failed. >> there was excavation that was taking place underneath the house and several retaining walls were undermined and collapsed and the house fell over. >> the folks who owned this property were thinking of selling and my realtor walked me through and it wasn't the house for me and i am glad i didn't buy it at the time. dan: the recent rain may have played a role. crews are trying to decide if or when they can reopen it to traffic. >> i know she is going through a lot of trauma. ama: holding out hope for happier days. a bay area family details the struggle to adopt a ukrainian child during wartime. dan: and allegedly stocker of the apple ceo promising to stay

her adoptive dad flew to germany to see her and hugged her. there is now more red tape. the family's emotional story. reporter: ukrainian orphan sveta only eight years old when she first met the callahan family. >> chris turns to me and goes, what have you done? just right away, she is just a spitfire. reporter: they started the international adoption process. there was a pandemic, and then good news as 2022 donned. >> we were approved and we were excited for an hour. and then we got word that russia had pulled their people out of the ukrainian embassy and we both thought, this is not good.

what is happening? and then it went downhill from there. reporter: the orphanage director loaded 130 children on a school buses and they got them out of ukraine on february 25, sveta among them. >> it was probably some of the worst weeks of my life, wondering where this girl was. reporter: she ended up at a hostel in germany. chris callahan got on the first flight he could find and went to the compound. he was in tears when he saw her. it was sveta's 11th birthday. >> we have a child of ours fleeing a country under war now and now we get to physically see her and see her safe. it was comfort.

reporter: he stayed for three weeks but with the ukrainian government freezing adoptions, he came home to california without her. was it hard to say goodbye to her? >> terrible. it was really hard to leave. >> i know she is going through a lot of trauma. it is a helpless feeling. reporter: they are now lobbying the state department along with 200 other families to get special u.s. visas for the children to stay with their adoptive families temporarily and then must get ukrainian approval. meanwhile, they talk to sveta every day. >> every day we call she asks if she could see her room, and we show her that all of her things are still there. we will get her here. reporter: leslie brinkley, abc 7 news. dan: a virginia woman accused of

stocking apple's ceo has agreed to a new restraining order. the company was granted a temporary restraining order after she showed a erratic and bizarre behavior. court papers included emails allegedly sent to cook with a pistol and ammo. the agreement prohibits her from contacting cook or any apple employee. ama: san francisco's mayor is back from trying to woo european tourists. mayor london breed visited the london -- united kingdom, france, and germany on the trip. during the trip, she met with a journalist in an effort to get the word out about san francisco but at times, safety came up. it is something she talked about in a medium post. >> we put the message of how

the bay bridge where our forecast futures will have clouds overnight. there might be a few damp spots in the roadways on the morning commute. we expect a mix of sun and clouds tomorrow. here's the overnight forecast. we will see lots of clouds passing over but lots of clearing skies as well. down on the surface, lots of fog will be developing. maybe even a patch or two of spotty drizzle inland as well, so watch out for the possibility of what pavement on the roadways tomorrow morning. here's the view of overnight temperatures, mainly in the upper 40's. temperatures tomorrow will range from the 50's to the low 50's tim -- to the low 60's and that is inland as well. generally 56 degrees will be the

average high in the area. we talk about the big warm up coming our way and there it is on thursday. look at friday and saturday they had we will see low to mid 70's right along the bay shoreline but the coastline will not warm up much at all. on sunday every location cools down a few degrees but temperatures rebound on monday and by tuesday, high temperatures are back to near 80 degrees in our inland areas. almost summerlike warmth coming our way.
