body. >> lodi police say they received a report from the funeral home on july 16 that a fetus was missing from storage. after reviewing security video, they determined a transport service contractor had disposed of in item containing the remains into a waste container two weeks prior. the couple say they saw the video and described a man removing a bag of their daughters remains from a cradle in cords -- in cold storage, dropping it on the floor before retrieving it again. >> he grabbed the bag. kept on swinging at and shaking it knowing the baby was there. and then, -- >> shaking it just like that. after that, he walked around. took her out of the

cradle. through it in the trashcan. >> the funeral home says it cannot provide details due to the sensitive nature of what happened but they did send a statement saying in part we are working closely with family, law enforcement and others involved to investigate the incident and resolve the issue quickly. police say the people in the video have you contacted and the case is being forwarded to the san joaquin district attorneys office to determine if criminal charges could be filed. right now, the parents are still working through their grief. reading a poem he wrote for emily on a, he says he only wanted the best for their daughter even after death. >> we hope that she knows we love her. >> the body could not be retrieved because all waste containers at the funeral home had been taken by a collection

this hotel while the building got fixed. >> if they don't help us, i don't know what is going to happen to >> the real estate management firm that owns the building sent a letter to all tenants letting them know after august 17, they will no longer be responsible for their temporary housing. among those residents are 60 low income tenants. she is one of them. she was diagnosed with stage four breast cancer last year. she said the uncertainty with her housing is impacting her health. >> i hope they get us a place so we don't have to go through this anymore. this is very stressful. >> we spoke to the senior management director who said repairs are taking longer than anticipated. >> the elevators are not occupy a book because all the surroundings of the elevator shafts got wet and are growing mold so we have to replace all of the drywall.

>> the supervisor is requesting the city attorney office investigate what happened and whether the ownership has met and is continuing to meet legal obligations for displacing tenants. there are so many questions circling around specifically from the supervisor saying there needs to be a thorough investigation of what took place in the building. what took place? >> we do not know. we are analyzing all the pieces of equipment and doing a full investigation. we want to understand how this happened so it never happens again but we do not know at this point. >> they said what they are doing is legal. >> we made sure we got legal help to make sure we were following the law. >> this resident is hoping they help her with housing passed august 17 trip >> i need stability. i do not know how long i got to live. i got cancer in my bones.

this is really stressful for me. to the records, they have had 31 move outs and 22 people are scheduled to move in the upcoming weeks. they will give everyone their security deposit. as for the 60 low income residents, they are working with the city to relocate those tenants. >> 17 lawmakers were arrested today during a protest outside the supreme court calling for abortion rights. among those arrested were bay area lawmakers jackie spear and barbara lee. 35 people were arrested for crowding, obstructing or causing a disturbance. joining us now is congresswoman jackie spear. you went out there today knowing you might get arrested and you did. why did you do it? >> i did it and actually this is the first time i have been arrested. i did it because so much is at stake.

i cannot fathom that we are going to endure what we are already seeing happening around the country and states that have and abortions where women are having ectopic pregnancies that are not being well with. there is a reluctance to do a dnc, which happens at the time of the miscarriage. it also happens when you have an abortion. there are professionals who unwilling -- who are unwilling to do a dnc. i have had miscarriages i have also had an abortion. i had the ability to control my body in conjunction with my family and physician. i worry for my daughter because she has less rights than i do now. it is incumbent on me to protest. to do so in a civil disobedience, a nonviolent way. that is how most great changes in our country have taken place

whether it was rosa parks who would not relinquish her seat in bus or whether it is the suffragists who tied themselves or chained themselves to the fence at the white house. these are important issues. never in the history of our country has a right and taken away from the american people but that is what has happened with the decision of the supreme court. >> some abortion rights advocates have said the biden administration has not responded with enough urgency, with enough outrage or action. do you share some of that frustration? >> i certainly would appreciate it if the president and he is contemplating creating what is called a public health emergency should he has taken steps to make it clear medication abortion which is what is used in about 54% of all abortions which is taking two pills and
