developing news. we are seeing new images of the primary suspect in the kidnapping of a three-month-old in the south bay. the baby is safe this morning, niangfully and a total of three people are in custody. there are still a lot of questions about this case. reporter: five minutes is all it took. this is the man who kidnapped a 3-month-old from his family's san jose home. the boy was found tuesday morning after a 20-hour search that ended miles from where he was taken. asking for the public's help monday evening, police released this surveillance footage showing a man with a baby carrier, casually walking along elm street. and in this exclusive footage, time stamps uncovered that same man then leaving five minutes later. >> right then and there, i thought that was the guy. reporter: the camera gave our only glimpse of the kidnapping. police say it was instrumental in the investigation. >> you can just tell when he was walking towards the house by the

apartment, it was light and when he had it walking back, it looked like there was a wave in there. reporter: the baby's grandmother tell police she was unloading groceries outside with a 3-month-old in the house. and the massive search for the baby involved the f.b.i. now three suspects are in custody with some connection to the family. though police aren't specifying. >> there's still much more for the detective can co-do and i don't want to give too much that can affect the investigation. reporter: the call the police led to the recovery of the baby. at the scene, at least five officers with vests that read san jose police gang unit were seen carrying units from the home where the baby was found. though police did not elaborate why the special unit was there. our knocks weren't abc7 answered

but neighbors described their shock. maria alvarado says they had the boy right here, all this time and she didn't know it. back at the baby's home, residents there are still trying to make sense of the kidnapping they say seems targeted. >> and when they said the baby was taken, i heart -- i have a lot of grandchildren and great grandchildren. reporter: the family's neighbors said every aspect of the case has made her emotional. >> who can come into your home with a little baby bed to carry this child out? who can be so daring if who can be so ugly? reporter: police say the three suspects include the man seen in that surveillance footage. a woman was with the child's grandmother before he was abducted was also detained. abc7 news. julian: at u.c. berkeley student

is facing charges of threatening to shoot staff. it led to a campus lockdown last week. a 39 years is charged with two counts of felony criminal threats. the university said the threat was related to a student who had been placed on interim suspension for threatening behavior. officers found the student and gave the all clear after a lockdown that lasted for more than four hours. kumasi: we are learning new details about the treatment vice president kamala harris is getting after testing positive for covid-19. the white house says she's asymptomatic but her doctors have put on the lifesaving drug. here is more. reporter: so vice president harris is isolating and working from home right now she's not considered a close contact to president biden or the first lady and that's because of recent travel schedules. we're also learning this morning here that she is you shouldn't a doctor's care and taking prescribed doses of the covid

kumasi: state senator scott weiner wants to ban cases from sexual assault. this comes after san francisco d.h. revealed that the investigators used the woman dna to arrest her from an unrelated crime. >> we need to do everything in our power to discourage encourage survivors to come forward and we will protect them. senate bill 1228 will make sure that this misuse of victim dna never happens again.

kumasi: the woman announced to sue the city. the san francisco chief has instituted new guidelines banning the use of victim d.n.a. in unrelated investigations. julian: in the north bay with racing returning to the speedway, the track is warning fans and drivers not to display the confederate flag. because of the pandemic, there were no races last year. it is not clear what prompted the warning since four races have already been held this season the track posted a message on its facebook page last week. kumasi: harvard university announced it is pledging $100 million to create a fund to redress or address its "extensive sipangments with slavery." it coincide sides with the university releasing a report with details its connection to slavery, segregation and discrimination the report finds that harvard profited from

only at 37 degrees. we have some upper 40's and low 50's around the bay, but much cooler in santa rosa. 13 degrees cooler than 24 hours ago. but this afternoon, temperatures not that much cooler compared to yesterday however, it is a cold morning what freaking and a frost advisory in effect until 9:00 for parts of lake county and mendecino county. temperatures below freezing and that could kill some sensitive vegetation. and then tonight, a wind advisory in effect for the north bay and east bay. gusts down 60 miles an hour. so be extra careful there especially in the higher elevations with windier conditions at the beaches. only first there. lots of 60's. 5 in 67n j and overnight lows will be in the 40's for the most part. upper 40's around the bay. some mid 40's through parts of the north bay. the accuweather seven-day

♪ agmrenovations.com ♪ julian: new development in a viral vandalism case in martinez. you might remember this video from 2020 showing a couple painting over a black lives matter mural. the couple has agreed to plea deals they were also charged with burglarizing a dead man's home. our media partners reports 54-year-old david nelson pleaded no contest to misdemeanor vandal victim and a burglary charge he was sentenced to 120 days in jail and two years probation. nicole anderson pleaded no contest and received 40 hours of community service and a year of probation. drug charges and hate crime enhancement for the vandalism were dismissed as a part of the plea deal. kumasi: a san francisco woman found herself at the center of one big fun live on national tv and you might have seen it unfolded here on abc7. jessica help stump the celebrity

few low 70's. and then the wind advisory goes into effect tonight at 8:00 through tomorrow morning. the areas in the north bay highlighted in yellow and east bay where gusts could reach up to 60 miles an hour. so i'll let you know we've got a cooler day tomorrow and i'll have that complete accuweather seven-day forecast coming up. julian? julian: we'll see you in just a second. developing news in the south bay this morning where we are awaiting to find out the out you have to the three people accused in the abduction of a 3-month-old baby in san jose. that little boy back with his mother this morning. got some new video showing the primary suspect police initially shared the video of the man arriving with that empty carrier. well now we have exclusive video of the man leave the carrier with the baby inside. only five minutes later. a neighbor surveillance camera captured these images. >> they caught the gentleman walking from left to right back with the baby and without the

following year. teachers say most of those schools are in prominently black -- predominantly black and brown neighborhoods. 75% of voting members ruled in favor of the strike their demonstration will be held friday in the morning. the issue of consolidating schools has been heavily debated since the start of this calendar year. the teachers union says this strike is not about wages but about unfair labor. >> we are going on an unfair play-by-play practice strike. this is not a strike for wages and benefits. this is a one-day ulp strike. >> the school district said it was heading for a budget shortfall and claims it had no choice but to close some schools. they say this planned strike is illegal. in a statement, they said there has not been a final ruling to the unfair labor charge. the asserted basis for the strike, we strongly urge oea to reconsider its illegal activity.

>> three, two, one, zero. ignition. and liftoff. julian: a new mission to space is making history this morning. three american astronauts and one european blasted off into space just a few hours ago. one of the nasa astronauts is 33-year-old jessica watkins who previously worked at nasa ames in mountain view she is the first black woman to perform a spacewalk and live on the international space station for a long-term mission. the spacewalk might be live,
