4:00 pm
number one number two a video of that incident has been released by the city building management at city hall. now this video released we're looking at it right now. apparently there is no video not sure about the quality of that video, but it shows at least what happened the moment? it happened the exchange between both butler and walton and what point did their super his supervisor intervene? and of course the people who were there now in the meantime, here's what cadet butler and supervisor walton told me. i just want him to tell the truth amari butler granted us an interview stating that he wanted to clear his name and remind people of what happened on that busy morning of pride weekend when board president shaman walton went through one of the security checkpoints at san francisco city hall in the past. the supervisor would always get
4:01 pm
screened with a handheld security wand so it was really crowded so when he came in i tried to give him a warning, you know, he's gonna have to take off his belt and decided that he wasn't gonna do it unwilling to cooperate cadet butler says supervisor walton verbally harassed him in front of everyone waiting in line looks at me points out the window and says, it's in words like you look like me. that's always a problem and he continues to go on and say this is some, you know inward --. and repeats it again at that point butler says his supervisor allowed walton to go through the checkpoint but not without in his words threatening him so he gets us things and as he's walking towards the elevator. he looks at me and he goes, he must not know who i am. i whoop your --. and over the cities harassment welcome visual verbal or
4:02 pm
physical conduct in recent days supervisor walton has gone on the record accusing the sheriff's department of retaliating against him stating that in the past. he has received unfair treatment at the security checkpoints today. we approached walton who a few weeks ago asked school board member and shoe to resign after she made some racially insensitive remarks towards black and latino families. what's your reaction to all of this controversy? the thing is you've asked and shoot to resign and she apologies you apologize. so let me be clear about this and shoe made racist remarks towards the black and brown population. that has nothing to do with the inaccuracies reported by the sheriff's department. you have my statement if you want to sendour 'ret ou shoulyos have asked walton to resign with the exception of dean preston. most have don't i have no inteno
4:03 pm
do that and not no. no, but my question is that you know you to college the collins and then you asked and shut your ear to do an interview about the eviction rally. we have tenants residents facing eviction here. so, you know if your question is am i asking shaman walton to resign the answers no full transparency abc 7 news did cover that press conference on evictions for our newscast in the meantime cadet butler says at this point an apology from walton wouldn't mean much to him. and yes, i do feel offended by some of the things. he said as far as the comments about it being about solidarity and between two black men, i don't agree with that at all. and you read the city harassment free workplace policy and you can certainly argue that this cadet falls under the category of protected class now larry harassment of employees applicants or persons providing
4:04 pm
services to the city by contract whether by employees or non-employes, employees. they say is prohibited. stay with us here as we bring in abc 7 news insider film. it's here joining us. you saw leann's reporting on this whole confrontation and what is happening at city hall where you have this situation you have the the anshu situation and she was rebuked for her comments. she rebuked herself. she apologized and rebuked herself. what's going on city hall is the mayor has asked for shaman to apologize. nobody's asked for him to resign but this is a classic case larry of the supervisors and the elected officials. make the rules but they don't necessarily have to follow themselves the city can find make a finding on the supervisor, but that doesn't they don't get to hold them accountable elected officials get will do that themselves. it's interesting also to note that about a year ago us fellow supervisor aaron peskin apologized for his bullying of
4:05 pm
city staff at when confronted with it and at the time shaman walton defended pescence saying that no, no, in fact, the true bullies were the members of the mayor's staff who said they were being bullied by a pescat so you get gives you a flavor of what's going on phil and i want to add this you can almost call this a will smith moment if you will, you know, we can say what was going through the mind of the board president shaman walton, but clearly he was very upset. apparently. he lost his cool and he acted now again what this cadet is me is that at this point an apology at this point wouldn't mean too much to him as you heard there, but what he wants from supervisor walton is for him to go in front of all the supervisors and in his words. tell the truth. well, this is where things get complicated and lawyers get involved leanne to put it very bluntly. you know, the more that the
4:06 pm
supervisor sort of places to blame on the cadet that increases possibly the these liability should the cadets say, you know, i'm the one who's being attacked here. i'm going to file a claim against the city and so it's either there's a rule in politics if you're in trouble stop digging and at this point supervisor walton doesn't appear to be to stop and digging. and hearing from one of my sources that the line to defend this cadet is very long there you go. that's politics. we'll see how it plays out before we go here phil. what are the possible scenarios? okay, how could this play out? well one thing is there could be the cadet could win a hearing in front of a city board to decide what actions or have it reviewed have it go public even if the board of supervisors doesn't take it up the board of supervisors could although shaman walton is the president tried to make some statement there once they're back from their recess the other one. is what we see a lot in america the lawsuit and you can bet that
4:07 pm
everybody is looking at that going. okay. what's the city's liability in this when the dust settles if it ever settles? to be continued leanne phil. thanks very much for your insights. and other news and appeals court has temporarily stayed construction and further demolition at berkeley's people's park, but uc berkeley will be allowed to put up a security fence. the university wants to redevelop a portion of the park with housing for students and people experiencing homelessness protests over the plan resulted in dramatic clashes between police and protesters seven people were arrested and two officers were hurt uc berkeley issued a statement writing in part while this new injunction. will add further delay in significant additional costs to the project. we are pleased the court has agreed to an expedited process. yesterday a clash broke out at parker elementary in oakland between parents community activists and district security officials much of it was caught

4:19 pm
afternoon, you'll like tomorrow's it will get maybe a degree or too warmer by sunday, but still sunny and pretty mild by summer standards all throughout the weekend. we'll even see more sunshine at the coast this weekend and then next week. we'll start to get a little bit warmer starting tuesday. you see look at that 11 degrees cooler and conquered about two in san jose seven in novato and santa rosa so if you've been outside, you definitely know it's going to be a great evening because this is gonna translate into pretty comfortable temperatures right now. we have mid-upper 60s half moon bay in san francisco. 70s around the bay and a few eighties as you head to the south bay north bay in east bay, per hour 65 prettyvegot theree5 comfortable there. it's going to accelerate up to 30 miles per hour through the delta like it's been doing for the last couple evenings and that will continue until nine o'clock where temperatures will following back into the 60s and maybe a light jacket need to buy 11 o'clock most of us in the low to mid 60s tonight with the cloud cover over top of us still a touchy humidity in the air. little bit milder than the

average by a couple of degrees upper 50s to some mid-60s tomorrow. look at this some 70s holding on around both peters and sunnyvale. no 90s in the south bay just a whole lot of eighties elsewhere for the peninsula to get a little breezy around millbrite 73 not as much around redwood city, so you'll warm up to about 80 degrees the coast. we should see a lot more sunshine than today mid-60s there and upper 60s to near 70 for downtown and south san francisco with breezes kicking in during the afternoon nowers. you'll feel those in sausalito. so but these are subtly breezes and that's why they're not quite as cold as what we would normally think about this time of the year temperatures in the upper 70s to mid 80s in the north bay 70 at berkeley the 76 at san leandro. so temperatures in the 70s all across the east bay and inland. we're still looking at some 80s to deal with now if you're going to outside lands, i think we're going to see more sunshine and maybe you're used to at this event 66 fog to sunshine saturday and about 66 sunday. all right. here's a look at the cloud cover. see pretty extensive tomorrow

california brown pelican spent nearly 40 years on the endangered species list before making the comeback, but now they are facing a new challenge. yeah wildlife experts want to know why hundreds of the birds are showing up dead or sick. this is happening up and down the west coast abc 7 news reporter cornell bernard spoke with experts who are trying to figure out is going on. we continue to be on high alerts jd bergeron. ceo of international bird rescue is alarmed about why so many sick california brown pelicans have wound up in his two rehabilitation hospitals in the bay area and southern california. the only thing they all have in common actually is starvation
4:25 pm
symptoms of starvation and emaciation and dehydration. bergeron says since may 334 brown pelicans have been cared for about 50 of them were found stranded in the bay area. aviaries and things were filled to the gills with with pelicans some of the birds suffering secondary injuries from fishing hooks or were hit by cars trying to find food in unusual places. the big mystery here is why are they serving? so we're we see them coming in with broken wings wildcare in san rafael has also cared for the injured birds and this year. the numbers are higher. we in 2022 so far have admitted 14 emaciated pelicans in anyone, we admittedou n for the avian flu, which is on the rise, but climate change is another theory. ocean is the water is warmer. it drives fish away from their traditional hunting grounds, but the water temperatures are also

not high in a statement the california department of fish and wildlife said pelicans feed primarily on anchovies, but anchovies are currently abundant and it is unclear why these pelicans were not able to find enough pray over this relatively short time frame in may. it is possible the prolong periods of unusually strong winds and late april and early may interfered with their ability to forage, but many pelicans are still starving dozens have died. the good news is about 197 birds have been released back into the wild after rehabilitation while experts try to understand why many of these amazing seabirds are going hungry. this could easily be a cater of a larger problem. we just don't know yet what that problem is in marin county cornell bernard abc 7 news. coming up covid cases have surged. thanks to a sub-variant why faulty testing could be one of the big factors in the spread of ba-5. the school district is the school year is about to start in

it's based on more traditional protein-based technology. so question, why is the omicron ba-5 sub-variant spreading so quickly ucsf infectious disease expert is now saying it's inaccurate testing that may be causing rapid spread abc 7 news reporter dustin dorsey explains how we test for covid could help curb its spread. as the country continues to battle with the latest dominant covid-19 variant ba-5 president, joe biden said vaccinations treatments and tests are key. but what happens when one of those strategies doesn't work as intended san jose's isaac velasquez says, he and his fiancee never got a positive result on their home test despite being exposed and showing symptoms for covid. i ended up coming out negative twice. she was testing negative four times. it wasn't quite adding up so we decided to go to the hospital to do some of the pcr tests. ended up testing positive a couple days later.
4:31 pm
this story is becoming common according to ucss dr. peter chenhong and it's causing concern. i'm worried that a lot of transmissions occurring not because people are being devious or irresponsible is just that they don't know they're positive dr. chin hong says it's not that the tests aren't working. it's that the ba-5 variant is just behaving differently than other strains of the virus. he says symptoms for ba-5 first show up in the throat meaning a nose test won't show a positive result for several days. you'd be swabbing, you know. until there's no tomorrow if all the actions in your throat, it takes a while for that virus to go up to the nose. so that's why you're turning negative. for a long time until you tune positive when the virus gets up to the nose dr. chin hong says the other factor is how a vaccinated person's immune system responds to this strain. you might have symptoms, but there's not enough virus particles in your body for tests to show positive results. the rapid tests needs a hundred thousand or more virus to tune
4:32 pm
positive. whereas a pcr just needs like five or less than 10 viruses to tune positive for this reason he suggests a pcr test may be better than a test or use the swab from a home test to swipe your throat. then your nose to get a better result dr. chinhong also says testing at least five days after the start of symptoms could help prevent this highly transmissible variant from spreading even more in the south bay dustin dorsey abc 7 news. president biden has signed into law to bipartisan bills aimed at stopping fraud under pandemic relief programs. the two new laws will extend the time period to prosecute individuals who committed fraud through the paycheck protection program or covid-19 economic injury disaster loan program, mr. biden said the goal is to make cheaters pay back what they stole and hold them accountable under the law whether it's pandemic burnout or low salaries schools are not attracting enough teachers, of course. this is not something parents want to hear abc 7 news reporter
