marin, contra costa, alameda, santa clara and solano counties are all reporting steady increases in new emissions -- admissions. thankfully not in icu admissions. >> they seem to cause a much less severe disease than early variants. >> the question is, could that change if you are infected with both strains? >> you can be infected with more than one virus, for any disease. that's possible. it may happen. but i suspect it is a rare occurrence. >> what is not a rare occurrence is how likely each new omicron subvariant lee to break new infections. that is according to a recent study published by the new england journal of medicine. researchers found anybody levels were lower against the original omicron variant. now, our 20 fold lower against both ba.4 and ba.5. that puts it in perspective. larry: that is a concern. let's talk about reinfection

possibilities. what we know about the potential for symptoms to worsen, the more you get this virus? >> it's a question that is concerning. there is some preliminary data being looked at, that suggests the more you are infected, the more chronic symptoms you could have. it is too early to know for certain, but if moore comes out to prove that, dr. say, it may be time another booster shot will become available for people under 50. we know the white house is pushing to develop a plan for that. larry: thank you so much. here is the latest snapshot of coronavirus activity in california. from date of the state released today for the first time in the months, the test positivity rate didn't down -- went down, only slightly but could hit a plateau. new cases appear to be at a plateau, with a number of covid patients in the hospital that is rising. ama: firefighters from across the country are rushing to yosemite national park to help battle the washburn fire. it burned more than 32 acres and is 22% contained.

it is burning in portions of mariposa grove, where there are more than 500 giant sequoias. the trees are secure, at least for now. 1600 people remain evacuated from the small community. the cause of the fires under investigation. fire officials say that since there was no lightning when it darted, it is assumed -- started, it is assumed it was human caused. let's bring in our news meteorologist. larry: any air quality concerns right now? >> we have air quality concerns but it is only for contra costa county it is not from the washburn fire i will explain in a moment. let's look at the visible satellite picture, washburn fire sending a plume of smoke to the south lake tahoe area. you notice the shift is more northward, out of the bay area. moderate air quality for yosemite there are part of the sierra foothills that are in the moderate to poor category, here locally we have moderate her quality -- air quality.

but the concern is even of the washburn fire smoke stays out of the bay area and is mainly over eastern california, the air district is concerned as the sea breeze drops off overnight, that the marsh fire and pollution from that smoke could lead to higher pollution levels from that. and air quality advisors up before eastern contra costa county not just today, but tomorrow as well. the forecast is for good air quality for the entire bear area. it is during that -- the overnight hours that there is concern. larry: we will see you in a few minutes with the seven-day forecast. new, contra costa sheriffs office says it has arrested this man, and connection to three sexual assaults. is accused of two rapes in 2017 and attempted rate in 2020. owens is charged with multiple felonies, currently being held on $8 million bond. detectives believe there may be additional victims. only on abc seven news, new

details about the injuries of celebratory gunfire after the a's game on july 4. oakland police and the mayor's office said six people were hit i bullet fragments but that is not what one victims x-ray shows. our news anchor has a story. -- the story. >> all kevins daughter wanted on july 4 was to be at the oakland a's game and watch the fireworks. >> it was a wonderful game. ♪ >> the song, celebrate, even played in the background, after the a's win against toronto. >> the mood before the incident was wonderful. it was festive. it was celebratory. was a wonderful experience up until that point. >> that point came after the fireworks began. >> she immediately screamed and yelled, i am hit. we didn't know what it was. you could see blood. i could see the pain that she was going through. >> kevins daughter who requested we not use her name was one of six people.

oakland police chief said was had by celebratory gunfire from up to a mile away. >> these appear to be bullet fragments that may have come from guns being fired in another location. >> the term fragments also used by the mayor, following the incident. >> it seems intentionally designed to minimize the seriousness of what happens in that area on a regular basis. >> i spoke with the veteran firearms expert who tells me this is not fragments, is a complete bullet, most likely from an ak-47. i asked oakland police about the disparity and the messaging, and kevins daughters x-ray. they responded, saying initially, bullet fragments were believed to cause all of the victim's injuries. upon further medical treatment, it was discovered to some of the victims were by full rounds, consistent with celebratory gunfire. they did not elaborate on how many other victims were hit by bullets. the mayor's office requested we

daily harvest ever called her to warn her or other consumers. >> on june 17, daily harvest emailed customers including the client who asked would not share her name elaine email with the subject line -- in an email, which said please read, important information about your lentils crumble. a small number of customers reported gastrointestinal discomfort. lentils must be thoroughly cooked. please dispose of any french lentil and leak crumbles. do not eat them. the client says she missed the emailer from her hospital room on june 29, recorded this conversation with daily harvest. >> when i went back to my emails, i did see it. but it was -- it was one of the emails he would just delete. >> she says the daily harvest called the client after the daughter requested a call from the company. >> they talk to me about transferring me to liver manhattan, for liver transplant.

larry: we are working to build a better bay area, an obvious place to improve is the tenderloin. san francisco's new district attorney toward the neighborhood. she says she is committed to cleaning it up and stop the open-air drug markets. our reporter tells us what jenkins plans to do to get things under control. >> san francisco is one of the richest cities in the world, but on the side of the road in the tenderloin and that wealth seems a million miles away. >> i've committed to them just like i did the entire city, to making sure that we end these open-air drug markets, that would clear the streets. >> on tuesday, san francisco's new district attorney toward the tenderloin and met with neighborhood leaders before speaking with the media. i asked her what her plan was for cleaning up streets like this one. jenkins says her first step is to try and get the dealers, especially those who are repeat offenders, off the streets. >> i want to know what types of offers are on the table, on the cases that are currently in our office, so we can craft a policy that promotes more

accountability. >> a lot of people say the d.a. can only do so much and the police department will have to play a big role in stopping the open-air drug markets. >> you have to send a message to the police that aching arrests will have a value because you will prosecute. >> even making those arrests can be difficult. on another street corner, we saw one officer get out of his patrol car and walk around the block. while several people hurried away after seeing him, others simply waited around until he presumably asked them to move. randy shaw, the director of the tenderloin housing clinic says while addressing the dealers is key, public officials also need to figure out what to do with drug users, especially those who refuse services. >> that is the question the city has to ask. i would say you don't let them set out on the sidewalk in a public street, just like you would not let them be on union street, you would not let them be on eddie street. ama: top san francisco officials say they will fight drug dealers

actively giving him cpr. my first response was to beach my boat, and render it with what i could. reporter: he did not survive. the third person to drown out the popular bay area lake in the last two weeks with 11 drownings here since 2020. most of them and oh shores, where there are racks of life jackets available for free public use. the napa sheriff's department said the lake is deeper than people realize the sharp drop off. his family hopes to talk with her friends were with him the day he drowned. they have set up a gofundme to raise money for his funeral. >> for us to lose him, it is heartbreaking. >> at this point, we just need answers. so i can do right by my son. that's it. i just want closure. larry: it's so hard for his

family. investors of a high-stakes deal introduced to them by attractive women, feared they may have been built out of hundreds of thousands, maybe even millions of dollars. michael finney has been tracking the story, joining us with the investigation. this is interesting. >> it is. it's bigger than what we all think. the federal trade commission warned about the potential fraud in the unregulated frontier of crypto. they have seen an uptick of complaints involving romance and crypto. kevin met a woman online in february, who reached out suddenly via direct message. >> she was very kind. and still to this day, she is still empathetic. >> he says their online relationship grew. but they have not met in person. kevin says that she mention on february 10, an investment opportunity in cryptocurrency. open the wallet and enter the mining pull she wrote, urging

kevin to invest with a site called -- he did just that and he said immediately it paid off. >> originally, it started at 2000, then he went up to 5000 a week later. >> so he invested more money. >> at $50,000 i was making a thousand dollars a day. >> he even borrowed $100,000 to invest from his mother. when he tried to cash out on some of his investments he ran into problems. your participating in a seven-day 100,000 u.s. dt pledge of the mining pull. you cannot withdraw during the pledge period, they told him. that was on march 5. in all he invested $225,000 and still is not been able to withdraws money. so, he filed a complaint with the fbi. approximately 225 k was removed from his crypto coin base wallet without consent. the ftc says it cannot comment on any current or potential

investigation. nor could a comment on any particular crypto platforms. but, it issued a report that put total losses for crypto related fraud, from january of last year through the first quarter of this year, and more than $1 billion. the senior data researcher says often times investors are led to believe there invest in's -- investments are growing, when in fact the website is take. -- fake. >> the website will be used for them to encouraged -- to encourage them to send more and more, until they realize they can't get it back. >> she is ceo of the investment form, -- firm, he says he invested in the website after meeting over an online who suggested it, who he still has not met. my account has been frozen with $1.2 million, they're trying to get me to send another $215,000 to release my funds.

he wrote in his complaint to the fbi. he says he has been investing in crypto for seven years. he checked out d 5 based, and found that it listed tom as an invest -- advisor to the company. he invested slowly, side build up, was able to withdraw funds, so he invested even more money. >> then i started putting clients with my investment firm that i have into it, then that is when the rope was pulled. a lot of funds were compromised. >> he would later find out, it was not part of d5 base, his name and image were used without his consent. we caught up with him recently, while he was vacationing. >> since i have nothing to do with it, and makes me feel frustrated because i can't stop it. i don't like being associated with people getting ripped off. >> he has filed a complaint with the fbi but says he is not heard back. he says he has not found a way to contact the base directly. the contact button on their website is not functioning, but

that -- but for now is giving her the benefit of the doubt. >> she is trying to help me get the funds out of this mining pull by loaning me the money. he thinks he understands what kevin is thinking. >> i have a real relationship, the caring relationship. because of that, people's brains move over from the logical thinking brain into that fast acting and very emotional side of their brain. >> the fbi would not comment but the ftc has this warning. >> someone that you have met online in a romantic situation is giving you investment advice that is a big red flag. >> we reached out to all of those listed, as advisors, with d5 -- defi base. all of the names are being used without permission. we also saw websites under different company names in different urls, again listing the others as advisors with the
