to massive waves in hawaii. plus, what we're learning about j. lo and ben's big wedding. and the interrupting emu. >> good monday morning, everyone. we begin with another mass shooting in america but this time a civilian took action to stop the attack. >> police say that civilian who was armed was a witness who shot and killed the gunman inthe mall in indiana but sadly, lives were already lost. >> reporter: this morning a good samaritan with a gun is being hailed a hero for ending a deadly mass shooting at this mall near indianapolis. police say the suspect had a rifle and several magazines of

ammunition. >> a mass casualty. >> next we know, we hear four gunshots. i looked at my mom. what in the world is that sound? next thing, bang, bang, bang about six time. >> reporter: in the end, three people were kill at the greenwood park mall before that armed civilian killed the shooter. images show the chaos during the shooting as police tried to figure out what they were dealing with. >> store employees helping customers flee for their lives. >> i was really, really scared. i wanted to close the gate. people kept running at me. >> reporter: that mom of three said she wanted to get home to her kids. in addition to the three victims killed, two others including a 12-year-old girl were injured. >> this has shaken us to our core. >> reporter: police overnight saying the good samaritan is 22

years old and was legally carrying a gun. >> the real hero of the day is the citizen lawfully carrying a firearm in that food court and was able to stop the shooter almost as soon as he began. >> reporter: there was no word overnight on the shooter's motive or identity. we are expected to learn more later today. as for that 12-year-old girl, she is expected to be okay. abc news, new york. the other big story this morning, the new report slamming the police response to the school shooting in uvalde, texas. investigators are det what they call systemic failures, and body camera video was released overnight. one officer can be heard saying, we've got to get in there. some viewers may find these images disturbing. >> reporter: new. this morning new border cam video is providing a look at the police response to the uvalde school shooting rampage.

the camera worn by uvalde police officer eduardo canales shows them arriving minutes after the gunman made it inside the adjoining classrooms where 19 students and two teachers were killed. he and the officers draw back when they take gunfire from the suspect. >> am i bleeding? >> reporter: injured by shrapnel then tells the other officers they have to go in. sgr we've got to get in there. we've got the get in there. he's shooting. we've got to get in there. >> reporter: another officer can be heard saying the department of public safety is sending people. his camera captures the voice of ruben ruiz whose wife was one of the teachers killed in the shooting. the video was released on the same day a skateding new report was published which found the officers took a lackadaisical approach when they arrived at robb elementary school sglxt if there is only one thing i can tell you, there were multiple

systemic failures. >> reporter: a preliminary report by a texas house xhoe found law enforcement responders failed to react to their training and they failed to prioritize saving the lives of innocent victims over their own safety. surveillance video shows law enforcement positioning themselves outside the classroom for more than an hour. committee members said they do not know whether a faster response could have saved lives but the report added, it was possible some victims could have survived if they had not wait 73 additional minutes for rescue. >> several officers in that hallway or. in building knew or should have known there was dying in that classroom. they should have done more, acted with urgency. >> reporter: the report blames no clear leadership among the 376 law enforcement officers who responded. including 149 border patrol officers, 91 state police officers, 25 uvalde officers, 16

sheriff's deputies and five members of the school district police force under chief pete arredondo. the committee found misinformation at the scene contributed to the disk. many officers were told to stay out because chief arredondo was not side the room actively negotiating with the shooter. still, they said someone should have stepped up to the task. >> there were multiple opportunities to at least ask for questions or offer their guidelines to try to remedy the chaotic situation and make sure there was effective overall command. >> reporter: a possible motive was revealed in the report. the shooter was a former student at the school. he attended fourth grade inside room 111 where the shooting took place, and according to his former teacher, had been bullied. the report found none of the school's three exterior doors was locked and the school's emergency response system was delayed because of wi-fi issues. meanwhile the acting police chief has been placed on leave. in a few hours, the death

penalty trial for the parkland florida school shooter begins. the 23-year-old pleaded guilty last october to the attack at marjorie stoneman douglas high school in 2018. if they don't receive a verdict, the sentence will be life without parole. four people have died after two planes collided in north las vegas. the authorities say one of the planes was preparing to land when it slammed into a second plane. federal investigators are now trying to determine what went wrong. >> one of former president trump's closest advisers, steve bannon, goes on trial today. he's charged with contempt of congress and his trial come as the january 6th committee prepares for a prime time hearing this week. ann is in washington. good morning. >> reporter: after months of defying the subpoena, steve bannon is getting his day in

court. this morning jury selection begins in the high profile trial of steve bannon. the former trump strategist is facing criminal contempt charges for refusing to comply with the house committee investigation into the january 6th assault on the capitol. he said this on his podcast on january 5th. >> all hell will break loose tomorrow. >> reporter: he cite executive privilege for not complying with the subpoena even though he had stopped working for the white house years earlier. accept he would be taking on the biden regime. this will be hell. >> reporter: bannon reversed course last week saying he's willing to testify after trump gave him the green light. he said his new offer would not change it. meanwhile the january 6th

committee is now turning its attention to the secret service and text messages from january 5 and 6 that were deleted. >> it is quite crazy that the secret service would end up deleting anything related to one of the more infamous days in american history. >> reporter: the secret service said it is cooperating and said the insinuation that text messages were maliciously deleted is false. the committee expects to obtain those deleted messages by tomorrow and present the evidence thursday during a pram time hearing. >> that's crazy. i don't know that would be. we need to get this information to get the full picture. >> back to steve bannon, the "washington post" reports prosecutors expect to take just one day to trent their case. if found guilty, he faces up to two years in prison. the u.k. is expecting its hottest day on record today while extreme heat fuels dozens of wildfires in both france and spain.

two large fires in france have burned more than 40 square miles, forcing thousands of people to evacuate. the heat is being blamed for more than 1,000 deaths in spain and portugal where the drought is blamed on climate change. >> time for a look at your monday weather. thunderstorms and heavy rain are expected across much of the u.s. today. severe storms are possible in the northern plains this afternoon. the big story is that dangerous heat from the dakotas to the gulf coast and all the way to. today. dallas could approach a record of 110 degrees today. salt lake city hit 107 yesterday. checking the high temperatures elsewhere, 80s in the northeast. a heat wave is expected there later this week. mid 70s and low 80s for the pacific northwest. coming up, not so fast.

been fired for treason. president zelenskyy removed and replaced the security chief and prosecutor general. he says dozens of officials working for the men were actually working against ukraine in russian occupied territories, raising questions about their leadership. 50,000 russian soldiers have been killed or wounded. that's 30% of the ground force for the entire russian military. and preparing for a price surge this fall. the potential price increase, as soon as possibly october, would be tied to stricter sanctions on russian oil. it has democrats nervous ahead of the mid-terms. a top white house adviser says a lot of factors could change by then. >> nobody can see around the corner. really, don't pay a lot of

attention to those forecasts. it's too much volatility. he also expects gas prices to keep falling through the end of the month. meanwhile, millions of dollars worth of jewelry and jams are missing after an armored truck heist. the merchandise was being taken to an exhibit in pasadena. a security company says the jewels are worth less than $10 million. the exhibition company claims they're worth up to $100 million. they were being transported from an event hosted by the international gem and jewelry show. a different jewel heist did not go as planned. police near milwaukee are searching for this would be thief who tried and failed to break the glass display in the jewelry store with a brick. he made several attempts before he was chased away by a worker. coming up, no laughing matter. a big scare for one of the stars. office. and a firefighter in ever wonder what everyone's doing on their phones?

this intersection. a small plane landed in the road on san marcos, then hit an suv, two people in the vehicle suffered minor injuries, a camera inside the tesla recorded the incident. the crash is under investigation. and we have another close call to show you, this time involving a new york firefighter, fortunately he's okay this morning. a terrifying moment in new york city after an suv toppled over crushing a firefighter's leg. the owners of this white volvo were stopped at a light when out of nowhere they said this black suv ended up on top of them. >> it was a terrible, terrible loud crash. >> reporter: bystanders were able to help the volvo passengers get out safely but getting the passengers out of that tilted suv risked toppling the vehicle over. >> i told them whatever you do don't get out through the passenger side. >> reporter: as firefighters tried to help the passengers out of the suv, the driver hits the gas sending the vehicle on to its side and on to the outstretched leg of the firefighter.
