sacramento mass shooting. one just got out of prison. >> following the mass shooting in sacramento, local leaders gathering in san francisco to call for an end to gun violence. sandhya: temperatures rising, records falling. abc7news at 11:00 starts now. >> building a better bay area, moving forward, finding solutions, this is abc 7 news. dan: good evening. thanks for joining us. you're watching abc seven news at 11:00. sacramento police have arrested the third person in connection with sunday's mass shooting that left six people dead and 12 others injured. tonight we are learning that one of the three suspects, smiley martin, was recently released from prison after serving just over half his sentence. a reporter air stone is going the story and has new details. reporter: 27-year-old smiley martin is one of three suspects, including his mother dandrae martin in custody in connection

with the mass shooting that happened sunday in sacramento. leaving six dead and 12 wounded. >> smiley martin and his brother deandre work together during this incident. reporter: he was in front of a judge for the first time tuesday facing assault illegal firearm possession charges. smiley, who was shot during the incident will be questioned -- booked into the sacramento gel when his medical condition improves, is no can -- stranger to the law. the colorado department of corrections confirmed he was released a little more than a month ago in february after serving nearly 5.5 years of a 10 year sentence, after past convictions involving robbery and assault with a deadly weapon. he faces gun charges, including being in possession of a machine gun. the sacramento da's office was so concerned about his release they wrote the parole board last year vaccine he has little regard for human life and the law.

smiley's release was denied, but this year, with presentencing credits, authority say his sentence was completed. >> the question is going to be asked, what level of supervision, if any, was he under when he was released from prison? reporter: legal analyst says possible lawmakers now take a look at the prison credit system. >> they're going to look at this whether they should go back and tinker with the prison credit system so that certain people do not get out this early. i think it is too early to point fingers at anyone governmental entity. it is questions that need to be answered, particularly when you look at the carnage that occurred. reporter: none of the suspects face homicide or murder charges. police say that could change as they are currently going through for them 170 video clips and sorting through evidence. dan: in the wake of these mass

shootings in sacramento, there has been renewed calls among lawmakers to enact stricter gun laws and do something about ghost guns. reporter tim johnson spoke with state and local leaders about some of the changes they believe will save lives. reporter: days after sunday's mass shooting in sacramento, the deadliest in the city's history, there is a renewed push for new gun laws. one bill that would target ghost guns, moved out of committee tuesday. another in the works is a be -- introduced by -- >> it holds gun manufacturers, gun dealers, gunshots liable for the guns they put on the street. reporter: if passed, the law would allow people to sue gun manufacturers and sellers for harm caused by their product. -- california has some of the strictest gun laws.

the indictment says a bank of america contractor was on the inside, helping cohorts cash in on the edd debit cards make off with $2.7 million. michael finney is here with the story. reporter: >> he took $16,000 from the account, where did it go? reporter: diane davis and michael conant walked as hackers drained their edd debit cards. think of america denied the claims of reserve accounts, along with thousands of others. >> we believe the overwhelming number of frozen accounts represent frauds that were stopped. reporter: that was a bank of america executive explaining to state lawmakers why the bank froze those accounts, saying it believed they were skimmers trying to claim extra money. >> i'm the victim, being treated like a criminal. reporter: the federal judge ordered bfa to -- be of a two

reopen those claims. >> but we will find out as the case unfolds is what went on, how did they do it, how did they get away with it. reporter: the grand jury in little rock has indicted 10 organs are residence on charges of cashing california edd debit cards. the indictment names for bank of america contractor madison part of little rock, customer service agent serving edd cardholders. it she used her position and access to bank of america's systems without authorization, to reissue debit cards, remove flock -- fraud blocks and add credits. the u.s. attorney's office said the other defendants used debit cards to withdraw $2.7 million. one defendant was out on bond the facing of the charge when authorities say he joined the conspiracy. the u.s. attorney's office said

dan: saved from the flames, a litter of puppies is recovered after being rescued yesterday from a burning home in the central valley. crews discovered the pups after hearing yelping. paramedics give them oxygen, bandage deposits, which were singed. firefighters couldn't reach the owners of the home, so they drove the puppies 80 miles to a vet hospital, once healed, they will be released to their owners. the firefighters did great work. encouraging signs for
