dan a.: thanks for joining us. the board of supervisors is taking action. the chief sent four investigators to raid the only garage that makes bat mobile replicas licensed by d.c. comics. ddan noyes is back with his exclusive investigation. dan n.: i have obtained some of the receipts for that trip funded by your public money. last week, i introduced you to realtor sam who ordered a $10,000 bat mobile from this indiana builder. he missed a payment and he couldn't reach him for more than eight months and moved the realtor from first position to the ninth customer in line.

they froze his account and charged him with two felonies. >> will now go to public comment. dan n.: the san mateo board got an earful from their constituents today. >> we heard nothing about the allegations of sheriffs being sent to another state to pretty much abuse power and bully a businessman when the matter could have been settled in civil court. >> the d.a. is supposed to pursue truth and justice irrespective of a person's wealth and status. >> this is unacceptable. it is embarrassing. it is humiliating when i get calls from my friends around the country asking what the heck is going on in san mateo? dan n.: they are looking to get answers from the sheriff's department. >> it is appropriate that the county look into this and give

a relationship. marquez says he was in a relationship with ramirez and until the news broke, he thought it was their child together. she is accused of passing off the baby for her own. she faces up to 14 years in prison, portillo faces up to five years. a prosecutor in this case tells us she was hoping for something more harsh. >> there were multiple attempts to kidnap this child, as well as other things that occurred that these individuals were looking to kidnap brand and there should have been an opportunity for us to have a sentencing hear where they could have been sentenced up to the maximum exposure. zach: you heard her mention that the suspects attempted to harm the family. a vehicle manipulation and they face a misdemeanor charge for that.

we pictures were given to ayala, baby brandon's mom. they have evidence that the suspects cut baby brandon's mom's brakes to her car. she noticed the brakes were severed as she was about to take the older daughter to school. they have enough evidence that backed that story up. we heard from the defense attorneys for ramirez and portillo, ramirez''s attorneying saying this is an opportunity to minimize the damage it caused on her life. portillo's attorney says he was the victim of being in love. they are to be sentenced on august 8. dan a.: let's move on to monkeypox. a fifth child tested positive. the newest patient lives in long beach and is the second pediatric case in our state.

it has been 4 hours since california declared a state of emergency. every county has at least once case and we're seeing count cases rise in some areas. san francisco has 386, about a third of all of the c the casese state. there are more than 70 cases initial meet da county, 55 in santa clara county. luz pena is in the newsroom to describe in more detail what state of emergency actually means. luz: it means california has more flexibility to respond. they can set up clinics like they did for covid-19. before we get to that point, there is still a need for more vaccine supply. it is a public health crisis that has now reached statewide intervention, behind new york and illinois, california became the third state to sound the alarm on monkeypox. >> we are declaring, loudly that we have an emergency here.

luz: what does the state of emergency actually change? we went to a state level to speak to matt haney. >> by declaring the state of emergency, we're telling the federal government, we need help, we need support. we're also putting the infrastructure, the personnel, the treatment resources and education resources in place, so that we're prepared to spond. luz: in other words, counties will be able to speed up efforts to tackle the outbreak. another key to this declaration, it opens the door for counties and cities to get a refund for their efforts. >> my hope is there is a reimbursement for expenses for monkeypox specifically. luz: just yesterday, san francisco state of emergency went into effect. hundreds waited in line at zuckerberg san francisco general hospital, many leaving without a vaccine. the state of emergency will allow more medical professionals to administer the vaccines, but

it doesn't mean that california will get any more vaccines. >> i'm very concerned. the cases are going to increase significantly before they start decreasing. luz: according to c.d.c. data, california is behind new york with the highest number of infections. infections, 827 cases. before governor newsom declared a state of emergency, the federal government was prioritizing places with the most cases. today, san francisco got a call. >> just today, i'm happy to share some news that san francisco was told that it will be getting over 10,000 doses this week of monkeypox vaccine. that's good news. that is more than double than what we have gotten in previous weeks, it is obviously not enough. luz: as part of california's state of emergency, now pharmacists will be able to vaccinate people for monkeypox, but again, supply is limited and the state is only giving the vaccine to local health gurs

now, i have been listening to this meeting on zoom, again, very heated. they just called a recess. this will end up being a stern warning to hsu that she cannot repeat the statements ever again. now, i want to also point out that in that meeting, the president of the board said the inability to learn is not the fault of the student or the parents, but that of the school district. well-known columnist herb cain said that san francisco is where the opinions clash. thrown in was school board hsu and likely will be reprimanded by her colleagues. >> people can say anything about you and it is ok. lyanne: the ncaap held a rally in front of the school asking for her resignation after hsu made racist comments about black

and brown parents. expect they did not ask allison collins to resign after her tweets describing anti-blackness among asian americans. he supported collin, but he, too, asked hsu to step down. phil has an explanation. >> san francisco has takennen a hit, the recall of a school board member and another recall and they are hurting. in san francisco politic, you hit and you hit back and this is a hit back. lyanne: the democratic party has been asking both collins and hsu to resign. >> as we both black and latino and api communities get pitted against each other. i think political environment has gotten too toxic, too

divisive. lyanne: nowhere is that more apparent than in the board of the supervisors. 10 of 11 board members said collins should resign, but only four of them asked the same of hsu or said they would not vote for her. >> the difference with ann, she harmed another community and she acknowledged something was wrong and she apologized and opened up dialogue to learn from this experience. lyanne: here is another likely reason for not going after hsu. >> the chinese americans swung their way in the recall of bow dean and they are now a force to be reckoned with. lyanne: what we heard, it is time for the group, it is time for the city and school board to focus more on educating students and outcomes rather than all of this adult bickering.

moving forward, finding solutions. this is abc7news. dan a.: the numbers don't lie. the san francisco police department is facing a major staffing shortage. ama: in a report a few months ago, the department was down 352 sworn officers and 133 civilian positions. in june, the department lost another 50 officers. the latest academy had just 12 graduates. how will we build a better bay area with fewer police? abc7news insider phil matier sat down with the police chief to find out. dan a.: you had a candid conversation, phil. phil: the conversation is bad and it is surfacing every day and night with a quarter of the staff is soon or now eligible for retirement. cops are leaving and they are not being replaced. it means longer shifts, fewer

cops in parts of the city, but more importantly, slower response times in critical situations. how many cops are you down now? >> around 500, 525, what we should have based on our staffing analysis. phil: so we have, 1,200 for the whole nine yards comes to how many a day, a shift? >> you're look at about 300 officers. phil: what effect does that have on policing? >> well, it definitely, devil is a strain to keep one the cost of service. it is a strain to keep up with the demand that our residents and community wants in the city. phil: a good number of those are assigned to the downtown because that is a high visibility area, right? >> that is a very high visibility and high-need area. when we say 300, the tenderloin station has over 100 officers.

they are not all working at the same time. phil: we have 100 at the tenderloin, residential station like park station out by golden gate park has something like, what, 40 officers? >> they have over 50, mid-50's. phil: that seems like a pretty big area for not too many cops. >> the car load and the park station are much different than the call load in the ender loin. phil: i understand that sometimes between midnight and 6:00, you are down to two squad cars. >> yes, and that has been challenging and we've been able to augment that with staffing overtime, so we have what we call backfill. phil: so, you have to work overtime. it is not mandatory. >> that is true. phil: traffic cops there is a problem with san francisco

traffic. do we have that many traffic cops left? >> we do. our traffic cops have dwindled from what it used to be. there was a time when there were 70-plus motorcycle officers, we call solos. it's hovering around the mid 40's and 50's now. phil: chief, as the number of police have dropped, what about the need? what about the calls and the need for services? we have side shows now. we didn't have that 10 years ago. we have the grab robberies, we have the free-form shoplifting. all of those things seem to be going up while the police numbers are going down. what is the effect? >> well, the effect is they are a strained police department and we can't be everywhere at all times. we have to do the best we can with what we have, but we also need to be efficient with our resources. you have a dwindling workforce with a call load that is going

up and a community demand, most community meetings i go to, people are demanding they see foot beat officers in their neighborhood, particularly the business corridors. the tourist areas, they want to see officers visible, because we don't want people going to our most popular sites in san francisco, whether they live here or visit here and have their cars broken into or get robbed. there is a high demand. phil: i understand in june, over 50 officers retired or left the department to go to other departments, how many came in? how many came in from the recruit classes? >> the recruit classes are small. one class had 13 officers, one had 19. we're getting anywhere from 25 to 30 in the academy and usually 80% of those make it there through academies. phil: if we had 20, 30, or 40 a

month leaving, for whatever reason and we're having 13 to 20 coming in, the math isn't in your favor. >> no, and that's what our basically one of our top prioritities, not only to hire, but to retain. that pace accelerated over the last two years in terms of more people leaving than we were bringing in. that is one of our top priorities so turn that around. phil: what is it in policing or catching the bad guys, whether that is someone who runs a red light or someone who shoots at someone? >> we try to get to the highest priority calls within eight minutes. when you don't have enough officers, and we do pretty good there, but when you don't have enough officers to respond to the call load, the response time

typically goes up. we have seen the response time tick up over the last few years. ama: phil, how will they ever be able to keep up with staffing demands with 25 people coming into the academy? phil: they have to recruit more. it is not just san francisco. we're seeing it in oakland, berkeley, and other bigger communities. it is everything from housing to commute times and the attitude of the public. when you go to the meetings, you're told that the police are overreacting, that they are brutal, people don't want to be a police officer anymore. you go to another meeting and they say they like the cops and they want more of them. it is tough to get people to take the jobs, and that is, you know, a tough thing. they have to sell the department and being a cop, because if not only san francisco, but the whole society will be suffering. if you don't have someone

keeping an eye on law enforcement, you don't have enforcement, if you don't have enforcement, you will have complete, more problems. dan a.: complex problem, but serious. thanks, phil. ama: the city of oakland is getting much needed funds to help battle gun violence. the city receive l re -- will re a $6 million grant to keep individuals from pulling the trigger. >> this grant is the first that i know of, in which the emphasis will be on working with individuals at the highest level of risk, and working with that individual's family. ama: those families will work with individual coaches. officials say that is the best way to create sustainable change. it will focus on some 200 individuals teaching them to resolve everyday conflicts

the agreement settles charges at the firm knowingly sold, offered for sale and distributed approximately 1,200 recalled products in 2019. the chair says the majority of sales were products recalled due to the risk of infant suffocation and death. >> now, the majority were products that were recalled that were poor babies, so one of them was fisher-price rock and play, so these are ones that we know about and did investigations of, worked to recall them, because of the deaths were that involved. we want to make sure they were taken out of people's homes and instead what happened, they ended up putting them in the hands of families who didn't suspect anything. michael: tjx provided this statement. safety is very important to us

community has been anything but. tom recorded these videos on his property. you can hear a neighbor firing off rounds and rounds of ammunition. the man who lives here has been using his home as an unofficial shooting range spending hours firing off automatic weapons. >> you feel like you're in a war zone. >> loud bursts, explosions of noise. >> reporter: neighbors say this gunfire started two months ago and could be heard for miles. it is terrifying for neighbors, including one war veteran. >> he described having ptsd symptoms. >> i had to convince my kids that someone was not coming to shoot them. >> reporter: they reached out to the county, but they were told they can't do anything because this man is on his private property. they have hired an attorney to
