that crucial formula plant. johnny depp back on the stand in his defamation trial addressing explicit text messages about women. plus, twitter paying up. accused of privacy violations. and later, school safety in the spotlight. after 9 the tragedy in texas, a closer look at what some schools are now doing to protect kids in the classroom. good thursday morning, everyone. we begin with several new developments in the texas school shooting tragedy. >> investigators say the shooter was barricaded in the school for up to one hour getting inside even though he had been confronted by an armed security officer. the town of uvalde came together last night for a prayer vigil to mourn the 19 children and 2 teachers killed. the pastor saying, we pray for the little children who saw what happened to their friends. >> the faces of those friends now cover newspapers around the world. we're learning more about each of them and the impact they had

but first the investigation into the question, why did this happen? this morning, messages obtained by abc news reveal a chilling warning just minutes before the elementary school shooting in uvalde. the messages appear to show the suspected gunman texting a 15-year-old girl in germany on the morning of the massacre, first describing an argument with his grandmother over paying his phone bill and then texting, quote, i shot my grandmother in the head. later he writes ima go shoot up a elementary school right now. that last message was sent at 11:21 a.m., 11 minutes before authorities say he entered the school. speaking to "the new york times" the girl says after seeing the news, she asked a friend to contact police and said, quote, maybe i could have changed the outcome. just could never guess that he'd actually do this. sources say the alleged gunman met the girl on yubo, a social media platform, which claims to have 60 million users.

according to multiple users on yubo, the suspect live streamed himself abusing animals including putting a cat in a bag and throwing it at a house. authorities are investigating the yubo profile but say they cannot confirm its validity. it comes as a new time line emerges. authorities say the gunman spent 40 minutes to an hour inside the school opening fire on anyone in front of him. >> they did engage immediately. they did contain him in the classroom and put that together in a very orderly way and, of course, breached. >> reporter: officials are confirming agents from the border patrol's elite specialized units took down the gunman but not before he killed 19 children and 2 teachers including cousins, annabell rodriguez and jacklyn jaylen cazares. and makenna lee elrod, she loved softball and gymnastics. amerie jo garza had just turned 10. her father taking this video of amerie fishing just days ago. >> she was the best person that i know.

full of life. gone too soon. always smiling. she was artistic. she was smart. >> reporter: authorities say the suspect legally purchased two ar-15 style rifles, one on may 17th, a day after his 18th birthday. the other one on may 20th. they say he also had more than 300 rounds of ammunition. one focus of the investigation has been the home of the suspect's grandparents where police say he shot his grandmother before driving to the school. his grandfather saying he had no idea the teen who was living in the home at the time had guns. >> i didn't know he had weapons or nothing or this or that thing. if i would have known, i would r ve reported it. own on >> yes. m against all that. >> reporter: investigators say no documents found so far have shed any light on a motive for the school attack. at last check six people injured in the shooting remain hospitalized including the suspect's grandmother. students in at least three other cities have been arrested in connection with possible school threats. in richardson, texas, a student

was seen walking toward the high school with a rifle. in boulder, colorado, a 14-year-old allegedly threatened a middle school and in roseville, california, a student allegedly brought a gun to school and identified people to harm. also in california officials say a gun and loaded magazine were found inside the desk of a second grade student. in washington there is some progress in tackling the gun issue. new bipartisan talks are under way. abc's ike ejiochi is here now with the very latest. ike, good morning. >> reporter: good morning, mona. there are some positive signs coming on from capitol hill in terms of lawmakers addressing gun reform. still they are keeping their expectations low. in uvalde, a familiar argument over gun safety erupting at this news conference. >> sit down. and don't play this. >> reporter: beta o'rourke, a democrat running for governor interrupted the current governor greg abbott calling his response to the shooting totally predictable. >> you're doing nothing.

>> no. >> you said this was not predictable. this is totally predictable. >> sir, you're out of line. sir, you are out of line. >> this is on you until you choose to do something about it. this will continue to happen. >> reporter: but in washington the familiar arguments are leading to new discussions, at least for now. senator susan collins, a moderate republican, has already met with other senators to discuss maine's so-called yellow flag law similar to red flag laws in other states allowing authorities to temporarily take guns away from people determined to be dangerous. >> i certainly hope that the senate will take action. this was a horrific crime. >> reporter: and republican senator mitt romney is now signaling he's open to revisiting a bill proposed by democrat joe manchin and republican pat toomey which would expand background check including online and at gun shows. senators mansion and toomey introduced the bill after the sandy hook shooting in 2012.

it fell short of passing after five democrats joined republicans in opposing it. then president obama said this after that bill failed to pass. >> all in all this was a pretty shameful day for washington. but this effort is not over. >> reporter: the 60 senate votes needed to pass any new gun legislation still seems highly unlikely with most republican senators avoiding questions on the issue. >> did you support extended background checks? the majority of americans support it. do you support it. the majority of americans support background checks, do you support it? >> reporter: polls show 56% of americans support an assault weapons ban. 86% support a red flag law and 89% support background checks. now, texas governor greg abbott once supported a red flag bill in texas but backed down from the idea after pressure from republicans. since then texas has repeatedly loosened its gun laws. mona. >> ike, thank you. our coverage continues in just a few moments. we'll look at the debate over

>> reporter: in october, a former employee sent the fda a report detailing health violations at abbott's plant in michigan. but the fda said it didn't receive the whistleblower complaint until february. four months after it got to the agency's mail room. the fda blaming the failure on the lack of staffing due to covid-19. >> literally, we're blaming the mail room that was too slow and there were decisions that were sub opt malalong the way. >> reporter: by that time, an infant had already died and two others were hospitalized after drinking formula from the abbott plant. the fda that inspected the plant in january finding egregiously unsanitariy conditions. >> bacteria growing from multiple sides and many signs in this product that are so essential to the lives of our most precious people. >> reporter: in mid-february, the fda closed the abbott facility and the formula was recalled. since then, more than 40% of
