mistakes. >> the shakeup comes as the cdc plans to roll out a new covid vaccine in weeks. faith is in washington with the details. good morning. >> good morning to you if ctc director says the agency spent 75 years preparing for a health crisis like the covid pandemic, but when the big moment came, they did not meet expectations, and she's calling for a reset as we get new covid data. this morning, the centers for disease control ordering new booster shots as new data shows while the rate of new infections continues to fall, virus-related deaths remain high. an average of about 400 american covid deaths being reported every day. the original strain and the ba 4 and 5 subvariants making up an estimated% of 99% of all infections. the new shots meant to target those strains. >> these are substantial

upgrades in our vaccines. >> they could approve the boosters within the next three weeks and make them available to anyone 12 and up for pfizer and 18 and older for moderna. >> i would like to get to the point where everyone who wants a vaccine can get one. what's really limited us is a lack of resources, but we are fulling from other high priority items. >> the cdc also headed for a major overhall. a new review of the agency found during this and the previous administration, the nation's top public health agency failed to meet expectations amid the covid-19 pandemic. calling for a reset, telling agency staff, quote, we are responsible for some pretty dramatic, pretty public mistakes if agency review found the cdc's covid guidelines on masks, vaccines and more have been confusing and overwhelming. >> it's like contradicting.

it's a lot of stuff going on. don't do this or that and we have to listen to both. >> and as part of the sweeping changes, the doctor is calling for internal cdc staffing changes. she also wants the agencies to share information faster and in plain, easy to understand language. >> faith, thank you. now to the other major story unfolding today. a federal judge will determine whether the unseal the affidavit used to justify the fbi's search of former president trump's florida residence. just part of the legal wrangling around trump and several associates today. today the judge who approved the search will hold a hearing to decide whether the unseal the affidavit used to justify that search. the judge is set to hold a hearing this afternoon after several media outlets requested the documents be made public citing the, quote historic importance of these events.

but the justice department has requested it remain sealed as it could cause significant and damage into its ongoing criminal investigation. trump has also called for its release saying it's, quote, in the interest of transparency, and mike pence echoed that. but as some republicans continue to decry the mar-a-lago search, pence called on his party to stop attacking the fbi. >> these attacks on the fbi must stop. we can hold the attorney general accountable for the decision that he made without attacking a rank and file law enforcement personnel at the fbi. >> during that same speech in new hampshire, pence hinted he may be open to testifying before the january 6th committee. it comes as legal issues mount for some of the former

president's closest allies. today, allen wiselburg is expected to plead going according to new york times, as part of his plea deal, he will admit to all 15 felonies he's accused of and may have to testify about his role in the scheme if it goes to trial. >> when you met with georgia lawmakers, did you lie to them? >> and on wednesday, trump's personal lawyer rudy giuliani testified for six hours as part of a criminal investigation into trump's efforts to overturn georgia's results in the 2020 election. >> you've got voter fraud right in front of people's eyes. >> while testifying if before state lawmakers in 2020, he made false claims about election fraud including this comment about black election workers. >> they look like they're passing out dope, not just

accountable. >> a former nfl star is alleged to have instigated a brawl at a football game in texas. >> video tells the tale. >> video shows an argument between coaches and the officiating crew. multiple witnesses say a five-time pro bowler in the nfl came on to the field to confront the referees and allegedly punched mike hickman, a coach from the other team. then his brother pulled out a gun and opened fire, killing hickman. >> four people were actually pursuing mike, and they get into a tussle, he falls to the ground, then the brother shoots him. so he's shot in the arm first, and then he turns to run away, and he's shot in the back four times. >> he's not been charged. he was recently announced as an

analyst for thursday night's football broadcast. in a statement, his attorney says his client was present when this unfortunate incident occurred and is very distraught and devastated over the terrible loss of life. adding, i believe once all the witnesses are interviewed, there will be a different perspective as to what happened. he's charged with murder after turning himself in. loved ones describe hickman as a beloved father and grandfather. >> it was four or five against one person, and it escalated and obviously what happened happened, so i just think that more people should be charged. >> police say they are still investigating if any other charges will be filed in this case. authorities are working to identify a fifth set of human remains found in lake immediate, the nation's largest is at record low levels due to drought. it's believed the latest victim died of a gunshot wound up to 50

back now with some incredible video of good samaritans coming to the rescue in texas. nip people joined together to save a driver involved in a rollover crash. it happened monday morning in san antonio. the group flipped the car upright. paramedics later got the man out and he is now recovering at the hospital. the family of a man who fell from a milwaukee draw bridge wants to know why the bridge was opening while he was still walking on it. >> reporter: this morning, there are questions as to why a bridge operator opened a milwaukee draw brdge while a man was walking on it, sending him falling 70 feet to his death. surveillance video cameras show the man in the middle of the bridge as it begins to rise.

the victim identified as 77-year-old richard, his family now wants answers. >> the biggest question is, if anybody is responsible for this. >> reporter: his son says his father visiting from rhode island was wearing a hearing aid as he walked across the killborn avenue bridge with his wife on monday. he was using an ipad to find his way to church. alarm bells sound off before the gates come down and the bridge goes up. the medical examiner's office believed he didn't hear the warning. the department of public works officials say the bridge operator who remotely monitors from a tower a mile away is required to check two live cameras before closing the >> if there are anything that needs to change, and our process is, well, of course, evaluate these things. >> reporter: this tragedy one of several nationwide of people getting caught off guard when a
