after wednesday's peace talks, russia said it will cut back military activity in the direction of kyiv and the northern city of chernihiv to increase mutual trust, but hours later more explosions. >> we've heard the repeated sound of artillery slamming into kyiv's suburbs. remember, russia has specifically not agreed to a cease-fire, so there's every chance they'll continue to bombard ukraine. >> reporter: the state department believes russia's plan to cut back is not a withdrawal plan but rather a repositioning. president biden also casting doubt on russia's statements. >> we'll see. i don't read anything into it until i see what their actions are. >> reporter: it comes amid new bloodshed in southern ukraine. at least 12 people were killed after officials say a russian missile hit this government building in mykolaiv. the regional governor says he overslept, otherwise he would have been up side the building at work. in the port city of mariupol,

new satellite images reveal the extent of the devastation including apartment building after apartment building destroyed and long lines forming outside a grocery store, people desperate for supplies. as for the peace talks, a russian negotiator acknowledged there's still a long way to go before reaching any deal with ukraine. andrew. >> all right, em, thank you. also in washington the family of a former u.s. marine who is being detained in russia plans to protest outside the white house today. trevor reed has been in russian custody since august. his parents fear he's contracted tuberculosis. they say president biden hasn't made good on a promise to meet with them in person. families of those killed in the sandy hook elementary school shooting rejected a settlement offer from radio host alex jones. jones offered to pay $120,000 per plaintiff to settle a lawsuit stemming from his claim that the shooting never happened. jones has been found liable for damages and faces a trial to determine how much he should pay.

the victims' families called jones' offer a desperate attempt to escape a public reckoning. 20 first graders and six staff members died in that shooting. the motion picture academy released a new statement on will smith's slap at the oscars. the acis promising to take appropriate action and says it's outraged by smith's actions. abc's derricke dennis has the latest. >> reporter: this morning, new indications will smith may face consequences for slapping chris rock at the oscars. >> oh, wow. >> reporter: today the board of governors for the academy of motion picture arts and sciences is expected to hold an emergency meeting where it will likely decide on whether to punish smith. >> nobody is okay with what happened. nobody, nobody, nobody. >> reporter: whoopi goldberg is on the board. she says she does not believe smith's oscar should be taken away from him, but on "the view" yesterday goldberg suggested smith does need to be punished. >> there are consequences. there are big consequences. >> there has to be. >> reporter: comedy legend

surge in the future. that will have real protective effect to those most vulnerable to severe illness and death. >> the cdc says adults who got the johnson & johnson vaccine and its boozer can now get pfizer and moderna boosters as long as it's been four months since their last shot. meanwhile, 21 states are now suing the biden administration to end the mask mandate on public transportation. the states claim the mandate exceeds the cdc's authority. the committee investigating the attack on the u.s. capitol is looking into a seven-hour gap in the white house phone logs that day. abc's jonathan karl reports calls through the white house ae nn, ard including one from but that was before the seven-hour gap. >> reporter: as for why those calls are not officially reflected in the record, we don't know for sure, but while president he was known to frequently make calls using a personal unofficial cell phone and also took calls that came in on the phones of his top aides.

the federal trade commission is suing intuit, the company behind turbo tax. at issue is the company's claim to offer free tax preparation products. the ftc calls that claim misleading because most people are not able to use the free products being offered. intuit says its products have helped taxpayers and have always complied with requirements. now to the growing show of support for a nurse convicted in her patient's death. some health care workers say the verdict in this case is causing them to rethink their job because they say one wrong mistake could now lead to prison time. this morning, a new push to grant a tennessee nurse clemency as she faces prison time for a mistake that killed her patient. a jury found radonda vaught guilty of criminally negligent homicide for giving a fatal dose of the wrong medication to 75-year-old charlene murphy back in 2017. vaught reported the error and expressed remorse at her trial, but prosecutors argued vaught violated the standard of care expected of nurses. >> for me personally, it doesn't

matter. but to the community of nurses, it matters a lot. >> reporter: many medical professionals say the guilty verdict sets a dangerous precedent by criminalizing a medical mistake. the american nurses association says it's deeply distressed, adding it's completely unrealistic to think mistakes won't occur in health care. one nurse supporting vaught at the courthouse did not want her face shown on camera. >> i'm terrified that now i'm in a profession where, god forbid, i do make a mistake. >> reporter: the district attorney's office insists the verdict was not an indictment against the medical profession but rather the gross negligence shown by the nurse. but more than 100,000 people have now signed a petition calling for clemency for vaught. the family of her patient, charlene murphy, has not commented on the verdict but vaught says she recently saw murphy's grandson. >> he had the kindest things to say to me and about his grandmother, and he told me just to take care of myself.
