right now on "america this morning," horrific human tragedy. that description from one official after more than 40 bodies are found in a suspected case of human smuggling in texas. the victims packed inside a tractor trailer as temperatures outside topped 100 degrees. several people in custody overnight. what we're learning about how the migrants were allegedly covered in cooking spices to hide them from authorities. the deadly amtrak train derailment in the midwest. >> it happened. >> the train flipping on its side, passengers trying to escape from windows. how some boy scouts rushed to rescue the victims. the committee investigating the january 6th attack on the capitol announces a surprise hearing today promising new evidence.

the witness now coming forward. inflation taking its toll. the percentage of americans now living paycheck to paycheck and how much more your july 4th barbecue will cost compared to last year. plus, the attempted gold heist at a major airport. and from this wild scene at a youth baseball game to a ball boy's fainting spell at wimbledon, it's tuesday, june 28th. good tuesday morning, everyone. i'm andrea fujii in for mona. >> i'm andrew dymburt, and we begin with the tragedy unfolding in texas overnight. more than 40 people found dead in a suspected case of human smuggling. >> they were packed into a tractor trailer in the summer heat, some of them children. all of them likely in search of a better life. this morning, a suspected case of human smuggling turning deadly in texas.

authorities in san antonio say they found 46 bodies near or inside this tractor trailer in a remote area. >> we're not supposed to open up a truck and see stacks of bodies in there. none of us come to work imagining that. >> reporter: rescuers pulling 16 people from the truck still alive suffering from heat exhaustion with outside temperatures topping 100 degrees. >> no signs of water in the vehicle. it was a refrigerated tractor trailer, but there was no visible working ac unit on that rig. >> reporter: a law enforcement official tells "the texas tribune," it appears people were trying to jump out of the tractor trailer because some of the deceased were found along several blocks, and many of the people appear to have been sprinkled with steak seasoning, perhaps an attempt to cover up the smell of people. three people have been taken into custody. it's unclear if they're connected to human trafficking. the homeland security department is now leading the investigation. the agency says it recently

added more than 1,000 workers to crack down on smuggling, an effort it says has resulted in the arrest of nearly 2,000 nths placing blame on the biden administration writing, these deaths are on biden and the result of his deadly open border policies. the mayor of san antonio calling it a horrific human tragedy. >> 46 individuals who are no longer with us who had families, who were likely trying to find a better life. we have 16 folks who are fighting for their lives in the hospital. >> reporter: authorities last night said they have no idea how long the victims were inside the truck. the closest mexican border crossing is more than 140 miles away. now to the train derailment in missouri. we're learning more about the moments after the crash on the tracks including some of the young school-aged passengers who jumped in trying to save lives. this morning, passengers describing the terrifying moment

a amtrak train derailed killing at least three people. >> all of a sudden the car that we were on was over, and everyone was flying everywhere. >> reporter: the train carrying more than 270 passengers from los angeles to chicago hit a dump truck at a railroad crossing in rural missouri derailing eight passenger cars and turning nearly the entire train on its side. >> dust everywhere. i was on the side of the train that came down first, and so everybody on their side fell on top of us. >> seats were coming apart. bags were going everywhere, and then after it stopped, you could smell the fumes, and so people started panicking thinking it was going to catch fire, so we tried to get out as quick as possible. >> reporter: emergency responders racing to the scene as passengers climbed through the windows. >> you all right? >> yes, sir. >> reporter: 16 boy scouts from wisconsin traveling on the train also jumped into action helping

administer first aid to victims. >> we had one young man who provided aid to the dump truck driver until he expired. they just were helping immobilize people on back boards and getting them out safely, anybody who was complaining of any sort of pain, helping load them into ambulances. >> reporter: it was not immediately clear why the dump truck, its wheels seen here after the crash, was on the tracks, but authorities say there are no crossing arms at that location, which is not unusual in rural areas. >> it's an uncontrolled crossbuck intersection on a gravel road so no lights, no orr: tsh simil rol tch cah lt three people dead after a train collided with a car at this crossing without signals or guardrails. back in missouri more than 40 people had to be hospitalized after the derailment.3 federal investigators will arrive today to determine what went wrong. the january 6th committee has abruptly scheduled its next

hearing for this afternoon. the panel says it will present recently obtained evidence. sources say former white house aide cassidy hutchinson is expected to testify possibly offering details about interactions between former president trump and chief of staff mark meadows. meanwhile, former trump attorney john eastman says the fbi has seized his cell phone, and he is now suing to get it back. >> the authority to seize all of my information in modern smartphones, that's access to all my private financial records. i'm an attorney. it's access to all my privileged communications. this stuff is what we used to call a general warrant that the british king issued to just go rummage through somebody's belongings to see if they could find evidence of some crime. >> eastman was a key figure in the alleged plan to use phony electors to overturn the 2020 election. abc newslive coverage of today's january 6th hearing begins at 1:00 p.m. eastern. now to the impact of the supreme court's abortion ruling. new legal battles are being

fought in several states, and some pharmacy chains are now limiting sales of emergency contraceptives because of surging demand. abc's derricke dennis has the latest. >> reporter: this morning, new fallout from the supreme court decision to overturn roe v. wade as the sudden change in health care becomes the focus of legal battles across the country. [ crowd chanting ] more than a dozen states had so-called trigger laws in place to immediately ban or limit abortion when roe was overturned. now judges in two of those states, utah and louisiana, have temporarily blocked the trigger law from taking effect saying, the states are unprepared for such a significant change. the judges granted temporary restraining orders requested by abortion rights activists allowing more time for the courts to hear challenges. >> we will get care to patients and get patients to care. we have to fight state by state now in order to make sure that people can get that. >> reporter: in california voters will decide the issue this fall after governor gavin placing the right to an abortion

on the ballot in november. meanwhile, the white house is downplaying calls to build abortion clinics on federal land. vice president kamala harris says, the administration is not discussing the idea. >> i think that what is most important right now is that we ensure that the restrictions that the states are trying to put up that would prohibit a woman from exercising what we still maintain is her right, that we do everything we can to empower women to not only seek but to receive the care where it is available. >> reporter: and now pharmacies nationwide are placing limits on the emergency contraceptive known as plan b, the over-the-counter drug is different than the abortion pill prescribed by doctors. cvs, walmart and rite aid are capping the number of plan b pills a customer can buy as demand surges in the wake of the supreme court ruling. and back to the restrictions on abortion, even though trigger laws in two states are on pause, seven other states are now enforcing bans with few

exceptions, and 18 others are expected to follow. derricke dennis, abc news, new york. >> thank you, derricke. the supreme court has provided a major victory for public employees who want to practice their faith on the job. the court's conservative majority ruled monday that a now former high school football coach in washington state had the right to pray with players on the field after games. the justices said the school district wrongly punished the coach for a private religious observance. experts say the ruling does not open the door to wider teacher-led prayer in schools. another round of supreme court decisions is expected tomorrow. cases involving immigration and the power of the epa are still to come. leaders of the g7 summit in germany today issued a statement calling russia's missile attack on a shopping mall in ukraine a war crime. at least 18 people were reportedly killed in monday's bombing. abc's james longman is there. >> reporter: just look at the level of damage here. the air is thick with smoke, and

back now with video after a chlorine gas explosion at a port city in jordan. a crane loading containers holding the toxic chemical dropped one of them setting off the explosion. 13 people were killed. 250 others were injured. a nearby beach was evacuated and people in the surrounding area were told to stay indoors.

ghislaine maxwell, the longtime associate of convicted sex offender jeffrey epstein, is expected to be sentenced today. maxwell was convicted in december. prosecutors are asking for a prison sentence of at least 30 years. several accusers are expected to speak in court. britney spears' ex-husband has been ordered to stand trial on a stalking charge. jason alexander showed up uninvited at spears' wedding earlier this month. he allegedly tried to enter her bedroom. he and spears were childhood friends. their marriage lasted only 55 hours. an actress known for her roles in a string of hit tv shows has died. mary mara's credits include "e.r.," "law & order," "ray donovan" and many more. she apparently drowned while swimming in a river in upstate new york. police say there were no signs of foul play. she was just 61. major league baseball has handed out suspensions and fines to a dozen members of the angels and mariners all because of this
