behind an 18-month-old. approximately 40 injured survivors are still recovering this morning. police say the suspect confessed to the shooting during the fourth of july parade monday morning and now we know that he was on the verge of a second attack. jobina has the details. jobina: thank you. the suspected 21-year-old gunman in custody confessed to police he unleashed the hail of bullets from a rooftop during the town's fourth of july parade. his hopes of violence did not stop there. police say the man fled the chicago area and went to madison, wisconsin where he considered shooting another celebration. ultimately detectives say he decided against it. >> he seriously contemplated using the firearm he had in his vehicle to commit another shooting. indications are he had not put enough thought and research into it. jobina: the suspects father could also face charges because he sponsored his son's gun permit in 2020 which included the murder weapon he used. this was months after police confiscated his collection of

challenging to address. >> good morning we're talking about another variant, ba.4 and ba.5. according to the latest research, the ba.4 and ba.5 variants are four times more resistant than three vaccine doses than ba.2. the research conducted by columbia university finds these are now the dominant strains in the united states. in california, the state topped more than 9.5 million cases and there have been 4000 people hospitalized. infections remain below the january people at health experts say the entire bay area is considered at a high risk level for covid-19. last month, santa clara county health officials predicted a peak in the current search by the end of june but the latest numbers show a seven-day positivity rate of 15%. >> i think the simple answer is we do not know. the main reason why is we have these additional subvariants

help of two friends, edwin perez and donio solarzono. sadly they lost their lives on the delta. >> for us, they are our heroes because they do not think about nothing else about the little boy. j.r.: emergency crews for multiple counties including san francisco recover the three men's bodies tuesday. figaro said revis had gone fishing with two of his grandsons along with perez and solarzono. as the three adult were fishing, one of the grandsons jumped in the water and suddenly began drowning. that is when the three jumped in. the boy survived along with two others in the area who helped with the rescue. revis, perez, and solarzono didn't make it. figaro said the three were lifelong friends from guatemala who loved soccer. revis, who had lived in the area

for 30 plus years, coached soccer in west oakland. >> real sad because i know these guys and they always tried to help the community, tried to keep the kids out of trouble. j.r.: while the current may not look rough, the delta is where multiple waterways come together which can make for strong currents in certain spots. figaro is urging caution. >> if you guys are going to take your kids to the water, be real -- use lifejackets. j.r.: figaro tells me the boy here and two other survivors are having trouble sleeping at night. he also says revis; family is trying to raise money to send the bodies to what a mullah. there is a huge soccer fundraiser set for this sunday. the park in west oakland at noon -- sunday for the park in west oakland at noon. j.r. stone, abc 7 news. kumasi: crews made significant progress against the elector fires in calla dora and

reggie: a bay area couple barely dodged a bullet and you are about to see the moment gunfire went to their car. the shooting happened last month interstate 580 as this couple enter the freeway off of grand avenue. they were not hurt but as you can imagine, it was a terrifying

experience. leslie brinkley spoke with them. leslie: 5:00 p.m. june 14. >> honey, are you ok? they just shot through our window. are you ok? >> i'm fine, yeah. >> we need to call the police. leslie: leaving for work, garrett mason and fiance, tina doak, found themselves in the middle of a shoot out as a vehicle cut them off as another tailbone. >> may be within 15 seconds of being on the freeway, the first vehicle shot backwards at the second vehicle which we happened to be lined up with along the freeway. >> i heard a few rounds at that point and when it the windshield, i thought it was a rock so i did not know it was a bullet at all. i was literally feeling my body, making sure nothing else was hurt. for us, it is like we have minor fractures. leslie: police told them freeway shootings were not uncommon.

more than 80 freeway shootings in the bay area in the last four years. >> really the only rare part of the scenario was the fact the bullet went right past her face. >> they processed what happened for two weeks and posted on instagram which blew up overnight. they recovered their insurance dockable through a gofundme and took it down. >> [indiscernible] so it's like my family is all here and hearing the story not too long ago about the two-year-old boy is just now it is like personally hit me, i don't want it to affect anyone else. it's disappointing it is happening in our hometown. >> unfortunately we were the wrong place at the wrong time. >> also look at the right time. >> people have commented, rights. if we were a second faster or slower and our car, how can that change with a bullet is? can't think too much about the what if's.

it is just where we are at. >> you can say we literally dodged a bullet. leslie: i'm leslie brinkley, abc 7 news. reggie: in the story, tina mentioned the little boy shot and killed area has name was chester -- jasper and he died weeks before his second birthday. it was a saturday afternoon and he was in his car seat in the back of his mother's car when a stray bullet struck him. it happened southbound 880 near 7th street in oakland. that case remains unsolved. the same thing goes for dozens of other freeway shootings. our team dug into how frequently the use of shootings happen and what is being done to protect drivers. you will find that story on our website, abc7news.com. kumasi: time is 5:15. this morning, president joe biden is admitting democrats simile do not have enough votes to change the filibuster to bolster the u.s. abortion rights. according to the chronicle, dianne feinstein up supports --

feinstein supports the rights but stop short of filibustering. it allows a minority of 40 senate members to block votes on legislation. there have been widespread calls from democrats and others to remove that rule in the wake of the supreme court overturning roe v. wade. reggie: there are fears same-sex marriage may be banned once again in california after the overturning of roe v. wade. it is all because of prop 8, the same-sex marriage band that was approved by voters in 2008, struck down by a judge in 2010. it remains in the state constitution and can only be removed with voter approval. now, many are worried if this a prima court overturns marriage equality, prop 8 could become the law of the land once again. >> the very fact the supreme court of the united states is looking at this again means that that lower 2000 10 decision could be revisited.

reggie: to combat that issue, members of the states lgbtq caucus are now pushing for a ballot measure to have voters officially remove prop 8 from the states constitution. kumasi: a congressional delegation is in yosemite to understand the impact of climate change. the national department is one of hundreds that have been impacted by warming temperatures and drought. eight legislatures including those from california are touring with park managers and researchers. leaders tell the chronicle they want to learn how to persuade congress into bipartisan changes. reggie: a southwest flight attendant took the preflight safety instructions to a new level. here is his presentation. >> wrap the strap around her waist, buckle in the front, and pull to tighten. process up to 10,000 tests per week. that doubles the current capacity. kumasi: a pilot program is in the works for san francisco to divert 911 calls from police to community workers. the compassionate alternative response team will be responding to those 911 and 311 calls. those are nonemergency requests for other city services related to homelessness that are low priority and do not pose a threat. the estimated yearly budget is $6.8 million with the program up to a year away from launching. reggie: brittney griner's drug trial resumes on a rush of this morning. she has been detained since february. now the white house is facing criticism after president biden called her wife. and when has that.
