200 miles away in evansville, indiana. casey white escaped from jail april 29th allegedly with the help of longtime corrections officer vicky white. police saying vicky sold her house and drained her bank accounts to run away with him. despite the same last name the two are not related. but investigators say the two had a special relationship, shocking vicky's family and co-workers who described her as a hard worker on the verge of retirement. >> i said you need to send an officer out. i got a suspicious vehicle. >> reporter: a tip led investigators to indiana where the manager of a car wash grew suspicious about a truck parked there for days. >> i walked up to the truck. i noticed the windows are down and my first thought is could be this guy from alabama. he might be in there asleep, passed out, suicide, whatever. >> reporter: surveillance video from the car wash showed a man who appeared to be casey then investigators say they tracked the couple to a nearby hotel where the whites took off as u.s. marshals pursued them.

over in a ditch.ing a cadillac - casey was pulled from the wreckage and arrested, but authorities say vicky was pinned inside with a gunshot wound to her head. they say casey told them vicky had shot herself. >> announced that his wife had shot herself in the head and that he didn't do it. >> reporter: vicky later died at the hospital where an autopsy is expected today. >> we got a dangerous man off the street today. he is never going to see the light of day again. >> casey white will be transferred back to alabama to face new charges related to his escape. president biden is expressing new concern about vladimir putin's next move in ukraine. the president says he's worried putin doesn't currently have a way out of the war. biden also said he's eager for congress to pass a $40 billion aid package for ukraine which could happen today. the war's intensifying with repeated attacks on the port city of odesa where russian missiled destroyed five buildings including a mall.te in poland tt

on the russian ambassador during a service. gas prices hitting new records across the country this morning. average prices are up 15 cents in the last week thanks to tight oil supplies blamed on the war in ukraine and covid disruptions. president biden's decision to release oil from the u.s. strategic reserves had little impact. gas prices are expected to keep rising as summer travel season begins. >> given that global crude oil supply remains tight and we know that there's going to be an increase in demand for the product, that's what's pushing these pump prices higher and higher. >> in los angeles uber drivers are protesting demanding higher pay. gas prices there now average $5.89 a gallon. meanwhile, record high diesel prices are making inflation worse. higher transportation costs being passed along to consumers buying everything from groceries to toys.

meanwhile, stocks have been on a wild ride down falling nearly 17% so far this year with big losses for tech stocks recently. investors are worried about inflation and corporate earnings. one expert warns we could see these losses continue until fall. new security concerns in the wake of that leaked supreme court draft opinion on abortion. more protesters have been gathering outside the homes of the supreme court justices and now the court is about to get some new protection. abc's justin finch is now here with more. justin, good morning. >> reporter: andrew, good morning. the senate has now passed a bill providing security protection to family members of supreme court justices as that debate over abortion rages on. the new bill would give the nine supreme court justices security protection equal to what's already provided to top officials in the executive and legislative branches, all in response to protesters gathering outside some of the justices' homes. [ crowd chanting, "alito is a

coward" ] >> reporter: this was the scene outside justice samuel alito last night. protesters angry over his draft opinion that showed the court's conservative majority is poised to overturn roe versus wade. senate minority leader mitch mcconnell even called the protests illegal citing a federal law that criminalizes demonstrations with the intent of influencing the judge although legal experts question whether that law applies here. >> this is a place where they sleep. this is a place where if they've got children at home where they're raising children. it's an implicit threat of physical violence, and that has no place in our system of government. >> reporter: democrats are vowing to take action in the wake of the leaked draft opinion which would leave the legality of abortion up to the states. the senate is expected to vote tomorrow on a bill to codify abortion rights protections, though the measure is almost sure to fail because democrats don't have enough votes. key swing voter republican lisa murkowski says she's voting no. meanwhile, the white house is responding after senator mcconnell said it's certainly

possible that lawmakers could impose a federal ban on abortion depending on the supreme court's final decision. >> dozens and dozens of republicans in congress signed on to the mississippi court case and advocating for severe restrictions on a woman's right to choose, so in some ways, yes, you're seeing an outcry by the nearly two-thirds of the public, many peacefully protesting who are concerned about what this opinion will say. >> reporter: and as for that security measure for supreme court justices, the house still needs to approve the bill before it heads to the president's desk. andrew. >> justin, thank you. new covid cases are climbing in 45 states sparking concern about a fifth wave of the virus. the current hot spot is the northeast where new york's transmission rate is up 75% in the last month, and in the boston area officials are considering a return to mask mandates.

>> while we've seen a surge in cases, we're not seeing that correlated impact in mortality. the challenge we have is going forward especially into the summer months where we may see an impact in the south where we don't have the same level of vaccination and boosting and testing. >> reporter: experts also say the current surge is likely much worse than the numbers indicate because many people are testing at home or not testing at all. autopsies are being conducted on three americans found dead at a resort in the bahamas. now, it could take weeks to find out what killed michael and robbie phillips, a husband and wife from tennessee as well as vincent chiarella of florida. toxicology samples have been sent to a lab in the u.s. a friend of chiarella and his wife donnis who survived says he's heartbroken. >> they were celebrating their 40th anniversary, which is a few days away from ours. just a lovely, lovely couple that was just full of life and just, you know, enjoying their time in paradise. >> all four victims reported feeling sick the night before. the lab will now determine if

latest from court as the accuser took the stand. >> the linguine with clams is a simple dish. >> reporter: this morning, former tv chef mario batali is on trial facing possible prison time for indecent assault and battery. >> mario batali assaulted me that night, yes. >> reporter: the 32-year-old woman accusing him took the stand in boston describing an encounter at a restaurant in 2017 which she says left her shaken. she says she was taking selfies with batali who was visibly drunk when he began kissing and groping her. >> there was touching of my breasts, touching of my rear end, touching of my sensitive feminine areas in between my legs, touching all over my face, his lips on the side of my face, his tongue in my ear. >> reporter: only the judge can see the selfie photos now at the center of this case and the accuser is also being concealed per the judge's orders.

>> they don't show that, do they? >> they don't show that. that doesn't mean it didn't happen. >> reporter: this isn't the first time batali has faced these kind of allegations. the 61-year-old celebrity chef was once a fixture on tv with ownership stakes in restaurants across the country. his empire crumbled after four women accused him of inappropriate touching in 2017. batali apologized saying his behavior was wrong, but he denies the allegations being made in court. his lawyer attempting to discredit the alleged victim saying she's seeking more than $50,000 in a separate civil lawsuit. >> you continued to take the selves despite what you say about him assaulting you, correct? you continued doing it the entire time? >> that's right. >> reporter: batali has waived his right to a jury trial meaning the judge will decide his case. if convicted, batali could face up to 2 1/2 years in prison and be required to register as a sex offender. the trial is only expected to last two days.
