drew: it is cloudy. down to a mile and a quarter visibility and a half bay. numbers a couple degrees cooler this morning compared to this time yesterday. most of us waking up to temperatures in the 50's and 60's. muggy feeling continues for another day. here is a live look from sutro tower. fog. we will keep the humidity elevated with us today. today is a warmer afternoon. we will take a closer look at high temperatures coming up. kumasi: developing this morning. construction equipment is now surrounding historic people's partner uc berkeley and this is the latest step in the fierce battle over the future of that piece in the city. the controversial plan to change this to new housing for the university. and alameda county judge gave the green light to break ground last week. reporter: the protesters who

were at this location have since left the area. all that remains our police. and construction crews and a few other officials on site. that is all that happened. it has been a very long night of clashes between protesters, as well as other people in the area. construction crews as they were loading gear and other officials in the area. to our knowledge, this happened without the opposition. -- the opposition knowing about it. they showed up shortly after midnight and started putting up barricades and fences and inserted construction without those who opposed the plan knowing about it. they arrived after midnight. we had a berkeley reporter on scene who provided as video of what happened. many clashes between protesters and individuals. this site has a long history with it.

people's park has been a site of protest going back to the 1960's. very recently, it has been used in the last few years as a major homeless site for the berkeley homeless population. berkeley has moved to the homeless to temporary housing with the plans to hopefully move them into long-term housing to they can pave the way for uc berkeley to go ahead and build this new student housing plan, which they say will help their student housing issue. as the morning has gone on, we have only seen a few remaining protesters. the big group that was here overnight has since left. we now also have a law of police on site as construction crews are still -- a lot of police on site as construction crews are still working. that is all we can say right now isis continues to develop throughout the morning. it has calmed down. there are still a lot of people here not happy with the situation. what we can tell you is there are high fences, and lots of

barricades, security and police while they go about the construction. reggie: house speaker nancy pelosi's on her way to seoul after a controversial visit to taiwan. overnight she met with taiwan's leaders and placed -- praised the values of self-government, saying this could further escalate tensions with beijing. kumasi: the former speaker call this a serious violation of the one speaker -- one china policy. china announced military exercises will take place in the air space waters surrounding taiwan. although taiwan is a self-governing island, the chinese government views it as part of china. they have not ruled out action to reclaim the territory, some the republicans and democrats agree should not happen. >> we have three purposes. one is security, for our people and global security.

two is economics, to spread as much prosperity as possible. three is government. kumasi: white house officials urged china to not turn the visit into a crisis. spokesman john kirby said "nothing has changed about our one china policy. we said we do not support taiwan independence." when speaker pelosi visits south korea, she will meet with high-ranking members of the government. the country's president will not be in attendance because he is on vacation. >> to the controversy over a san francisco school members racist comments. this descended into chaos. >> [overlapping voices] jobina: before the vote took place, audience members began fighting with each other. the meeting had to be recessed. the argument stems from comments she made about the black and

love today. that is what we have out there. august is living up to its standard of a foggy morning out there. we have dense fog along the coast. elsewhere we are doing much better when it comes to visibility. we are waking up to numbers generally in the 50's so take the light layer with theo. there is a live look from sutro towers showing you the beautiful sunrise. we are going to keep icloud for much of the morning. it is still a humid day and the high clouds have a potential to step up isolated showers this morning in the north bay. reggie: an intense neighborhood battle over housing at uc berkeley. the heavy construction machinery is moving into people's part. the historic park has been chosen for a new cal and city housing. many neighbors at the park is a critical piece of history. abc 7 news reporter ryan curry live with the early protests. reporter: but we can tell you is

there is still a few number of protesters inside the parks. they are remaining very peaceful so there is no confrontation with police which is a good sign because earlier in the evening that was not the case. you still have a very large police presence and there are still a good number of police and construction crews that straightened very tense moments throughout the night as they moved in without protesters knowing what was going on. this is a very tense situation between people who are for this and people who are against this. the protesters in the middle of the park over there. we did learn moments ago from uc berkeley in a statement that they confirmed theprior to thatr about when they were actually going to begin construction. they kept saying hopefully the end of the summer but here we are august 3 and now seeing the construction crews move in and that is creating tense moments

between people who did not want to see the park go anywhere else. know this has been a big piece of history in years past. a lot of protest happened in the 1960's and this has been a very big center for berkeley's homeless population. overnight we got video sent to us robber berkeley side reporter who captured moments between protesters and police, clashing over construction of this project. very tense moments as we mentioned here. uc berkeley had this planned for a while and they were teaming up with berkeley to get this project underway. the city of berkeley had a plan to move the homeless were in this area over to temporary housing and then hopefully move them into long-term housing that would involve them leaving people's park so uc berkeley can get construction crews in here. that is exactly what we are seeing today. they had a long battle recently in court where a judge ruled in favor of the university and that paved the way for them to start construction happened rapidly.

of course, we are still seeing some protesters who are refusing to leave. they do not want to see the part go anywhere but the tense moments of overnight have since gone and now it is just a matter of getting the remaining protesters out in peaceful fashion. this is a very delicate situation for many. kumasi: turning to the spread of monkeypox. the san francisco public health departments has more than 10,000 vaccine doses are coming to the city. it is not clear when they will be available but it is within double what they received in previous allotments. 600 50 doses were administered yesterday. the clinic zuckerberg will be open again today and will stay open until noon or until they give out the rest of the current amount of vaccines. reggie: this comes as california's second pediatric case of monkeypox has been confirmed in long beach. data shows men who have sex with men have made up the majority of

monkeypox cases nationwide but now a small number of women and children have become infected. while showing bedding with someone who has monkeypox blisters could be a danger, and trying on back-to-school clothes -- but trying on back-to-school close is low risk. dr. winslow says parents should not panic over the news of another pediatric case. >> i have children and grandchildren and i am not concerned about going back to school because of monkeypox. i really would like to reassure the viewers that their children really are not at particularly high risk for this disease. reggie: while the monkeypox vaccine is not regularly available for kids, it will be made available in certain situations where a young person may have come into contact with monkeypox. kumasi: president biden appointed an official to oversee the nation's monkeypox response. fema official robert fenton has been named the monkeypox codinator. this comes as more than 6300

cases have been confirmed in the u.s.. every state except montana and wyoming have now confirmed cases. reggie: an outbreak of legionnaires' disease has left one person dead and several others hospitalized in napa county. it is a type of pneumonia caused by a bacteria that grows in warm water. the county says 12 people have been sickened since july at desk since july 11. it is not transmitted person-to-person and can only begotten from breathing in water vapor containing the bacteria. kumasi: nancy pelosi's husband is scheduled to be arraigned on drunk driving trust that charges. he is facing misdemeanor charges of driving while under the influence of alcohol and driving with a blood alcohol content of 0.08 or higher. this stems from a two vehicle crash near his home. it is not clear if pelosi will appear in person but the dnr office says he can be represented by his attorney. reggie: election results are

still being calculated in primary elections in some states. the stage is set for pivotal contests in november. jobina: in michigan, the stage is set for a race that will put a trump-backed candidate against the state's current democrat governor. door dixon won the republican primary last night. he is against abortion rights and gain popularity for attacking governor gretchen whitmer boards covid policies. governor whitmer says the stakes are high. >> there is a lot at stake in this election. no matter who comes out of this primary, we are going to have someone who is an election denier and does not believe in efforts to kids in school, it is not an bridge women's reproductive rights. kumasi: in major win for abortion rights, kansas voters rejected a proposal to remove rights from abortion access from

the state constitution. it is the first state to put abortion rights on the ballot since roe v. wade was overturned. president biden is expected to sign an executive order for medicaid to pay for abortion services or people who have to travel to states where abortions are illegal. reggie: there is a major milestone in washburn fire burning near yosemite. mariposa grove will reopen. that is the growth home to ancient where -- redwoods. they washburn fire is now 97% contained and has burned nearly 4900 acres. the fire started july 7. all the mariposa grove will reopen, several trills in a the area are still closed. kumasi: the number of people who died from the mckinney fire has double to four. victims were found in separate homes by crews searching through the rubble along a highway. the cooler weather and rain helped to slow down the fires growth. it has burned more than 56,000

safety is what matters right now. >> why did crews move in the middle of the night? >> i just told you. obviously, a time of the park is least populated and there are fewer people there that minimizes the transfer confrontation and maximizes transfer progress. >> what you sent out said there were a few people sleeping? >> there were two separate groups here sleeping. we had some homeless people. a few months ago, the states, city, and campus spent millions of dollars to provide transitional housing to the un-housed that had been here. also constructed a new daytime center at the first presbyterian church. there were two or three unhoused people who had refused all offers of shelter. there were contacted again today by the city of berkeley's homeless response team and offers shelter and transportation. they were offered storage of

their personal items. we'll need to check with the city, peter is due and the city manager's office as to whether any of those two or three people accepted the offer of shelter. there were also activists in the park and these are people who have houses. that is a separate group who were here as part of their opposition, long-standing opposition, of the project. >> this comes out right after the recent court case between the groups. what -- was the plan to move forward as soon as possible with the construction once the court case got finished? >> we have a urgent student housing crisis at this university. a provide fewer beds than students at any of the uc campuses. we want the storm to be open and ready to roll two years from now. that is a tight construction schedule for a building of this size. students we got the green light from the court, but were going to be ready to roll. >> there were about 46 people
