side of this honda accord, minutes after a gunman opened fire. officers with the california highway patrol say shots were fired along interstate 80 west of alamo drive just after 4:00 monday afternoon. a busy time of the day with the evening commute underway. of those bullets, at least one struck a child. scanner traffic that was confirmed hours later with chp saying that the child will recover. >> there is one single call and it looks like the victim was shot. j.r.: the child being taken to northbay medical center in fairfield, we witnessed this chopper taking the child to the hospitals in oakland. a chp officer by their side before the flight took off. the officers will not confirm if the shooting victim was one

airlifted to oakland. chp shutdown eastbound lanes of i-80 as they searched ford's shell casings. meanwhile the traffic standstill was a long one along i-80 with no suspect vehicle descriptions, and no arrests were made. another challenging highway shooting case for the chp due to the lack of info. they are hopeful that anyone with information in this case come forward, calling the chp tip line or 911. j.r. stone, abc 7 news. ama: federal data says nearly 2400 virus positive americans are being admitted to hospitals daily. that is up 17% this week. a study found that a fourth dose of the covid vaccine could give people higher immunity than the initial booster. scientist at rutgers university have developed a lab test to detect the virus and terman --

services to our residents. reporter: the covid dashboard showed the covid rolling average at 552 new infections compared to 140 cases at a low point in march. dr. jorge says that what we do now should not be about panicking, but rather taking personal responsibility. >> we know that masks work, vaccines work, good ventilation works. we just need to implement it. reporter: on the county level, public health officials say they are not expecting to make any changes to masking. masks are still required in all county buildings. >> if you can avoid, i would recommend as a doctor for you to avoid it. reporter: in san jose, i am amanda. dan: we saw sun and hail today

after a 15 month old girl was found unresponsive in santa rosa this morning and unfortunately died in the hospital. investigators found multiple traces of fentanyl in the bedroom. both parents were arrested under federal child cruelty charges. ama: new details in the kidnapping of baby brandon in san jose. he is the three month old boy who was taken from his grandmother last month. an interview with the suspect's employer so -- shows that she

fabricated lies. she told employer she wasn't able to come into work, saying she had to go to the police department to identify a suspect who broke into her apartment. ramirez also sent him a video to back up her story. >> the day of the kidnapping, she called me up around 1:00 because i usually rotate my employees. i told her she needed to go to the same area. she said her neighbor's baby was recently taken from the side of her home. they went inside her home to steal the baby. ama: ramirez's employer didn't hear back from her after attempting to reach her several times. it wasn't until he turned on the news that he put two and two are. dan: accountability put into question with a known criminal with a repeat history of stealing from san francisco

receiving a reduced sentence. stephanie sierra investigating why the da dismissed almost all of the charges against him. stephanie: surveillance footage caught nathan picco stealing from the cash register. >> i got a call from the breeze to who was opening up the shop. stephanie: storeowner joshua james says he got away with over $1000. glass was shattered along the sidewalk. james says multiple businesses were hit on his street. what he didn't realize, this burglary was at the end of a crime streak targeting businesses across san francisco. seven businesses hit. >> this person obviously made a career of terrorizing people this way. stephanie: picco was charged

with burglary and grand theft, but yet 13 charges were dismissed against him. >> a repeat offender at the highest level, so it was like, what happens to him after that? stephanie: the da office told the i team that the defendant pled to some but not all of the charges. in this case, he pled guilty to two charges of second-degree burglary. the plea deal says that he will take part in a residential treatment program and be placed on two years probation, despite the fact that the most recent 16 charges were in violation of his recent release on a pending case. >> this is representative of the type of chronic offenders we are dealing with in san francisco. stephanie: brooke jenkins is a former prosecutor who resigned last year. jenkins says she is one of 54 prosecutors have resigned since

chase abu dean assumed office. she says cases like picco's remind her why she left. >> we repeatedly see repeat offenders receive extremely lenient plea deals. >> we have filed more than 10,000 new criminal cases. stephanie: that doesn't toss the outcome of new cases. victims like james want accountability. the da's office has issued stay away orders for restitution and placed picco on electronic monitoring. we will be following what happens. for the i team, stephanie sierra, abc 7 news. ama: the san jose city council getting ready to pass a bill banning ghost guns.

certainly more like winter. it is scattered in nature. all roads except for 50 requiring chains. 40's and 50's on those temperatures. the ocean temperatures at 49 when you get the wind blowing off that cold ocean air. it is feeling colder out there, although the winds have dropped off. these are the high temperatures for today. anywhere from four to 15 degrees below average. as we head into saturday, you're going to be seeing places like concord going to 90 and that is a 20 degree warm-up. going to 86 degrees. some are like weather is coming. you can clearly see across the bay. cold overnight and showers tomorrow. much warmer weather towards the end of the week. tomorrow morning at 5:00, watch out for wet spots as spotty showers develop.
