i walked on these streets at night. cornell: many were shocked to hear about a rare crime. police say sunday morning a man was found lying in the middle of keller street after being assaulted. he was pronounced dead at the scene. >> early this morning, 1:40 9 a.m., we got a call of a possible fight downtown. the person said his friend had been struck by a baseball bat. cornell: police do not know what led up to the assault, >> a suspect is at large. >> no one was seen running away on foot so we think the suspect fled in a vehicle. we do not have a vehicle description. cornell: relatives learning the terrible news at the police station. >> my condolences to the family and sadness for my community, that we deal with more and more of this kind of interpersonal violence. cornell: this crime is more shocking considering the last homicide was back in the summer

of 2017. >> i think it is shocking. i mean, we have liquor for almost five years and really low crime -- we have lived here for five years. cornell: police believed the victim and attacker may have come from a local bar or nightclub. >> the bars are all getting out. in the past we usually have some type of disturbance. it is somehow related to that. >> it could happen to anybody and that makes me more uneasy about being down here. cornell: police are looking for surveillance video from downtown businesses, which could provide clues about the crime and suspects. cornell barnard, abc7news. dion: the victim's name has not been released. orth found highway 101 is now open or than 12 hours ahead of schedule. caltrans closed two lanes between the robin williams tunnel and rodeo avenue this weekend. crews were making repairs to a drainage system. the lanes were scheduled to remain closed until 7:00 a.m.

tomorrow, but the good news is crews finished earlier and everything is back open. now to the california wildfire season. taking aim at the yosemite valley. the walsh burn fire increased in size overnight and the intense fire zone is near the historic community and yosemite. the southern entrance on highway 41 is closed. nearly 1600 acres have burned, a four hundred acre jump since last night. containment is at 0%. fire officials say the fire was active overnight and is difficult. mariposa grove edits giant socorro's -- sequoias is closed. >> afraid for the people of the town and heartbroken about the trees. >> pretty scary and we are going full force on our suppression tactics. dion: all other areas of yosemite are open, but visitors are warned to expect smoky conditions.

the marin county fire department as fire season heats up, the marine independent journal reports the department is doubling crews thanks to a boosted budget. annual funding will increase to 13 million for the next fiscal year and that money will allow the department to increase its crews to four teams of 14 to 16 firefighters. do not forget, you can always see a wildfire, all of them in california by using our online interactive wildfire tracker. you will find it all at abc7news.com. new at 6:00, teens in the east bay are making their voices heard in the fight for abortion rights. >> to have the city of palomino declare a proclamation to become a sanctuary city for people in need for an abortion or any other reproductive medical needs or services. dion: members of the social justice organization at youth activists for alameda held a march at city hall to protest of

the recent supreme court decision to overturn roe v. wade. among their demands, they are calling on the city of alameda to build a reproductive health care facility, so those in need of services do not have to drive to neighboring cities to help meanwhile, today president biden said he has asked his administration to consider whether he has the authority to declare an abortion related public health emergency. the january 6 committee will hold its final two scheduled hearings this week. the first will include video testimony from former president trump's white house counsel. abc news reporter alex presha has a preview. alex: for the first time the public is expected to hear from former president trump's white house counsel pat cipollone. the witness spent eight hours to begin with lawmakers behind closed doors. sip ohlone, who was with then president trump during the assault on the capital, was repeatedly mentioned during testimony by cassidy hutchinson, a former aide to the president's chief mark meadows.

>> mr. cipollone said something to the effect of make sure that we do not go up to the capital, cassidy. keep in touch with me. we are going to get charges with every crime imaginable, if we make that movement happen. alex: on abc's this week, adam kinzinger who sits on the committee says cipollone these testimony did not contradict that of other witnesses. >> you will see over the next couple hearings a little of what he said, certainly you will see a lot of that in the report. but at no point was there any contradiction of what anybody said. alex: when asked about a washington post report that former president trump is considering waving his claim to executive prison for his former strategist bannon, the committee welcomes anybody who did not testify before. >> anybody who wants to come and knows information to talk to the select committee, we welcome them to do so. we welcome them to do so under oath. alex: abc news obtaining a letter to the january 6 committee, where he says mr. bannon is willing to and indeed

prefers to testify at your public hearing. meanwhile, wyoming congresswoman liz cheney, who serves as vice chair of the committee says that the hearings will give the public a chance to hear how the former president sent a violent mob to the capital and tried to -- failed to immediately stop the violence. she is also promising an account of the attack on several white house trump officials. alex, abc news washington. dion: abc news will provide live coverage of the january 6 hearings on tuesday and thursday. twitter has hired a law firm to lead the company's battle with elon musk over the billion dollars sale that it seems is not happening now. bloomberg news reports the social media giant has hired a firm that specializes in business mergers. it is in response to elon musk sec filing on monday to try to dump his $44 billion bid to take over twitter. elon musk claims the company has not given him enough information about the company in dealings.

dion: a husband and wife are in critical condition after being hit by a car in berkeley last night. police say the couple was crossing the street in the crosswalk at mlk and addison when a toyota corolla ran into them. a 76-year-old man and his 74-year-old wife suffered head injuries. the driver is described as a 78-year-old woman from emeryville. she stayed at the scene and is cooperating with investigators. police say she did not show any signs of drug or alcohol impairment. check this out, some scary moments on a spirit airline flight from tampa to atlanta. spirit says one of the brakes and the landing gear overheated, causing a fire. flames and black smoke could be seen. the plane was towed to the gate

and no one was hurt. now to the roads and gas prices. the national average has gone down $.13 in the last week and $.30 in the last month. the national average for a gallon of regular gas is $6.48. -- four dollars 68 cents, i'm getting my california and national ones mixed up. california's averages down to six dollars and nine cents. $.15 less than it was last week. san francisco's average prices are down $.22 in a week. several services will be more expensive when the post office opens tomorrow. a forever stamp will cost $.60, up two cents. and everything from postcards to certified mail to money orders will also cost more. the postal service says its rate hike amounts to about six point 5% of an increase across the board. right coming out to chris alvarez with a preview of sports. chris: coming up in sports, the giants in san diego and playoff pressure in tahoe.

office this weekend. the latest film in the marvel cinematic universe made more than $140 million and counting here in the u.s.. it is already made more than 300 million dollars worldwide so far for disney, the parent company of both marvel and abc 7. all right, i am thinking about a good line not too long ago that the prices of gas and stamps are going up. >> they are going down, but temperatures are going up. oh yeah, way up and fact. check out the 24 hour temperature change and you can see why weather is a big story today. it is 13 degrees warmer, excuse me. i inhaled the wrong way i guess. 13 degrees warmer than this time yesterday. san francisco, nine degrees warmer, nevada, warmer. it's warmer everywhere. is going to be warm tomorrow as well. it got a nice robust onshore flow now. wind in san francisco at the surface, 27 miles per hour, but the cooling influence of those winds is being out near the coastline. it is still warm inland.

here is the view from mount tam showing the search of fog out over the bay and pushing inland already. still it is 75 degrees in san francisco, 80 palo alto, 86 san jose, santa clara 88. looking out over san francisco, this is a much clearer view than we had the previous shot. 93 degrees. 85, 96 at fairfield, 93 apiece at conway and livermore. at the golden gate, you can see the effect of the fog right now. these are our forecast future. fog will expend overnight, drizzle or the coast of the bay in the early morning hours. hot inland again tomorrow, but we expect a refreshingly cooler pattern around the middle of the week. here is what we can expect overnight, looking at the forecast. surge of low clouds and fog across the bay. 5:00 as the morning commute gets underwear, there will be lingering fog and perhaps a damp spots on the roadway as we

expect spotty drizzle with this pattern. it will go back to the coastline quickly tomorrow as it did today and we will have a rapid warm up in the afternoon. overnight, it is going to be relatively mild, maybe even uncomfortably mild in some places as more temperatures drop into the upper 50's to low 60's, generally upper 60's in some spots like antioch. then tomorrow, that heat is on again. we will see mid-60's at the coast, not warm but right around the bay shoreline, look or low to mid 80's. inland areas like fairfield and antioch will heat up to 90 degrees in the far north look for triple digits. 105 and 103. so it is going to be pretty hot in inland areas tomorrow, but that will be the final day of this current little spike. look at the cooldown on tuesday and wednesday, upper 80's inland. mid 70's around the bay shoreline. that will be a sharp cooldown. we will see some minor warming on thursday and then into the end of the week and weekend, only around 90 degrees. mid 70's around the bay
