benefits of being optimistic. >> and the big news overnight. ♪ >> about brittney. ♪ i'm not that innocent ♪ >> from abc news in new york. this is "america this morning." >> good thursday morning, everyone. >> we begin with today's high stakes hearing on capitol hill. >> lawmaker are promising to reveal new evidence about the plot to attack the u.s. capitol on january 6th, 2021. and we're learning more about the video that will be unveiled in prime time tonight as well as the role president trump's daughter and son-in-law may play in the hearing. let's get right to em with a preview of what is to come. em, good morning. >> reporter: good morning. the january 6th house select committee has poured through thousands of records and hours of testimony to establish the truth of what happened that day.

all of that leading up to tonight's opening hearing. the house select committee investigating the deadly january 6th capitol attack, presenting its mountain of explosive material for the first time in prime time. the panel vows to lay out step by step how former president trump and his allies did more than provoke and carry out an attack on the capitol, but deliberately worked to undermine american democracy and overturn his loss in the 2020 presidential election. >> the idea that all of this was just a rowdy demonstration that responsibilitily got a little out of control is absurd. you don't almost knock over the u.s. government by accident. >> reporter: the committee tonight revealing tamed testimony with trump administration officials. as well as trump family members including ivanka trump, jared kushner, and donald trump jr. >> ivanka trump, i'm told, is quite candid about the fact that

she, that she told her father that he needed to do something to get out there and stop the riot. that jared kushner didn't agree with much of what the trump legal team was trying to do in terms of turning over the election. this i think will be some eye-opening testimony. >> reporter: other witnesses include carol i'm not edwards, a capitol police officer who suffered a concussion and traumatic brain injury after mobs pushed through barricades. you have stolen moments away from me that i can't get back, edwards wrote in a court record last year. they will hear from a documentary filmmaker who was embedded with the proud boys before and during january 6th. the night before the attack, he captured this video showing the proud boys leader meeting with the oath keepers. >> i think people will be absolutely surprised how much was known. >> reporter: ahead of the hearing, house minority leader kevin mccarthy is expected to

attack the findings of the committee which republicans have called illegitimate and partisan. >> all right. thank you. and abc news will bring you live coverage of the hearing in prime time, beginning at 8:00 eastern. details are slowly emerging about the plane crash of a military plane in the california desert. the marines confirmed five people were on the osprey aircraft when it crashed about 150 miles east of san diego. according to the "l.a. times," at least four of them were killed. another osprey crash killed four marines back in march. now to the alleged assassination plot targeting supreme court justice brett kavanaugh. the fbi searched the suspect's home in california last night. the arrest is prompting republicans to demand democrats pass new security measures for the court. here's abc's reporter. >> reporter: this morning new fears for the safety of the supreme court after u.s. marshals stopped an alleged plot to kill justice brett kavanaugh. >> i am concerned about the safety of all our supreme court

justices. >> reporter: nicholas was arrested just after 1:00 a.m. wednesday, according to investigators, the 26-year-old was outside cavanagh's house dress in the black and carrying weapons including a glock handgun, and a tactical knife with pepper spray, duct tape and zip ties. >> units be advised. >> reporter: before his arrest, he allegedly called 911 saying he had a gun and wanted to kill a specific supreme court justice. according to the fbi, he admitted he was angry about the uvalde school shooting, as well as the draft supreme court opinion that was leaked last month suggesting the court will soon overturn roe v. wade. >> this is exactly, exactly the kind of event that many feared, the terrible breach of the court's rules and norms could fuel. >> reporter: threats against judges and courts seen on this

chart have already tripled in rece yes. this week a homeland security said this is an even more serious environment. protests outside the homes of sprorlt justices prompted attorney general merrick garland last month to order the u.s. marshals to help protect the justices. >> i oppose, vehemently oppose the nomination and there is a way to do that in this country. it is the democratic process. to threaten harm is outrageous. >> reporter: some republicans blame democrats' rhetoric on the abortion issue for fueling the threat. as for the man arrested outside kavanaugh's home, he's charged with attempted murder and faces up to 20 years in prison if convicted. abc news, new york. >> thank you. a new development in the baby formula crisis. abc news has can you be firmed that a whistleblower filed the complaint about abbott's formula plant in michigan back in

february 2021. abbott and the fda were alerted days later, but it took one year before there was a recall and the plan was shut down. the complaint cited contamination concerns and bad equipment. the plant finally reopened last weekend. now to the push for gun reform in washington after yesterday's emotional hearing on capitol hill. the house last night approvedt passing in the senate. last night, five republicans joined house democrats approving a bill that would raise the minimum age for buying semi-automatic rifles and shotguns to 21. and ban large capacity magazines as well as kits that allow people to assemble so-called ghost guns. >> we stand for lexi, and it is her voice we demand action. >> reporter: the house approving it after powerful testimony from families of the victims. uvalde and buffalo massacres. >> we seek a ban on assault rifles and high capacity magazines. >> reporter: lawmakers hearing

from a uvalde pediatrician who saw first hand the damage an ar-15 can do. >> two children whose bodies were fired possible, who were decapitated, that there was only cartoon clothes still clinging to them. >> reporter: her son was shot and killed in 2016 and she also testified. she said cracking down on guns is not the answer. >> ten more laws, 20 more laws, a thousand more won't make what has already illegal more wrong or stop criminals from committing these crimes. and y'all are delusional if you think it is going to keep us safe. i believe it is our god given right to defend ourselves from any act of violence. >> reporter: she called for addressing mental health issues and improving school security. issues currently being addressed by a bipartisan guerrilla in the senate. that group is focussing on frenthenning background checks

the possibly include juvenile records and provide funding incentives for red flag laws. as for the bill that passed in the house, lindsey graham saying i will vigorously oppose this measure. it will go nowhere in the senate. meanwhile, president biden appearing on jimmy kimmel overnight saying the stalemate can only be solved in the voting booth. >> you have to make sure this becomes a voting issue. it has to be one of those where you decide your position on the issue of senator or candidate for house or senate on what we're going to do with assault weapons and have 300 rounds in a magazine and, i mean, what you say on those things will determine how i will vote for you. it should be one of those issues. >> sources saying the bynum talks in the senate are progress with the potential for an agreement by friday on a framework for a deal. and talks are ongoing about funding mental health resources. meanwhile, the violent weather that roared tough

the parents of a university of missouri student are calling for several fraternity brothers to be charged with hazing. 19-year-old daniel santulli can no longer walk, talk or see. members of the phi gamma delta fraternity are accused of forcing him to drink a bottle of vodka at a party. the family attorney says santulli passed out and his lips turned blue, yet no one called 911. much of the incident can allegedly be seen on surveillance video. we'll have much more on that evidence later on "good morning america." prosecutors say convicted sex offender r. kelly should serve a minimum of 25 years in prison.

they say for nearly three decades the singer used his celebrity to prey on children and young women. kelly's lawyers argue a sentence of 17 years is more appropriate. he'll be sentenced later this month. we turn now to the mystery surrounding a missing new york art student. her family fears she may have been targeted by human traffickers. here's abc's rhiannon ally. >> reporter: this morning, police are appealing for the public's help in the search for 23-year-old tijae baker one week after her family in brooklyn, new york, received a chilling phone call. >> she said, just tell her mother to come get her. >> reporter: they say that was the last time they heard from tijae, a call she made from this nail salon in maryland. her family saying they tracked down the surveillance video, confirming she was there june 1st, but by the time they got there, she was gone. >> where is my daughter? she got off at the capital union station in d.c. >> reporter: tijae baker, a budding artist in her last semester of college left on a

bus headed to washington, d.c. her family says she met a woman online and apparently agreed to make artwork for her there. she was supposed to return the next day. her family says they filed numerous police reports, but they say the first official police flier about the case put tijae's photo on a wanted poster instead of a missing persons poster. the family claims tijae's disappearance isn't getting wide attention because she's black unlike the case of gabby petito last year, which made international headlines. >> we believe that more needs to be done. >> reporter: tijae's mother fears her daughter may have been dragged into a human trafficking scheme. the nypd so far reporting no leads. >> i haven't been sleeping at all. it's been over a month and five days now. i just want my daughter to return. >> reporter: here in brooklyn some city council members are demanding changes to how missing person cases are handled to make sure cases like this one get the
