arguments. karina: he joins us live with a look at what happened. zach: closing arguments just ended a few minutes ago. i want to pan the camera over. we are hearing from scott peterson's sister-in-law who is reacting to what happened. this is the last chance for attorneys on both sides to get their points across before a judge decides if peterson's conviction is overturned and he gets a new trial. his attorneys believe a new trial would give him a chance to present new evidence that could clear peterson. peterson was in court alongside his attorney. you see some of his family members here and also family members of lacey peterson. it has been nearly 20 years since he murdered lacey peterson and her unborn son. scott peterson was convicted of the murders in 2004, but his fate is up in the air because of controversy around one of the jurors on the trial that led to his conviction.

when asked if she was the victim of domestic violence, she said no, but attorneys found that back in 2000, she was involved in a domestic dispute with her then boyfriend and later his ex-girlfriend. she claims she did not consider herself a victim, but the assistant da pushed against peterson's attorneys' claims, trying to prove that she did not intentionally lie in her questionnaire. >> she is inconsistent on her answers, but being wrong does not necessarily make it false or make it -- or make her a liar. >> the point peterson's attorneys have to prove is that she did not accidentally answer wrong but intentionally lied to get on the jury. in court today, the judge pushed back, questioning the claims of peterson's attorney multiple times, but this was the final time attorneys on both sides were able to get their arguments out and the judge now has 90 days to issue a ruling on if there will be a new trial. at this point, no date for a ruling has been set.

we will be sure to bring you the latest as soon we get it. like i said, we did just hear from family member of scott peterson. we will have some of her reaction to what happened today coming up at 5:00 and 6:00. >> we will see you at 5:00. peterson was arrested on april 18 two thousand three in san diego. on the same day, a coroner confirmed a body found days earlier in san francisco bay was that of his wife. peterson's trial began with a six-man, six-woman jury. five months later, peterson was found guilty of first-degree murder. in march 2005, he was sentenced to death. in august 2020, california's supreme court overturned his death sentence, bringing us to where we are today. karina: two people have then detained, but so far, there are no arrests.

>> this happened just outside the 24-hour fitness. ryan curry has the latest on the investigation. ryan: police tape surrounding a 24-hour fitness in the early hours. brentwood police site an altercation broke out involving a large group of people. that night led to gunfire. >> there was some cap of altercation that took place inside of 24 hour fitness that carried out into the parking lot. things escalated to at least two shooters pulling out firearms and exchanging gunfire with one another. >> one person died and three others went to the hospital injured. those injured police say brought themselves to the hospital. that's when they learned about the shooting, only to arrive to a hectic scene. >> there was a lot going on, as you can imagine. they were trying to gather information on vehicles of the potential persons involved and start working on the collection of evidence. >> markers of that evidence on the ground as investigators try to pinpoint what happened.

in the case. if granted, a list of these items would be granted to the public if the former president does not object. >> i will not stand by silently when their integrity is unfairly attacked. the men and women of the fbi and justice department are dedicated, patriotic public servants. karina: abc news has learned trump initially received a subpoena this past spring for the documents he reportedly took from the white house and failed to turn over to federal investigators. vice president harris is in the bay and had a meeting in san francisco today to talk about abortion rights. she met with california's attorney general, state politicians, and leaders from various reproductive rights groups. the vice president heard about efforts by the legislature to pass 13 bills that expand or

protect abortion access in california. the vice president will be in oakland tomorrow to talk about the private aerospace industry. larry: government -- governor newsom is in contra costa county pushing for new let, and desalination plants in california, which is expected to lose 10% of its water supply in the next two decades. >> what we are focusing on is creating more supply. what we are focused on is creating more water. what we are focusing on are projects exactly like this here in antioch, but -- larry: the antioch desalinization plant is the first to process water from the delta and will supply 30% of the state's water needs when

completed. on the left is today's drought status. when you look side-by-side, you can see how a swath in the central valley in particular is getting worse, but conditions in southern california are improving slightly, which takes us to meteorologist sandhya patel. any rain anywhere in the forecast coming? sandhya: yes, but not for the bay area. it looks like the sierra southern california will have the best shot at seeing any rain. as you just mentioned, this is the area you want to keep an eye on, all right? this is last week for the central valley. take a look at the drought monitor. as of today, you can see that the central valley, that exceptional drought has expanded. fortunately, the monsoon moisture actually brought about some improvement in southern california and the sierra nevada. this area is actually looking at a decrease in the extreme

drought category, so we have seen an improvement here in the bay area. no change. this is one of our driest months and we do not expect any rain locally. high-pressure funneling some of that monsoon moisture into the southeast portion of the state. as we go into next week, we will see an increase in that monsoon flow, which means more showers are expected in the sierra and southern california, which will help their drought situation. we will keep and i on it. karina: an initiative designed to improve traffic safety on the streets and roadways of san jose is getting a big financial boost. city leaders announced they are getting $10 million in additional funding from the state. the new round of funding would go towards safety improvements along the east san jose corridor. >> this is the dangers of those corridors, and we have been attempting to invest in making

these priority safety corridors much safer throughout our entire city, but we have limited resources in both money and staff time. karina: the goal of san jose's vision zero initiative is to eventually eliminate traffic deaths and severe injuries by pushing for improved safety measures, lowering speed limits in some areas, and making sure police are enforcing traffic laws. larry: happening tonight, community members will have a chance to address concerns over the chert of san francisco's castro theater. planet entertainment took over the theater earlier this year, and tonight, they will address concerns over urban ovation. some in the lgbtq community have expressed concerns that queer voices could be pushed out of this venue. that meeting would start tonight at 6:00. karina: covid guidelines two and a half years into the pandemic, and some major restrictions are being lifted.

the filing deadline is tomorrow. gabriella lopez was serving as board president when she and two others were recalled over issues like remaining in schools during the pandemic. larry: months after pink slips were sent out to dozens of teachers, an influx of new students has changed the game plan, boosting enrollment. cornell barnard explains what is behind that jump. >> just being able to meet those kids at the door, it is exciting to have that opportunity to be part of their lives. cornell: angela is a fourth-grade teacher and is ready to welcome new students next week and this year, it will be a full house. >> i'm 29 this year. cornell: she teaches at pleasant valley elementary school where a big jump in enrollment happened over the summer. almost 50 new students are starting here. >> i would say the most

challenging thing is having more bodies in the classroom, making sure that we differentiate enough. >> district-wide, the news gets better. faced with declining enrollment and budget cuts, and unified has seen an increase of almost 300 students. >> we are super excited to have an increased enrollment because a lot of the kids are returning from private school, and also there's a lot of new kids moving into the neighborhood. >> the expansion of transitional kindergarten classes along with fewer covid restrictions has brought many families back to public school. >> while i'm excited for her to have the opportunity because we are traveling pretty far. >> catherine says her daughter was starting in the marin school of the arts program. >> it is the opposite of the district where we are residence, which has a declining enrollment and is sort of enjoying more space. >> statewide, california schools

are at risk of losing funds due to declining enrollment. in 2018 and 2019, california schools lost about 20,000 students. between 2020 and wendy 21, public school enrollment dropped nearly seven times that figure with more than 160,000 students dropping out. in nevada, more students means the district will receive about $14 million in covid recovery funds and layoff notices issued last january to about 80 teachers have been rescinded. >> we are so excited to welcome all of our kids back on tuesday. larry: kids are heading back to school and inflation is putting a big squeeze on family budgets. the national retail federation estimates shopping for school supplies and clothing for kids will cost an average of $864 this year. that's $168 more than in 2019. another study found nearly half of parents will have to take on

debt just to pay for back-to-school supplies. karina: creating more affordable housing is one of the challenges of building a better bay area. accessory dwelling units are addressing this. as david louis shows us, these low-cost homes are also helping multigenerational families stay close by and for elders to age in place. >> it turned out to be great. david: with retirement on the horizon, they wanted to live close to their children and the grandkids. >> we were trying to figure out a way we could stay in san jose. david: they found a house where they could build an accessory dwelling unit. a two-bedroom house just shy of 1200 square feet. >> this was a huge solution both for them and for us because now it appears that we can live in one house and they can live in the other and it is all, you know -- i don't know -- it all works. the numbers work.

david: it was built for $350,000. it is prefabricated and brought to the site in two sections. they love the non-foot ceilings. it also came with most of the appliances. >> we were able to build the majority of the home off-site, allowing us to build the home and disrupt backyard for a very short time. two or three, sometimes for months, as opposed to years. w swap houses a way to agease. as their daughter's family expense. more room for family is also a reason why tom kearns is in his backyard. >> we like having the family around us. now some of the nieces and nephews will be coming here for parties because they live in apartments. >> california has made really great strides with laws and every single family home in the state can build a house, which is amazing, but there's felt a lot of progress to be made.

>> supply chain issues have eased up, and they hope next are to be able to produce two to three times as many adu's as they are now. larry: the mystery of that lost dog from gilroy found in germany has been solved. gilroy police were contacted by people in a small germantown telling them they found a dog with a gilroy, california dog tag. their first thought, the putsch belonged to a military family. turns out the owner was visiting his mother in germany when the dog disappeared. dog and owner have been reunited and are continuing their european vacation. the dog looks extremely happy right now. karina: yeah, reunited with owners getting to continue their vacation. i think that's great. larry: frolicking. karina: it just shows how important those dog tags are. larry: ships as well. karina: exactly. larry: let's get to the forecast. i know we are in for a warm up

here. karina: yes. week.ll getr because wan swou something interesting. notice the low pressure system off the pacific northwest coast. that is keeping a west/southwesterly wind going, which means we are not seeing the normal up flowing with a northwest wind, and that's why ocean temperatures are running in the low 60's. normally you're in the mid-50's. bodega bay a little higher, 57-degree dew point. temperatures, you will notice, are also running a little bit high for our taste. many other parts of the bay area feeling a little muggy, especially near the coast. the sea breeze certainly is helping. we do have gusts up to 37 at sfo. 37 sustained in san francisco right now. there's a little bit up haze in the air. it is in the low 70's around oakland, 79 around san jose.

temperatures so far have made it into the low 90's inland, but still comfortable in the 60's coast side. we have seen a few high, thin wispy clouds. 86 in santa rosa, 81 napa, 89 degrees in fairfield. on live doppler 7, we have the lack of rain, unfortunately, from our tower camera. this is what you will see more of, sunshine. overnight dog knew the coast and summer heat returns next week. as we go hour-by-hour, the shower marine layer is about 1500 feet deep right now. we will push in over the bay tomorrow morning at 5:00, you will notice the fog around and it will pull away. most areas should see the sun to end the work week. morning temperatures will be in the 50's and 60's with that fog. just a reminder, it is a super full sturgeon moon tonight. check it out if you get a chance. obviously, you have to get away from the fog to get a good glimpse. we also have meteor showers coming up after midnight.

break out the paddleboard with his dog brutus by his side. he got about 150 yards out before noticing something wasn't right. >> and i saw, like, the shadow figure underneath me kind of approaching my board on the one side and kind of dove down, and it was large, so my brain thought small whale. >> seconds later, he realized this was no whale. >> it came up really aggressively and hit the middle right side of my board with its body as its mouth was coming up, and it made a turn and latched onto the front right of my door. >> he says a shark was within three feet of his face, biting down on his prize paddleboard. >> it was kind of thrashing around, and then it lit go and off the board, but gave a quick turn that felt like its nose thrusted into the bottom of the board, which threw me and my dog

off the board. >> that's when he says his fight or flight instinct kicked in. >> my system just responded very methodically. i need to flip the board over immediately and save my dog. >> is the director of san jose state university's pacific shark research center. he estimates the shark could be two or three years old. >> when they get around 10 feet, they start to look at marine mammals and things like paddle boards and surfboards, they start investigating more. their diet is shifting to larger prey. >> he says this was his first time back in the water since june, only a day before the last shark attack in this area when a shark bit a swimmer in the stomach and leg. he suffered severe injuries. stickler flagged down what he believes was a whale watching boat that just so happen to have a group of buddhist monks aboard. they immediately started to pray over him and help guide him and

over the scene at ridgeview and jackson oaks. calfire says the worker was paving the road when he fell into that open manhole that you see them working over. they estimate he felt about 20 feet down. we will keep you updated on this breaking news and you can download the abc 7 news app for updates any time. larry: now on to covid headlines. two and a half years into the pandemic, the cdc is relaxing some of its guidelines as of today. the cdc dropping the quarantine regulation for people who come into close contact with an infected person. people no longer need to stay at least six feet apart. the cdc also dropping the recommendation that schools do daily testing, the practice can be reinstated if there is a surge in daily infections. joining me to talk about this is abc news contributor dr. patel. thanks for your time. on the face of it, sounds like we kind of declared covert is over, we are throwing in the towel, carry on.

dr. patel: that is kind of what it seems like, but i think the approach is more that covid is here to stay. it is now time we look at the individual risk. obviously, this is met with a lot of criticism. on one hand, i understand we have to do everything we can to keep schools open, but on the other hand, we need to be realistic and realize we could see another surge and when we are at that point, when people are getting exposed and not quarantining at all and doing what they have in doing according to pre-pandemic, we might be in a tricky situation. larry: it seems obvious that if we get good up a lot of these rules, we will have more surges, but with kids heading back to school, what kind of impact do you think this will have on them? i would getting right back to where we started? dr. patel: i think it is important the cdc made the decision that we have about 95% of people with either natural or vaccine-acquired immunity and we cannot ignore the fact that we

have made great progress, which the cdc stressed. regarding schools, it is concerning only about 30% of those kids aged five to 11 have gotten their vaccines. smaller number for kids below that, and we have eliminated things like test to stay. a lot of kids will not be wearing masks, but i like that the cdc was stressing ventilation and everyone out there will be doing everything they can, like i mentioned, to keep schools open. larry: let's talk about the fda, which is now recommending three tests to confirm a negative result. it was two. why the change? dr. patel: the change comes a new emerging data suggesting that rapid antigen test may not be as good at picking up some of the omicron variant's. some people have been saying we have suspected this all along, and we really have, so i think this is just another guidance for people at home. in other words, if you have been exposed, even though there are no quarantine requirements, it

is still a great move for yourself, for people around you to take those tests at home. we used to say take two negative tests 48 hours apart, and you will probably be fine. now it is best to take three, especially if you hour someone around you is high risk or you work in a high risk setting like myself. larry: we should be clear, these are specifically for the at-home tests. i assume the original pcr tests are ok. dr. patel: you are right. these are for the at-home rapid tests. what will be tricky is when people out there feel fine and they take one and it is negative and they say if they take another when in that one is positive, then what restrictions do i fall under? there will be a lot of confusion out there, which is why it is important that we stress that it is still up to the individual to do what you can to make sure you are protected, regardless of what any headline says. community levels are still high in most of the country. larry: we will see where all of
