situation. britt, thank you so much. we're going to turn now to the battle over the fbi search of former president trump's florida residence. a judge indicating he will unseal some parts of this affidavit used to justify that search. terry moran is there in washington with the latest on this. the former president is saying publicly he wants people to see this affidavit and what's inside of it, but his lawyers aren't actually calling for that yet. >> reporter: that's right, cecilia. saying one thing in public is not saying anything in court at this time, but the ruling by the judge in this case was somewhat unexpected, in a case the whole country is watching. he's trying to find a middle ground between the justice department's need to protect this investigation and the public's right to know. this morning, the federal judge who authorized that fbi search of former president donald trump's home say he's trump's home say he's inclined to let the public see at least part of the affidavit that the department used to justify the search telling lawyers, i'm not prepared to find that the affidavit should be fully sealed.
7:06 am
the judge gave the justice department one week to propose which parts of the affidavit it would be willing to release. that affidavit outlines the evidence collected by investigators such as cooperating witnesses along with the agency's next investigative steps. >> it includes a roadmap for the investigation as it stands right now. >> reporter: but while trump has demanded the full affidavit be released, his lawyers haven't taken any action to do so. instead, it's news organizations including abc news that are arguing in court that the public has a powerful right to know more. their lawyer declaring -- >> we are entitled to monitor the affairs of our government at all levels. >> reporter: the investigation into trump's alleged mishandling of classified information and white house documents is in its early stages according to doj lawyers. they argue the affidavit should remain sealed to protect the integrity of the investigation along with witnesses' safety warning, this is a volatile situation across the political spectrum, but certainly on one side in particular. trump and his allies have

repeatedly attacked the fbi, the doj, and especially attorney general merrick garland. so the justice department now has a week to propose its redactions to that affidavit. they're concerned about classified material, about witness safety. if the judge disagrees, if the judge thinks more of it should be made public, the justice department can appeal. it could be weeks before we see much or less of what's in this affidavit. cecilia? >> this isn't happening any time soon. okay, terry, thanks. we're going to stay on the legal battles for the former president. one of his trusted executives, pleading guilty to tax fraud. our senior investigative correspondent aaron katersky joins us with more. good morning, aaron. >> reporter: cecilia, good morning to you. at 75 years old allen weisselberg preferred to go to prison for five months and pay a $2 million penalty rather than turn on trump. he pleaded to all 15 counts

admitting that he schemed with the trump organization to evade taxes by paying certain executives including himself with luxury cars, leased amounts and school tuition, none of which was declared as income. weisselberg is now going to have to testify against a company he worked for for 50 years because of this indictment. >> it's hard to say how close his ties were to the trump organization, but the trump organization itself maintain they've done nothing wrong in this. >> reporter: nothing wrong, and the case is political in the eyes of the trump organization. the company says they will not be offering a guilty plea of its own trial scheduled for the fall, but weisselberg's testimony really could make things difficult for the company because he has copped to a tax fraud that began when donald trump was hosting "the apprentice" and ran all the way through his time as president. cecilia? >> you'll stay on top of this. aaron, thanks. gio?
