just as time was running out, so what happens next? wild ride. the stolen ambulance, the 70-mile chase and the wild ending. and later a not so empty nest, the number of parents still supporting their adult children. good tuesday morning, everyone. we begin with the battle at the southern border and concerns about a new wave of migrants crossing into the u.s. in the coming weeks. >> a judge is now stepping in poising a setback for the biden administration. a federal judge has now granted a temporary restraining order preventing the biden administration from lifting title 42, that's the trump era public health order which allowed border patrol to turn away illegal immigrants to prevent the spread of covid-19. the cdc had planned to lift title 42 next month prompting concern that it could lead to a flood of new migrants trying to cross the southern border.

>> the biden administration estimated that 18,000 migrants would be along the southern border if this policy was lifted. that was their own prediction. >> reporter: the federal judge's decision, a victory for multiple states including arizona, which has sued over the issue. >> we don't know why necessarily the judge ordered this policy struck down. the order was a one-paragraph order, and the justice department has not said whether they will appeal the ruling or not. >> reporter: one of president biden's campaign promises was to end title 42, but republicans and even some democrats say it's too soon. a group of house republicans visited the border yesterday, the same day authorities found the body of bishop evans, the 22-year-old texas national guard member had been missing since last week while trying to rescue migrants who were crossing the rio grande river. >> that man is a hero, and there are many heroes walking among us. >> reporter: the lawmakers honored evans and accused the biden administration of not having a plan to deal with the looming surge of illegal migrants.

>> we asked them what their plan will be. no plan is given. and if title 42 is lifted, it will be much worse. it's not just unsustainable now, it'll be uncontrollable then. >> the judge's restraining order prevents any action on title 42 before may 13th when a hearing on the lawsuit is scheduled. a judge is now holding former president trump in contempt of court. he is accused of failing to comply with a subpoena stemming from the new york attorney general's investigation into his business practices. trump has been ordered to pay $10,000 every day until he turns over the requested documents including his post-it notes. if not he must provide proof he has nothing more to turn over. his attorney says trump has already complied. and newly revealed text messages shed new light on efforts to overturn the 2020 election. the messages to trump's chief of staff mark meadows were handed over to the january 6th committee. in one message congresswoman marjorie taylor greene says, some trump allies wanted him to declare martial law to prevent joe biden from becoming

president. abc's jonathan karl is also reviewing messages sent to meadows as the capitol riot unfolded. >> reporter: amidst the attack even marjorie taylor greene texted meadows, quote, please tell the president to calm people. this isn't the way to solve anything. former trump chief of staff reince priebus texted in all caps, tell them to go home. and donald trump jr. begged meadows to push his father to make a statement texting, this is one you go to the mattresses on. they will try to expletive his entire legacy on this if it gets worse. >> just last friday congresswoman greene testified she did not recall when specifically asked if she had discussed martial law. now to billionaire elon musk buying twitter. reaction has been pouring in. critics worry musk will have too much power. others say the deal will protect free speech. abc's faith abubey joins us now with the very latest. faith, good morning. >> reporter: hey, good morning to you, mona.

twitter has agreed to accept an offer from elon musk worth $44 billion. many observers are now looking into the history books to figure out exactly how this deal could actually impact the american public. this morning, the debate is raging over how elon musk taking over twitter could change social media in america. the tesla and spacex ceo promising to redefine free speech online, open up the flow of information and be more inclusive after criticizing how twitter currently moderates messages it views as hateful or disinformation. musk tweeting, quote, i hope that even my worst critics remain on twitter because that's what free speech means. among his supporters, twitter shareholders who will receive $54.20 for every share they own, that's nearly 40% more than what the stock was worth earlier this month. >> for a lot of shareholders this is kind of a quick win. it's a very nice quick win. simple. >> reporter: musk hasn't said

whether he will allow banned users like former president trump back on the site but trump says even if he's reinstated he'll be staying off twitter in favor of his own platform, truth social. even without trump many conservatives are praising the deal. senator ted cruz posting this poll asking, is elon musk's purchase of twitter a good thing? the two answers available, yes and, no, i hate free speech. one of twitter's founders and its former ceo jack dorsey writing, quote, it has been owned by wall street and the ad model. taking it back from wall street is the correct first step. but many others are highly critical of the deal. human rights groups worrying that hate speech could find a new home on the platform. others worry the deal will hand the world's richest person too much power. senator elizabeth warren tweeting, quote, billionaires like elon musk play by a different set of rules than everyone else accumulating power for their own gain. the news website axios says the deal is further proof we're living in a second gilded age

comparing the likes of musk, gates, bezos and zuckerberg to the wealthy industrialists who dominated the late 1800s. "the new york times" argues musk more closely resembles newspaper barons like william randolph hearst and the fictional "citizen kane" who used their papers to carry out personal agendas and to harass their enemies. and, mona, to build trust musk is promising to make twitter's algorithm public, disclosing how twitter messages are displayed. the deal, though, is expected to close later on this year. mona. >> faith abubey, thank you. now to the war in ukraine. russia's foreign minister says the war could escalate beyond ukraine. he said the risk of a nuclear conflict should not be underestimated. his ukrainian counterpart fired back saying russia now senses defeat. an estimated 15,000 russian troops have been killed. russian air strikes have hit five rail stations and fuel sites in central and western ukraine, an apparent attempt to

target weapons headed to the front lines. meanwhile, new video posted by russian-backed separatists shows a village in ukraine's eastern region completely destroyed. no word when that video was shot. back in this country police in wisconsin are investigating the murder of a 10-year-old girl. lily peters was reported missing in chippewa falls after taking her bike to her aunt's house. her body was found in the woods by a walking trail. police say they have multiple leads but no arrests. police in san jose, california, are searching for the man seen here. they say he kidnapped a 3-month-old baby from the family's home. they say the suspect wearing a mask walked into an apartment as the baby's grandmother was unloading groceries. the supreme court justices are now considering the case of a former high school football coach who was fired for praying with students on the field after games. at issue is the right of public employees to practice religion versus the perception of a government agency, in this case a school district, appearing to push religious beliefs. justices weighed in during oral

than 70 miles. eventually the suspect jumped out and started to run. he was captured and later taken by ambulance to a hospital. charges are pending. the parents of a teenager who fell from a amusement park ride in florida are now suing. tie reese samson's parents have filed a lawsuit. against the operator and the death. investigators say the 14-year-old was not properly secured when he fell from the ride and the safety sensor on his seat had been manually adjusted. >> it should have been prevented. as the operator, you have a job to check those rides. that was not done. that was not done. so, if it was done, it should have been done more than once. >> the ride's operator says they're fully cooperating. later on "good morning america,"

samson's mother addresses the video of her son's fall. now the emotional reaction after a texas mother on death row has learned the judge has halted her execution amid protests demanding a new trial for melissa lucio. >> stay of execution granted. yes, yes, yes! >> reporter: this morning tears of relief from this texas family after hearing that melissa lucio's execution has been put on hold. just two days before she was set to die for the murder of her daughter. >> the court of criminal appeals issued a stay of execution for wednesday. >> texas representative jeff leach breaking the news in a texas phone call. >> oh my god! that is wonderful!

>> abc station krgv was with the family when they learned the texas court of pardons and paroles has now ordered the court to consider new evidence in the case. lucio, a mother of 14, was sentenced to death for the killing of her 2-year-old daughter mariah in 2007. her supporters say lucio's confession was coerced and now a forensic expert says mariah's bruising was consistent with head trauma from an accidental fall. >> this is your chance to set it straight. right now, it looks like you're a cold-blooded killer. >> hulu helped shed new light in the case in a recent documentary, prompting rallies across the country. her family celebrating this big moment. >> we're going to believe in god and continue believing in him and keep our faith with him and keep on fighting this fight until we bring her home. >> melissa lucio thanking those who fought for her clemency.
