sandhya: it has been windy since the fire broke out and it is still windy right now. relative humidity is 2%. the winds are gusting still out of the southwest to 37 miles per hour. windy pattern will remain through the night even going through tomorrow. hopefully, they can fully contain that fire. as you look at the wind election, it is generally out of the west-southwest. that has been transporting that smoke out near the tracy area. tracy has had some poor air quality but right now, it is ok. smoke was in the air from our east bay hills camera near the fire just as the sun was setting. i have an air quality advisory for another fire that has been burning for quite some time. a full look at the forecast coming right back up. dan: now to an abc 7 news exclusive i team investigation. on the same time daily harvest announced -- flower as the

>> i'm a really healthy person so it was really scary. >> she said she learned about daily harvest customers hospitalized and sickened with similar symptoms as hers. >> after the daily harvest story came out, i put two and two together. >> she said she connected with a handful of other super foods customers online who said they had similar experiences to hers. she also spoke to the fda and food attorney. he found a plant-based source of protein was an ingredient in daily harvest french until an leak crumbles. >> we have known for two weeks that the likely ingredient that was causing people to get sick was -- >> the flower is the cause of the issue. it has been investigation. they are working with the fda

and the flower producer to find out what made people sick. they have not named the producer , only that the company is no longer sourcing from this producer and that the flower was only used in its crumbles. meantime, revive super foods ceo says since it became aware of this ingredient as a potential hazard, it contacted regulatory authorities and removed the mango and pineapple smoothie from further sale on its website. the ceo says the company ran extensive testing for all major pathogens, toxins, and allergens, and all results have come back negative. our ingredient suppliers may differ, but we are taking no chances. we reached out for further clarity on what specifically is calling tara protein to be an issue. the statement falls short for halep. >> i don't think they even worn to their customers that --

about the products that are in people's freezers right now. >> they are utilizing all resources to get to the bottom of this. from the i team, abc 7 news. ama: congress is one step closer to enshrining same-sex marriage into federal law. tim johns joins us from the newsroom to explain why lgbtq plus advocates are not celebrating just yet. tim. tim: there are 47 republicans who joined democrats but it has to go to the senate where it faces a much tougher and more uncertain future. in the wake of the supreme court's historic decision to overturn roe v. wade, congress is taking steps to protect same-sex marriage. on tuesday, the democratic led house passed a bill that would make same-sex marriage a federal law. currently, it is only legal because of a supreme court decision, a ruling that lgbtq advocates worry could be at risk. >> clarence thomas wrote a

concurring opinion in which he issued his salvo and he was very clear about it. mckay says he thought had been wrongly decided in a way similar to roe v. wade. tim: the bill would need the support of at least 10 republicans and all democrats, and while that will be harder than getting votes in the house, it is something activists say needs to be done. >> is not going to solve every issue but it is a big one that represents a step towards those other issues that need to be addressed. >> carolyn weisinger is the president of sf pride. while many non-queer people might think same-sex marriage is a settled matter, others have had fears of their rights being taken away for years. she points to growing anti- gay rhetoric. >> you gain allies but you also gain a lot more steam from folks who thought they did not have an arena to spew hate so it's almost like a wash.

ama: oakland police are offering an award as they love to solve the mystery of a murder of a ride-share driver. two people in hoodies approach patrick's car in oakland on sunday. he was waiting outside his girlfriend's house, driving for uber. the suspects are heard telling patrick to get out. when he doesn't, a shot is fired. his growth and to abc 7 news. >> eve -- his girlfriend talked to abc 7 news. >> it is because it his hard-working trade that he got killed. ama: oakland police are calling this an attempted robbery.

police and crime stoppers teamed up to offer an award of $12,500. >> let's turn your attention to monkeypox as your health is a focus in our ongoing effort to build a better bay area. or people are now eligible to receive a monkeypox vaccine. the public health department has received 1600 doses today with the majority of those arriving just today. amanda del castillo has more on the expanding distribution effort. amanda: expanding monkeypox vaccine eligibility. promising news on tuesday. >> the supply is very tight in comparison to the need that we have but it's improving. amanda: improvement in the form of an added 886 doses of the vaccine. dr. george han says under the department's previous invitation-only distribution model, around 60 people have

already received it. >> with this new effort this week, we are hoping to get a lot more vaccines for people who may not have come into contact with someone they knew had monkeypox. >> almost anyone in the lgbt pew plus community can get -- lgbtq plus committee can get one. amanda: the criteria includes anyone who has attended the same event with a person contentious with monkeypox. and others within the lgbtq plus population at high risk. >> make sure the community stays safe, stays informed, knows the proper information. that way, we can prevent future outbreaks. amanda: reasons why the public health department is teaming up with local lgbtq plus organizations. >> the faster you get the word out, the faster you can get the vaccine to people. amanda: in san jose, gabrielle is gearing up for a thursday q&a with county health officials. >> it is a big deal.

when i said yes, you know, we can have a community forum. the question will be, where can we get the vaccine? amanda: the county says it's working on getting vaccine clinics online this week. depending on supply and logistics, they are looking to vaccinate up to 200 people at each site. in san jose, i am at, abc 7 news. dan: san francisco just received a new supply of monkeypox vaccine. a vaccination clinic will open tomorrow morning at 8:00 a.m. at zuckerberg san francisco general hospital. ama: the omicron ba.5 subvariant is now the dominant strain in the u.s. and accounts for 78% of cases nationwide according to federal data. the cdc has endorsed the novavax covid vaccine for american adults.

this means that there are now four vaccine options available in the u.s. the cdc has ended its covid-19 program for cruise ships. it allowed the public to monitor the spread of the virus in ships that sailed on u.s. waters. dan: new bodycam video is giving us a look at an incredible act of heroism in indiana when a good samaritan saved the lives of five people in under 15 minutes. nick bostic was driving to get gas last monday when he saw a house in flames and jumped into action. inside were an 18-year-old and four children. she was babysitting three of them. bostic off -- ushered four of them out of the house to safety. he held the girl in his arms and jumped out of the second-story window, breaking her fall and saving her life. >> the bottom of my hands are blistered. like i grabbed something hot.
