4:32 am
motion with the florida judge to unseal the warrant along with a list of items taken. >> it will ultimately be the judge's decision, and a ruling could come as soon as today. meanwhile, we're learning more about the information trump may have had in his possession, which triggered the fbi's search. in the wake of this week unprecedented fbi search at former president trump's florida home, multiple sources now tell abc news that the justice department and the fbi believe trump continued to keep sensitive classified documents that had national security implications. sources say in recent weeks, officials received additional intelligence suggesting trump was not complying with the justice department's request to provide them with the documents. sources say the information in the documents was sensitive enough that authorities were eager to take it back into their possession. sources say part of the information investigators were looking for during the mar-a-lago search included
4:33 am
material labeled special access, which is accessible only to people with the highest security clearances. sources say federal investigators have questioned many individuals close to the former president about these materials. this all comes just hours after the justice department filed a motion to unseal the search warrant and an inventory of items retrieved in the mar-a-lago search. minutes after that motion was filed, attorney general merrick garland addressed the search on camera for the first time saying, he signed off on the fbi's actions himself. >> i personally approved the decision to seek a search warrant in this matter. second, the department does not take such a decision lightly. >> reporter: abc news has learned trump was subpoenaed for the documents earlier this year after a visit by a smaller group of fbi agents in early june. the search on monday came only after the justice department concluded trump had not turned over everything demanded by the subpoena. >> that could explain why the department of justice felt the need to go in there with a criminal search warrant. you heard the attorney general

talk about how they typically try and use less intrusive means. well, maybe this is the explanation for why they had to use these more intrusive means, that because they tried a subpoena, they tried to get the documents and didn't get them. >> reporter: the justice department filing was signed off by the chief of the counterintelligence section of the national security division suggesting the investigation is related to classified information with national security implications. abc news learned yesterday that although trump's republican allies have been calling on the justice department to release details of the search, trump considered fighting to stop the information from being released, but overnight, the former president saying in a statement, not only will i not oppose the release of documents related to the un-american, unwarranted and unnecessary raid and break-in of my home in palm beach, florida, mar-a-lago, i'm going a step further by encouraging the immediate release of those documents. now we should note that copies of the documents the justice department moved to unseal
4:35 am
including the warrant are already in trump's possession. he does not need to wait for a judge to unseal them. he could release them himself whenever he wants. >> so the question now, if the judge agrees to unseal the search warrant, what could we learn? we got some insight from former federal prosecutor kan nawaday. he spoke with our phil lipof. >> so at first republicans are saying, we need to see what's inside that search warrant, right? so what do we learn if it gets unsealed? >> if it gets unsealed, it's going to be very limited. it's not going to be the full facts of the investigation. i highly doubt that the court and garland is seeking to unseal the law enforcement agent affidavit. that's where all the facts of e for probable cse. what they're going to unseal is the warrant itself, which is a one-page document, doesn't really say much and attachments that set forth the type of documents that can be searched for. and it might set forthth the criminal statute they're investigating. >> and we're talking about classified documents we think as
4:36 am
well, so you can't release what those are either, correct? >> exactly. it's going to be highly redacted. i don't think the release of the warrant and the attachment will actually inform much. it'll give people, you know, insight into what they're looking into, but it won't be that illuminating. >> again, the justice department is not yet seeking release of the affidavit, which supported the search warrant. that document would contain far more information about the investigation. also overnight, new details about the man police say tried to break into the fbi's field office in cincinnati firing a nail gun and opening fire during a police chase. he was eventually killed. abc's ike ejiochi has new information about that suspect. ike, good morning. >> reporter: good morning, mona. law enforcement officials are now labeling the suspect, ricky shiffer, a suspected violent extremist. this morning, the investigation into ricky shiffer, the man authorities say tried to breach
