remain on leave because of the events. >> the man suspected of killing a police officer back in court this morning. he pleaded not guilty. the officer was working as security for a television news crew when according to police, a robbery was attempted. mitchell is charged with murder, attempted robbery with a firearm. two other suspects have also been arrested. >> now to a story we first brought you last night about a woman stuck in an elevator that was overdue for a state safety inspection. the state says an inspector found enough issues with the elevator that it had to be taken out of service. our reporter has this update and new video of another group of people stuck in an elevator overdue for inspection at a popular san francisco concert venue.

>> it took requests by the hotel as well as calls by abc7news for someone to be dispatched to inspect the elevator. >> i called for help, i screamed. reporter: prior to her getting stuck, the elevator was last inspected in june 2019 after abc7news uncovered a backlog of elevator state safety inspections across san francisco. the department of industrial relations now says they found four issues with the elevator at the hotel, which warranted removal from service. the elevator red tagged until corrections could be made. >> shame on you. reporter: officials say that hiring is a top priority for the division. joel rodriguez and his girlfriend in a group of nearly 10 people who got stuck in this

elevator after a concert in february of this year. >> we are stuck in here after this concert. reporter: according to a permit inside the elevator at the time, it had last been inspected in march of 2016. >> a pregnant lady was on the elevator with us. myself and my girlfriend several from anxiety. reporter: it turns out the elevator has been inspected more recently. a spokesperson provided a permit for the same elevator, last inspected in february 2020. it is overdue a state safety inspection by more than a year. the state sent this letter that said the expired permit is valid until an inspector can be dispatched. we were told elevators are required to be properly serviced and maintained by the building owner and certified elevator maintenance company even when operating with expired permits. >> they were reaching out to a local tech in the area on a sunday night at 10:45, which

funding to help women get abortions. one issue in particular has already become a tough sell in the state legislature. surging tax revenues fueling a never before budget surplus in california. $97.5 million. here's how it could impact all of us. >> we are proposing $18.1 billion back in the pockets of millions, tens of millions of californians. reporter: one of the most controversial proposals in the package is to allot $11.5 billion worth of tax refunds in an effort to curb costs of record high inflation. this means for hundred dollar checks would be sent to every eligible vehicle owner with a maximum of two checks per person. >> a rebate to address the issue of groceries, to address the other cost burdens. reporter: but the pricey proposal comes with strong opposition in the state legislature. a state senator says it is shortsighted. >> i don't agree with that.

if her going to send money, let's make it very focused who are suffering the most. reporter: the senator says the money would be better spent on infrastructure investments that would benefit californians for decades. >> we have schools that don't have functioning bathrooms or bad ventilation. we are at risk of the embarcadero flooding. reporter: do you think it will pass? >> i don't think what the governor is proposing has support. reporter: but there's plenty in the package that has support, including $2.7 billion proposed to expand the emergency rental assistance program, allowing low income tenants design -- tenants denied aid to get help. other perks, funding to pay past-due utility bills, stubbins to hospital and nursing staff, a 12 month pause in the diesel sale tax rate, and hundreds of millions to provide free bus and train rides across the statepluo

subsidies to eligible it'll cost families. from subsidies to wage increases. newsom also proposed california's minimum wage will jump to $15.50 at the first of the year. another proposal included waiuving childcare fears for low income families, that would make subsidized childcare more affordable. if passed, it could impact 40,000 mas across the state, saving them up to $600 per month and that one has a lot of support on both sides. dan: a remarkable budget on sony levels. a lot of proposals packed into this relief package. when will we know what is past? reporter: we will know in just about a month from now. until then, the ball is in the state legislatures court to make changes or final revisions before the june 15 deadline. we are told most of these programs are backed by the democratic led legislature with the exception of that $400 tax

refund we talked about in the story. it is projected that will pass, but governor newsom said he is confident they will find a middle ground, even if that means reducing the amount slightly. dan: an interesting month. stephanie, thanks. >> new funding for more security cameras on state freeways, including several in the east bay. ryan curry talked to people who support and oppose the move. reporter: governor newsom now taking action in response to the numerous freeway shootings. he announced funding for a pilot program to add cameras on freeways across the state, including in both contra costa and alameda counties. >> they will be a great benefit to us and the world of enforcement and the world of investigation, and prevention. reporter: the alameda county sheriff said these new cameras will be crucial in helping find people who commit shootings. freeway shootings have resulted in the loss of innocent life.

a sheriff academy cadet died in a shooting near the bay bridge, and in november, a toddler died after being caught in the crossfire on 880. the sheriff says no one should be afraid to drive on a freeway. >> we have people who will not drive on the freeways in certain areas because they are afraid of being involved in a shooting. reporter: even with the rise of freeway shootings, there are some who think adding more cameras will create more problems. >> when you put cameras on a highway, you essentially are treating the entire public as potential criminals. reporter: adam schwartz fears adding more cameras violates the privacy of bay area drivers. he thinks it will lead to more racial profiling. >> these technologies aggravate existing biases in the criminal justice system and can lead to more people of color being prosecuted and incarcerated. reporter: but the sheriff says that will not be an issue.

she says cameras will only be used to track criminals. >> these cameras are only reviewed when a serious crime takes place. we are looking for the suspects of those crimes. if you are not a suspect at any of these shootings or crimes, there's nothing to be concerned about. reporter: ryan curry, abc7news. dan: california has reached a pandemic milestone, more than 90,000 lives lost. the state released the latest data today, the test positivity rate has climbed to 4.4%, up half a percent the past week. we could be getting close to a vaccine for kids under the age of five. a member of our abc7news vaccine team talked about the timing during our 3:00 p.m. show. dr. patel: the process of sitting on the data, it could be for five weeks. if every thing goes according to plan, we could see an approved vaccine for young kids under the age of five sometime at the end

through maybe one can week. reporter: the impact of the pandemic and a recent recall of one of the leading baby formula manufacturers has led to this shortage, leaving moms like this on their own, searching for ways to feed their babies. >> all of us are trying to share the formula we have. sometimes even half a can, i will take half and you take the other half. it is really serious. i cannot breast-feed at all. if i don't have formula, my baby is not going to eat. reporter: for the past two months, she's been contacting strangers on social media and paying via venn milk, hoping to have enough formula. >> i'm having formula shipped from oklahoma, kentucky, from sacramento. i recently looked into buying from canada. reporter: finding formula on the shelf is almost impossible, and on amazon she says the prices have more than doubled.

they say died during an exorcism. dion: the girl's mother has faced felony abuse charges since january. zach fuentes has new details. reporter: the girl died on september 24 last year. court documents show the girl's mother drove her to a san jose church, believing she was demon possessed. the girl eventually died in their attempts to get the so-called spirit out. the adults called 911 after -- hours after her death. documents show the child's mother said hopefully her daughter would -- said daughter would wake up and scream periodically and she believed she was possessed. her uncle took her to thi of ser 24. the girl's grandfather, later met them there. >> she was strangled multiple times to the point of unconsciousness. she had fingers shoved down her

throat to the point where she had multiple injuries to her mouth and tongue. she had pressure put on her body , her torso from the front and back, with so much force applied that she lost consciousness. she was held against her will and struggled against her abusers the whole time. this abuse lasted over 12 hours. reporter: hernandez was arrested january 31 of this year, months after the three-year-old's death. the girls uncle and grandfather eswe >> as the full corners report wears -- was released, we received additional information that was enough to indict the grandfather and uncle. reporter: if convicted, all face 25 years to life. days after her arrest, the mother posted a video speaking in vague terms about her daughter's death. >> i would not lie about how she passed away.

dion: tonight at 8:00, it is shark tank, followed by 2020 at 9:00, and abc7news at 11:00. dan: finally, thoughts about what really matters. there was nothing good about the early months of the pandemic and lockdown, but at the least there were not street robberies and car break-ins happening left and right in san francisco. the corks have crawled back out from under the rocks to prey on the innocent and unsuspecting again. so much so, the district attorney, taking heat from rising crime, is facing a recall vote. he is defending his record as strongly as some are attacking it. both sides are tossing around a lot of figures to make their case, arrest numbers, charging rates, divergent data. all kinds of finger-pointing. but the crime problem is also being measured by something else, perception. that feeling by a great many people that they are not as safe
